## SHORT TITLE This Bylaw may be cited as "The Business License Bylaw" ## 2. INTERPRETATION - a) "Applicant" means a person who applies for a license or renewal of a license required by this Bylaw - b) "Door to Door Solicitors" means any individual or company that travels throughout the municipality selling goods or services by door to door soliciting. - c) "Home Based Business" means any person who operates a business out of their residence whether the building is open to the public or not. - d) "Store Front Business" means any business who operates within the Village whereby their building is open to the public. ## LICENSES NOT REQUIRED - a) No license shall be required by the Village of Acme, their employees or Council for business carried on or operated by the Village or at a location operated by an official or employee of the Village acting on behalf of the Village in his capacity as such official or employee; - b) No license shall be required of a business carried on by the Governments of the Province of Alberta or Canada nor shall a license be required by any person or business if any statute of Canada or the Province of Alberta exempts such person or business form requirements of municipal licensing. ## LICENSES REQUIRED - Door to Door Solicitors - Upon payment of a fee and a license being issued a registered business may sell legitimate goods and services by going door to door within the Village. (see schedule "A" for fee) ## BYLAW #2002-9 ## A BYLAW OF THE VILLAGE OF ACME IN THE PROVINCE OF ALBERTA DEALING WITH THE ISSUANCE OF BUSINESS LICENSES. ## PART 1 ## General Licensing Provisions - b) Home Based Business - Upon payment of a registration fee and a license being issued a Home Based Business will be advertised in the Village of Acme Community Resource Directory and also on the Business Attraction and Information System Network. (see Schedule "A" for fee) - c) Store Front Business - Upon payment of a registration fee and a license being issued a Store Front Business will be advertised in the Village of Acme Community Resource Directory and also on the Business Attraction and Information System Network. (see Schedule "A" for fee) - d) Upon application and payment of the registration fee the administration of the Village will include the name of the business to a current business registry maintained at the Village Office. - e) Any license issued to a home based business will be issued in accordance with Land Use Bylaw #96-2. 5. All information in possession of the Village of Acme will be held according to the Freedom on Information and Privacy Act. ## ini LICENSE YEAR - a) The term "license year" means the period from January 1 to December 31 of each year. 2. A business or individual is required to renew the license each year by January 1st - c) Every license shall bear on its face the date on which it was issued and the date on which it will expire. ## OFFENCES AND PENALTIES - a) There is no penalty for failure to obtain a business license to operate within the Village of Acme for Home Based Business or Store Front Business. Only businesses with current licenses will be published in the Community Resource Directory and on the Business Attraction and Information System Website. - b) All businesses located within a residential area are required to make application for a development permit to ensure the type of business being operated complies with Land Use Bylaw #96-2. - c) For Door to Door Solicitors who fail to obtain a license to carry on business within the Village shall be contacted and requested to cease solicitation until a business license is obtained. Failure to do so will result in the RCMP being requested to assist. ## SCHEDULE - a) Schedule "A" being the listing of fees shall form part of this Bylaw. 2. Schedule "B" being the Business License Form shall form part of this Bylaw. 3. All changes to Schedule "A" or "B" may be completed by a resolution of Council with a simple majority. ## THIS BYLAW COMES INTO EFFECT ON THE 1S* DAY OF JANUARY, 2003.
