B-41/2023 A bylaw to establish fees for goods and services provided by the City of Airdrie WHEREAS under the provisions of the Municipal Government Act, a council may pass bylaws for municipal services respecting services provided by or on behalf of a municipality; AND WHEREAS a council may pass bylaws to establish fees, rates, and charges for goods and services provided by or on behalf of the municipality; The City of Airdrie Council enacts as follows: Title 1 This bylaw may be cited as the "User Fees and Charges Bylaw". Definitions 2 Unless otherwise specified, the words used in this bylaw have the same meaning as defined in the Municipal Government Act and its regulations. 3 In this bylaw: (1) "administration" means the staff and operations under the direction of the City Manager; (2) "City" means the municipal corporation of the City of Airdrie or the area contained within the boundary thereof as the context requires; (3) "City Manager" means the City of Airdrie's Chief Administrative Officer or their delegate; (4) "Council" means the municipal Council of the City of Airdrie; (5) "fee" means an amount of money charged by the City for a service, product, or right to use of something, and includes charges and rates; (6) "Mayor" means the person elected or appointed as chief elected official under the provisions of the Municipal Government Act; and (7) "program" means recreational or educational events, like classes, courses, and summer camps. Application 4 This bylaw applies to all fees charged by the City. 5 This bylaw does not apply to: (1) taxes or levies; (2) fees established in contracts or through the procurement process; (3) fines or penalties; and (4) utility service rates for sewer, waste, recycling, or water service. Part 1 - Establishing fees Fees established 6 Schedule "A" to this bylaw sets out the fees, rates, and charges for a service, activity, product, or use of something provided by the City. 7 If there is a conflict between a fee amount in this bylaw and another bylaw, this bylaw takes precedence. Programming fees 8 Programming fees for programs provided by the City are set by the City Manager or delegate in accordance with the Council User Fees and Charges Policy, P-COM-65-C, as amended or substituted, and are not set in this bylaw. Payment 9 Unless other bylaw or policy states otherwise, all fees in Schedule "A" are due and payable at the time of service, activity, use, or provision of goods. 10 Where a fee is expressed as a rate in Schedule "A", the amount payable is the rate multiplied by the number of units of service involved, unless otherwise noted in the schedule. 11 The method of payment for fees is at the discretion of the City Manager or delegate. 12 The fees established in this bylaw and imposed on a person or party constitute a debt of the person or the party to the City. 13 Where legislation permits and in addition to any other remedy available to the City, the City may add fees and charges imposed by this bylaw to the tax roll for the property in the same manner as municipal taxes. Review 14 Council must review this bylaw annually for amendments with an effective date of January 1 of each year. Part 2 - Animal control fees and charges Reclaim domestic animal 15 The owner of an impounded domestic animal must pay the relevant fees in this bylaw, in addition to any additional requirements set out in legislation, bylaw, or Council policy, before they may reclaim their animal. Reclaim prohibited animal 16 The owner of an impounded prohibited animal must pay (1) the actual amounts incurred by the City to prove care to the animal, including but not limited to a boarding fee calculated on a per day or proportional basis, food, veterinary fees, and costs of destroying the animal; and (2) any other related impoundment fees listed in this bylaw; before the owner can reclaim their animal. Part 3 - Fire Services fees and charges Consumable and disposable costs 17 Consumables and disposal costs over standard quantities will be billed in addition to motor vehicle collision and administration response fees. Goods and Service Tax 18 Fees and services are subject to the Goods and Service Tax (GST). Billing increments 19 Responses are invoiced at a one hour minimum with half-hour increments. Cancelled calls 20 Cancelled calls are invoiced at a minimum of one hour if emergency vehicles leave the station. 21 No fee is charged if a call is cancelled prior to apparatus leaving the station. Part 4 - Planning fees and charges Fees for City-sanctioned or City-requests 22 The Development Authority is authorized to reduce or waive fees: (1) for development permits that are required for Council-approved structures, signs, and events; and (2) where a change to a development application is requested by the Development Authority to further a City initiative. Sustainable development 23 The Development Authority is authorized to reduce applicable fees to accommodate innovative or sustainable development and structures associated with water conservation, energy efficiency, greenhouse gas reduction, and drought resistant landscaping. Environmental assessment inquiries 24 An Environmental Site Assessment (ESA) file search request may include the following items: (1) Existence of historical or current land uses in immediate area with the potential to operate underground or above ground storage tanks. (2) Presence of underground or above ground storage tanks on or in the immediate vicinity of the property. (3) Records of appeals of property assessments due to environmental concerns. (4) Registered or unregistered landfills, dumps, or gravel pits within one kilometre of site. (5) Records of any known or potential soil or ground water contamination in the immediate vicinity of the property. (6) Spills, fires, or incidents of a potential environmental concern on or in the immediate vicinity of the property. Part 5 - Public conveyance and vehicles for hire 25 Fees for public conveyance and vehicles for hire licence applications received after September 30th in any one year are half of the licence fee for a full year. Part 6 - General Conflicts 26 If there is a conflict between the numerical amounts for a fee set in this bylaw and the numerical amounts for a similar fee in any other bylaw or policy of the City, the amount in this bylaw prevails. 27 If there is a conflict between the provisions of this bylaw and the provisions of a provincial or federal legislation, the provincial or federal legislation prevails. 28 If there is a conflict between the procedure or implementation related to a fee in this bylaw, and the procedure or implementation related to a similar fee in another bylaw, the other bylaw prevails. Disputes 29 If there is a dispute about the amounts payable under this bylaw, the City Manager has the authority and discretion to determine the correct amount. The City Manager's determination is final. Severability 30 If any provision or part of this bylaw is declared invalid by a court of competent jurisdiction, all other provisions of this bylaw remain valid and enforceable. Transitional 31 This bylaw comes into force and effect on January 1, 2024. Read a first time this 20 of November, 2023. Read a second time this 20 of November, 2023.
