VILLAGE OF AMISK BY-LAW N0. 359 PROVINCE OF ALBERTA BYLAW #359 REPLACING BYLAW #314 BEING ENACTED FOR THE PURPOSE OF REGULATING THE USE OF OFF-HIGHWAY VEHICLES WITHIN THE VILLAGE OF AMISK IN ACCORDANCE WITH THE TRAFFIC SAFETY ACT, c. T-6, R.S.A., 2000. WHEREAS the Traffic Safety Act, c. T-6, R.S.A., 2000 provides that a Council of a municipality may enact bylaws regulating the terms and conditions. use and routes pertinent to Off Highway Vehicles within a municipality. AND WHEREAS, the \fillage of Amisk deems it necessary to establish maximum speed limits for off-highway vehicles on highways and roadways which are subject to the direction. control and management of the Municipality; NOW THEREFORE, the Council of the Village of Amisk, duly assembled, enacts as follows: 1. That words used in this bylaw shall have the same meanings as words used or defined in the Traffic Safety Act. a) Highways: means a highway as defined in the act and includes the entirely of the public road allowance b) Off highway vehicle: as defined in the Traffic Safety Act 0) Peace officer: member of RCMP or any designated peace officer by Solicitor General 2. That any person qualified to operate an off-highway vehicle as described in the Traffic Safety Act may operate same on roads or areas under the direction, control and management of the Village of Amisk (hereinafter referred to as Village Roads) following those provisions outlined in subsections (a) through (f) and including any subsections and schedules there of: a) The maximum speed at which off-highway vehicles are permitted to travel on \fillage roads or areas shall be thirty (30) kilometres per hour. b) Operators of off-highway vehicles on Village roads shall travel on the extreme right hand side of the road and shall travel single file at all time. c) Without restricting the generality of the foregoing, the provisions of the Traffic Safety Act shall apply to the operation of an off-highway vehicle on \fillage highways. f .5 c) All off-highway vehicles must be duly registered and insured pursuant to Section 118(1) and Section 119 of the Traffic Safety Act. t) No person shall operate an off-highway vehicle within Village of Amisk boundaries: 3) on any route other than the most direct route by using alleyways and Ianeways wherever possible, from the place of residence to the outside boundaries of the Village and back to the residence. and to and from food and/or gasoline outlets in the case of persons travelling through the \fillage; ii) on any park, playground, school ground, , or areas of Senior's Housing. ill) between the hours of 11 :00 PM of one day and 7:00 AM of the following day. 3. That every person who contravenes the provisions of this bylaw is guilty of an offence and thereby shall be liable to summary conviction and to a penalty as prescribed for in Schedule "A" attached hereto and forming a part thereof. 4. That the Council of the Village of Amisk reserves the right to revoke the provisions of this bylaw at any time without notice. 5. This Bylaw shall have force and take effect on the final reading thereof.
