<!-- image --> ## BEING A BYLAW OF THE VILLAGE OF ARROWWOOD IN THE PROVINCE OF ALBERTA PROVIDE FOR THE CONTROL, REGULATION AND LICENSING OF BUSINESSES WITHIN THE VILLAGE. WHEREAS under the authority of the Municipal Government Act, M-26, RSA 2000 and amendments thereto, provides that the council of a municipality may pass bylaws for municipal purposes; And WHEREAS, PURSUANT TO Section 7(a) of the Act a Council may pass bylaws for municipal purposes respecting the safety, health and welfare of people and the protection of people and property; And WHEREAS, PURSUANT TO Section 7(e) of the Act a Council may pass bylaws for municipal purposes respecting Businesses, Business Activities and Persons engaged in Business; And respecting pees remen ellas the tea Chance ray as a feminial paposes all of the matters listed therein; NOW THEREFORE the Council of the Village of Arrowood in the Province of Alberta, duly assembled hereby enacts as follows: That Bylaw 337 Business Licensing Bylaw has been rescinded; ## SECTION 1 - Definitions - 1.1 "Business" includes every business, trade, profession, industry, occupation, employment or calling and the provision of goods and services - 1.2 "Council" refers to the Council of the Village of Arrowwood - 1.3 "CAO" refers to the Chief Administrative Officer of the Village of Arrowwood duly appointed by the Council - 1.5 "Person" means and includes a firm, one or more persons, or partnership or corporate body. - 1.4 "Officer" includes a member of the Royal Canadian Mounted Police, or a Bylaw Officer, or a Community Peace Officer - 1.6 "Resident" means a resident of the Village's active trading area. - 1.7 "Village" refers to the Village of Arrowwood in the Province of Alberta ## SECTION 2 - General Provisions - 2.1 Each person carrying on a business within the Village boundaries is required to have a valid and subsisting business license. - 2.2 Any person carrying on a business, which is not located on a commercially taxed property within the boundaries of the Village, shall pay a prescribed fee as set out in Schedule "A" - Business License Fees or the Fees and Rates Bylaw whichever is most recent. - 2.3 No License shall be issued to a person under the provisions of this bylaw in a case where Provincial License is required, unless such a person is the holder of the required Provincial License. - 2.4 Every license issued under this bylaw shall be made out and delivered to the Licensee, who shall post same in a conspicuous place in his business premises and whenever required to do so by the Municipal Secretary-Treasurer or Council, shall <!-- image --> ## BYLAW NO. 500 BUSINESS LICENSING BYLAW - produce the license for inspection purposes. - 2.5 Licenses issued at inception of a business shall be permanent, unless the terms of this bylaw otherwise expressly provides. - 2.6 All applications for licenses shall be made in writing to the Village Office on a form provided, giving such information and particulars as requested. ## SECTION 3 - Revocation or Suspension of License - 3.1 The Council may at any time revoke, suspend, or refuse to grant any license issued under the provisions of this bylaw - a. For failure to comply with any of the conditions or regulations of this bylaw - b. For failure to comply with any other bylaw or regulation of the Village - c. For failure to comply with any legislation or regulation of the Province of Alberta - d. In the opinion of the Council the holder of a license intends or appears to - 3.2 cheque or other instrument which is not accepted by the financial institution on which it is issued ## SECTION 4 - Exemptions from Licensing - 4.1 Council may grant any exemption applied herein with or without conditions or may refuse to grant - any exemption. - 4.2 A business license is not required for the following: - 4.2.1 A Charitable of non-profit Organization registered under the Societies Act, R.S.A. 2000 Chapter S-14 and amendments hereto; - 4.2.2 A business for which the activities are carried out as a Farmer's Market association - 4.2.3 Any Business which is excluded from the requirements of this Bylaw by an Act of the Legislature of other Provincial Statute including but not limited to the following: - a) The Alberta Dental Association and College, - b) The Law Society of Alberta, - c) The Pharmacy and Drug Act, - d) Health Professions Act, - e) Chartered Professional Accountants Act, - f) Insurance Act, - Architects Act, - h) Land Surveyors Act, - j) Professional and Occupational Associations Registration Act. - Engineering and Geoscience Professions Act, and ## SECTION 5 - Enforcement - 5.1 Any person who contravenes this bylaw is guilty of an offense. - 5.2 In case of an offence that is of a continuing nature, a contravention constitutes a separate offense in respect of each day, or part of a day, on which it continues and a Person guilty of such an offense is liable to a fine as per Schedule "B" of this bylaw <!-- image --> <!-- image --> ## AI.BERTA BYLAW NO. 500 BUSINESS LICENSING BYLAW - or as stated in the Village of Arrowwood Community Standards Bylaw, in an amount not less than established by this bylaw. - 5.4 The CAO or Officer is hereby charged with the duty of enforcing the provisions of this bylaw. - 5.3 Should a person not pay the penalty provided or contravene any section of this bylaw, and a prosecution has been entered against said person, they shall be liable on summary conviction to the penalties legislated under the Municipal Government Act, Chapter M-26, Section 566, RSA 2000 and amendments thereto, in addition to any Business License Fee they may be required to pay. THIS BYLAW SHALL TAKE EFFECT UPON THE DATE OF FINAL PASSAGE THEREOF. READ a FIRST TIME this &amp; th day of Haul 2025. READ a SECOND TIME this 8th day of April 2025.
