( ## Bylaw/Policy Disposition Amends: 03-19 Anc 03-17 CORPORATION OF THE VILLAGE OF BARNWELEred by: IN THE PROVINCE OF ALBERTA Rescinds: ## BYLAW 04-22 BEING A BYLAW OF THE VILLAGE OF BARNWELL IN THE PROVINCE OF ALBERTA, TO AMEND BYLAW 03-19 THE TRAFFIC BYLAW OF THE VILLAGE OF BARNWELL. WHEREAS pursuant to Section 7 of the Municipal Government Act, being Chapter M-26.1 of the Revised Statures of Alberta, 2000, Council may pass Bylaws for the purposes respecting transport and transportation systems AND WHEREAS pursuant to Section 13(1) of the Traffic Safety Act, R.S.A. 2000, c. T-6, Council may make Bylaws for the regulation and control of vehicle, animal and pedestrian traffic within the municipality that are not inconsistent with the Act AND WHEREAS the Alberta Traffic Safety Act authorizes the use of flashing green lights by authorized volunteer firefighters in private vehicles when used in response to a fire or other emergency AND WHEREAS Section 28 of Alberta Regulation 122/2009 being the Vehicle Equipment Regulation of the Alberta Traffic Safety Act, authorizes municipalities the power to pass a bylaw allowing full time and volunteer firefighters to use flashing green lights in their vehicles as a means of identification when responding to a fire or other emergency AND WHEREAS the Village of Barnwell did establish by Bylaw 03-19 a new land use district to be known as South Village Road SVR and did by resolution provide for truck tractor access to the South Village Road SVR land use district, and; NOW THEREFORE, the Council of the Village of Barnwell in the Province of Alberta, duly assembled, enacts as follows: ## CITATION This Bylaw may be cited as the Traffic Bylaw Amendment of the Village of Barnwell and shall be taken to apply within the corporate limits of the Village of Barnwell. AMENDMENT TO SECTION A - INTERPRETATION &amp; DEFINITIONS <!-- image --> Section a of Bylaw 03-19 shall be amended to include the following additional clause and renumbering: - dd)"Truck Tractor" means a truck that may be coupled to a semi-trailer by means of a fifth wheel, but does not include a bed truck, picker truck or winch truck. In the event of a disagreement between this definition and the one provided for in the Alberta Regulations, Traffic Safety Act, Commercial Vehicle Dimension and Weight Regulation, the Provincial regulations shall prevail - ee) "Vehicle" means a device in, upon or by which a person or thing may be transported or drawn upon the roadway; - ff) "Village" means the Corporation of the Village of Barnwell or the area contained within the corporate boundaries of the Village, as the context requires. ## AMENDMENT TO SECTION D - EMERGENCY VEHICLES Section D of Bylaw 03-19 shall be amended to include the following additional clauses: - 4) A full time or volunteer firefighter may carry on or in a vehicle, other than an emergency vehicle, a lamp that produces intermittent flashes of green light and may operate the lamp in the Village of Barnwell if the vehicle is proceeding to a fire or other emergency. - 5) No person other than a full time or volunteer firefighter shall operate a lamp that produces intermittent flashes of green light. - 6) Nothing in this Bylaw shall be construed so as to permit a full time or volunteer firefighter to operate a vehicle in contravention of the Highway Traffic Act, the regulations under the Highway Traffic Act, any other provincial legislation or regulation, or any Bylaw of the Village of Barnwell. ## AMENDMENT TO SCHEDULE B - HEAVY TRUCK ROUTE Schedule B of Bylaw 03-19 shall be amended to allow for operation of Truck Tractor units on South Village Road as per attached Schedule. ## BYLAW REPEALED Bylaw No. 03-17 is hereby repealed. ## EFFECTIVE DATE This Bylaw will come into full force and effect on the date of final passing thereof.
