Bylaw 1104-2026 Page 1 BYLAW #1104-26 The City of Beaumont Access to Information Bylaw Whereas, Section 7 of the Municipal Government Act, RSA 2000, c M-26, and amendments thereto, provides that a council may pass bylaws for municipal purposes; Pursuant to Section 98(a) of the Access to Information Act, SA 2024, C A-1.4, ("ATIA") a municipality, as a local public body, must designate a person or group of persons as the head of the local public body for the purposes set out in the ATIA; and Pursuant to Section 98(b) of ATIA a municipality, as a local public body, may set fees the local public body requires to be paid for services rendered; Council therefore enacts: PART I - DEFINITIONS, AND INTERPRETATION Definitions 1 In this bylaw: (a) "Acts" means the the Access to Information Act, SA 2024, c A- 1.4, and the Protection of Privacy Act, SA 2024, c P-28.5; (b) "Applicant" means a person who makes a request for access to a record under section 7(1) of the Access to Information Act; (c) "Chief Administrative Officer" means the chief administrative officer of the City or delegate; (d) "City" means the municipal corporation of The City of Beaumont; and (e) "Head" has the same meaning as in the Acts. Interpretation 2 The following rules apply to interpretation of this bylaw: (a) headings, titles, and margin notes in this bylaw are for ease of reference only; (b) gender-specific words, phrases, and references are intended to be gender-neutral, and the singular includes the plural as the context requires; (c) every provision of this bylaw is independent of all other provisions and if any provision of this bylaw is declared invalid by a Court, all other provisions of this bylaw remain valid and enforceable; and Bylaw 1104-2026 Page 2 (d) references to bylaws and enactments in this bylaw include amendments and replacement bylaws and enactments, and regulations and orders thereunder. PART II - APPLICATION Designation of Head 3 For the purpose of carrying out the duties and responsibilities of the Head under the Acts, the Chief Administrative Officer is designated as the Head of the City. Delegation of Head 4 The Chief Administrative Officer may delegate, in writing, any powers, duties or functions of the Head to carry out the purposes of the Acts. PART III - TRANSITIONAL Consequential Amendment 5 Bylaw 969-20, Designated Officers Bylaw, is amended by deleting the following section: 8.5 The City Clerk is the designated officer for the purposes of carrying out the duties and responsibilities of the "FOIP" coordinator under the Freedom of Information and Protection of Privacy Act, RSA 2000 c-F25 and the regulations thereunder. 6 Bylaw 1093-25, Fees and Charges Bylaw, is amended by inserting the following after section 3: 3.1 Where an applicant is required to pay a fee for services to which the Access to Information Act, SA 2024, c A-1.4, and the Protection of Privacy Act, SA 2024, c P-28.5 apply, the fee payable is the maximum set out in the Access to Information Act Regulation, Alberta Regulation 133/2025, Schedule 1: Fees, as amended or repealed and replaced from time to time.
