VILLAGE OF BEISEKER
ACCESS TO INFORMATION ACT & THE PROTECTION OF PRIVACY ACT
BEING A BYLAW OF THE VILLAGE OF BEISEKER IN THE PROVINCE OF ALBERTA TO
ESTABLISH THE ADMINISTRATIVE STRUCTURE OF THE VILLAGE OF BEISEKER IN
RELATION TO THE ACCESS TO INFORMATION ACT AND THE PROTECTION OF PRIVACY
ACT, AND TO SET FEES THEREUNDER
WHEREAS
The Government of Alberta has repealed the Freedom of Information and Protection of
Privacy Act (FOIP) and enacted the Access to Information Act (ATIA) and the Protection
of Privacy Act (POPA);
AND WHEREAS the Village of Beiseker is a public body subject to the provisions of
ATIA and POPA;
AND WHEREAS it is necessary to designate a Head of Municipality and establish
procedures and fees for access to records under the ATIA;
NOW THEREFORE the Council of the Village of Beiseker, in the Province of Alberta,
duly assembled, enacts as follows:
1. SHORT TITLE
This Bylaw may be cited as the "Access to Information and Privacy Bylaw."
2. DEFINITIONS
In this Bylaw, unless the context otherwise requires:

"Act" means the Access to Information Act, S.A. 2025, c.A-8.2, and includes any
regulations made thereunder.

"Applicant" means a person who makes a request for access to a record under
section 7(1) of the Act.

"Municipality" means the Village of Beiseker and includes any board,
committee, commission, panel, agency, or corporation that is created or owned
by the Village of Beiseker and all members or officers of which are appointed or
chosen by the Village of Beiseker.

"Municipality Manager" means the person appointed as the Chief
Administrative Officer (CAO) of the Village of Beiseker and includes any person
who holds the position in an acting capacity.

"Regulation" means the Access to Information Regulation, Alta Reg 133/2025,
as amended from time to time or any successor regulation.
3. DESIGNATED HEAD
For the purposes of the Act, the Municipality Manager is designated as the Head of
Municipality.
4. FEES
Where an Applicant is required to pay a fee for services, the fee payable shall be in
accordance with the Access to Information Regulation, Alta Reg 133/2025, as
amended from time to time.
5. TRANSITIONAL PROVISIONS
Any request for information received but not disposed of prior to the coming into force
of this Bylaw shall be deemed to be a request made under the provisions of the Access
to Information Act as of the effective date of this Bylaw.
6. REPEAL
Bylaw 99-15 is hereby repealed in its entirety.
7. EFFECTIVE DATE
This Bylaw shall come into force upon third and final reading.
