BEING A BYLAW OF THE VILLAGE OF BEISEKER IN THE PROVINCE OF ALBERTA TO PROVIDE FOR THE
REGULATION, CONTROL AND MANAGEMENT OF VEHICLE AND PEDESTRIAN TRAFFIC ON STREETS, ROADS,
ALLEYWAYS, PATHS AND SIDEWALKS AND THE PASSAGE OF DANGEROUS GOODS WITHIN THE BOUNDARIES
OF THE VILLAGE OF BEISEKER.
WHEREAS by the virtue of the powers conferred upon it by the Traffic Safety Act, the Council of the Village of
Beiseker may make bylaws to regulate, manage and control vehicle, animal, and pedestrian traffic within the
municipality;
AND WHEREAS the Municipal Government Act and amendments thereto, gives the municipality certain
powers with respect to highways within the municipality;
AND WHEREAS the Council of the Village of Beiseker, in the Province of Alberta deems it expedient to
pass such a Bylaw;
AND WHEREAS the Transportation of Dangerous Goods Control Act R.S.A 2000 and amendments there to
authorizes a municipality to regulate the transportation of Dangerous Goods within the municipality;
NOW THEREFORE the Council of the Village of Beiseker hereby enacts as follows:
SECTION 1 TITLE
1.1
This Bylaw may be cited as "Streets & Traffic Bylaw".
SECTION 2 DEFINITIONS
2.1
The definitions in the Traffic Safety Act, RSA 2000, c T-6, and in the Dangerous Goods
Transportation and Handling Act, RSA 2000, c D-4, and all regulations and amendments
pursuant to these Acts as applicable, are adopted for the purpose of interpretation and
application of this part.
2.2
Notwithstanding Section 2.1 the following definitions shall apply to this bylaw:
a)
"Alley/Lane" means a narrow highway intended chiefly to give access to the rear of
buildings and parcels of land;
b)
"Bicycle" means any cycle propelled by human power upon which a person may ride,
regardless of the number of wheels it may have;
c)
"CAO" means Chief Administrative Officer for the Village of Beiseker or their designate;
d)
"Council" means the Municipal Council of the Village of Beiseker;
e)
"Enforcement Officer" means any member of the RCMP, Community Peace Officer, Bylaw
Enforcement Officer, or authorized person as appointed by Council;
f)
"Commercial Vehicle" means a vehicle operated on a highway for the purpose of
providing transportation of persons or goods in the course of business, and includes
trucks, truck-tractors, trailers, buses, and commercial passenger vehicles, but does not
include private passenger vehicles used solely for personal transportation.
g)
"Construction Vehicle" means a private or commercial vehicle or heavy equipment
actively involved in the construction process or in the delivery or storage of tools or
supplies;
h)
"Driver or Operator" means a person who drives or is in the actual physical control of a
vehicle;
i)
"Early Payment Amount 1" means 40% of the fine if paid within 15 days of the date of
offence.

j)
"Early Payment Amount 2" means 60% of the fine if paid between 16 and 45 days of the
date of offence
k)
"Gross Vehicle Weight" shall mean the aggregate weight of the vehicle and the load which
that vehicle is permitted to carry;
l)
"Heavy Vehicle" means a vehicle, or a vehicle with a trailer attached, having a gross
vehicle weight exceeding 4,500 kg, as determined under the Traffic Safety Act
m)
"Highway" means any thoroughfare, street, road, trail, avenue, parkway, viaduct, lane,
alley, square, driveway, bridge, causeway, trestle-way or other place, whether publicly or
privately owned, any part of which the public is ordinarily entitled or permitted to use for
the passage or parking of vehicles and includes:
1)
a sidewalk;
2)
where a ditch lies adjacent to and parallel with the roadway, the ditch;
3)
where a highway right - of - way is contained between fences or between a fence and
one side of the roadway, all the lands between the fence and the edge of the roadway
as the case may be; and
4)
a boulevard but does not include a place declared by the Lieutenant Governor in
Council not to be a highway.
n)
"Motorized vehicle" means a motor vehicle as defined in the Traffic Safety Act, and
includes any other self-propelled device capable of being operated on a highway, but does
not include mobility aids used by persons with disabilities;
o)
"Off-Highway Vehicle" means any motorized vehicle designated for cross-country travel
on land, water, snow, ice, marsh, or swampland or on other natural terrain and, without
limiting the generality of the foregoing, includes, when designed for such travel:
1)
low tire pressure vehicles;
2)
unlicensed 2-wheel vehicles;
3)
amphibious machines;
4)
all terrain vehicles;
5)
miniature motor vehicles;
6)
snow vehicles;
7)
minibikes, and
8)
any other means of transportation which is propelled by any power other than
muscular power or wind, but does not include:
(i)
motorboats; or
(ii)
any other vehicle exempted from all of the provisions of the Off-Highway Vehicle
Act.
p)
"Owner" means:
1)
in the case of land, any person who is registered under the Land Titles Act as the
owner of land; or
2)
in the case of property other than land, any person who is in lawful possession
thereof, or
3)
in the case of vehicles, "Owner" includes any person renting a motor vehicle or having
the exclusive use thereof under lease or otherwise for a period of more than thirty (30)
days.
q)
"Parade or Procession" means a procession or march organized for the purpose of
entertainment of spectators, display, inspection, or promotion of a cause or purpose;
r)
"Park" means to park when prohibited as defined in Section 1(n) of the Traffic Safety Act;

s)
"Parking Pad" means an area prepared with either gravel, concrete, asphalt or as approved
by the Village of Beiseker.
t)
"Penalty Tag" means a tag or similar document issued by the Village of Beiseker pursuant
of the Municipal Government Act.
u)
"Recreational Vehicle" means a vehicle or trailer that is designed constructed and
equipped either temporarily or permanently as a dwelling place, living abode or sleeping
place. This shall include travel trailers, fifth wheel trailers, motorhomes, tent trailers, van
conversions and truck campers. This shall not include a truck camper that is mounted to
and used as daily transportation, utility trailers, snowmobiles, all terrain vehicles,
motorcycles, or trailers designed to carry the aforementioned.
v)
"Special Event" means an organized event, program or service, occurring in the Village of
Beiseker which is open to or intended to attract the general public and will take place on
publicly owned land, any highway or in publicly owned facilities when the facility is being
used for something besides its intended use.
w)
"Store" means parking of a vehicle for a period of more than 72 hours consecutively at one
location on a highway.
x)
"Street Furniture" means (but is not limited to) items such as poles, traffic control
devices, waste receptacles, benches, trees, plants, grass, utilities, planters, bicycle racks,
newspaper boxes or any other similar property placed on a highway;
y)
"Traffic Control Device" means any sign, signal, marking, or device placed, marked, or
erected under the authority of the Traffic Safety Act RSA 2000, c T-6 for the purpose of
regulating, warning, or guiding traffic;
z)
"Trailer" means a vehicle so designed that it may be attached to or drawn by a motor
vehicle, and intended to transport property or persons, but does not include machinery or
equipment used in the construction or maintenance of highways;
aa)
"Vehicle" means a device in, upon or by which a person or thing may be transported or
drawn upon a highway.
bb)
"Violation Ticket" as per the Provincial Offences Procedure Act R.S.A 2000, Chapter P
4(POPA) and the regulations as amended or replaced from time to time.
SECTION 3 GENERAL
3.1
Nothing in this Bylaw relieves a person from complying with any provision of any federal or
provincial law or regulation, other bylaw or any requirement of any lawful permit, order, or
licence.
3.2
Any heading, sub-headings, or tables of contents in this Bylaw are included for guidance
purposes and convenience only and shall not form part of this Bylaw.
3.3
All the schedules attached to this Bylaw shall form a part of this Bylaw.
3.4
This bylaw is gender-neutral and, accordingly, any reference to one gender includes the other.
SECTION 4 RULES FOR OPERATION OF VEHICLES & USE OF HIGHWAYS
4.1
The Village of Beiseker is hereby authorized to cause the installation of any traffic control device
to govern and direct traffic within the Village of Beiseker.
4.2
Unless otherwise posted by a traffic control device, no person shall:
a)
drive a vehicle at a speed in excess of thirty (30) kilometers per hour on any highway within
the Village of Beiseker;
b)
drive a vehicle in any alley or lane within the Village of Beiseker at a speed in excess of
fifteen (15) kilometers per hour;
c)
drive a vehicle in a parking lot at a speed in excess of fifteen (15) kilometers per hour.

4.3
No vehicle driver or operator shall drive a vehicle upon any highway in such a manner as to
impede or hinder traffic.
4.4
No person shall disregard the warning signal or a flag person on duty at a worksite when repairs
or alterations are in progress on or adjoining any highway within the Village of Beiseker and such
work is being indicated by barricades, signs or by a flag person.
4.5
When a vehicle is engaged in such highway repairs or alterations within an area controlled by a
flag person, the provisions of this by-law relating to backing, turning, stopping, and making other
movements shall not apply to such vehicles.
4.6
The Village of Beiseker may, for repairs, maintenance or emergency or any special
circumstances, take such measures for the temporary closing of highways or the suspension of
parking privileges and place barricades or post appropriate notices on or near the highway
concerned as they may consider to be necessary to the circumstances.
4.7
No person shall:
a)
tear down, remove, or interfere with any barricades or notice of closing or suspension,
erected, or posted under the authority of this section;
b)
do anything in contravention of any notice posted under authority of this section.
4.8
No person shall drive any vehicle over an unprotected hose of the Fire Department that has been
laid down on any street or driveway for use at a fire or fire practice, except with the consent of the
Fire Department official in command.
4.9
No person shall drive or walk over newly painted lines on any highway as indicated by signs,
flags, or other warning device.
4.10 No person shall drive on, haul on or over, any hard surfaced or graveled highway in the Village of
Beiseker, any vehicle or any type of equipment or building or thing which may in any way damage
the said highway, including but not limited to vehicles with steel lugs or cleats.
4.11 No person shall drive a vehicle over or upon any curb, or gutter that would cause damage to said
curb or gutter within the Village of Beiseker, unless approved by the Village of Beiseker.
4.12 No person shall, without authorization from the Village of Beiseker, deposit any earth, rocks,
trees, snow or other substances or objects on any highway, sidewalk or boulevard within the
Village of Beiseker, and if such deposits have been made without authorization and the Village of
Beiseker removes the same, the expense therefore shall be chargeable to the person
responsible, which shall be in addition to any fine or penalty imposed by this by-law.
4.13 Notwithstanding Section 4.12, where an obstruction of any kind exists in, upon or about any
highway, and in the opinion of the Village of Beiseker, creates an unsafe condition, the Village
shall be entitled to take such measures as are required for the protection of life or property.
4.14 The Village of Beiseker or Authorized Representative may cause the removal of any unauthorized
structure or other thing which projects into or obstructs the use of any highway, sidewalk,
boulevard, or public place.
4.15 The Village assumes no responsibility for damage either to the property that is causing
obstruction, or the property that is abutting the highway when work is being done pursuant to
Section 4.13 or 4.14.
4.16 No driver of a vehicle shall allow refuse, sand, gravel, rocks, earth, or other loose material to
escape or be scattered upon a highway or upon land in the vicinity thereof and ensure the load is
completely covered with a tarpaulin or other covering in such a manner as to prevent the load
from falling onto the highway or land adjacent thereto or shifting within the vehicle or trailer.
4.17 In the event that any part of a vehicle, load or other materials becomes loose, detached, blows,
drops spills or falls from any vehicle or trailer onto a highway, it shall be the duty of the driver of

the vehicle forthwith to take all reasonable precautions to safeguard traffic and to remove such
material from such highway.
4.18 No driver of a vehicle shall apply or engage engine retarder brakes on any highway within the
municipality.
a)
The Village may post signs prohibiting the use of engine retarder brakes pursuant to the
Traffic Safety Act.
4.19 No person shall drive a motor vehicle upon any grassed or cultivated lands, improved area,
recreational area, playground, or schoolground within the Village, except on existing highways,
Village-designated parking areas, or with written authorization from the Village of Beiseker.
4.20 Any person who contravenes anything in Section 4 of this bylaw shall, in addition to any penalty
imposed, be deemed liable for any damages caused and the expense therefore shall be
chargeable to the person responsible, which shall be in addition to any fine or penalty imposed
by this by-law.
SECTION 5 TEMPORARY REPAIRS AND STREET MAINTENANCE
5.1
Notwithstanding any other provision in this bylaw, the Village of Beiseker may cause "No
Parking" or "No Stopping" signs to be placed on or near a highway twenty-four hours (24 hours)
prior to the commencement of the highway maintenance or construction.
5.2
The Village of Beiseker may cause movable signs to be placed on or near a highway during an
emergency to indicate "No Parking", without prior notice and when so marked, such signs shall
take precedence over all other traffic control devices.
5.3
No driver of a vehicle shall park a vehicle or permit a vehicle to be parked on a highway from the
time a sign or signs referred to in Section 5.1 have been placed, and until such sign or signs have
been removed.
5.4
Any vehicle that is on such highway when such signs are placed thereon shall be removed
promptly by its owner or operator.
5.5
Where the vehicle was parked prior to the placement of the signs referred to in Section 5.1, no
driver of a vehicle shall leave that vehicle parked or permit that vehicle to remain parked on the
highway after the expiration of twenty-four hours (24 hours) from the time the sign or signs were
placed, and until such sign or signs have been removed.
5.6
Any vehicle in contravention of Section 5 will be removed at the Owners expense.
SECTION 6 PARKING
6.1
Unless required or permitted by this Bylaw, by a traffic control device, by direction of an
Enforcement Officer, or to avoid conflict with other traffic, no person shall stop or park a vehicle:
a)
Pedestrian Infrastructure
1)
on a sidewalk or boulevard;
2)
on a crosswalk or any part of a crosswalk;
3)
within five (5) metres of the near side of a marked crosswalk.
b)
Traffic Control Devices and Infrastructure
1)
within five (5) metres on the approach to a stop sign or yield sign;
2)
within 4.5 metres of a fire hydrant, or where the hydrant is not at the curb, within 4.5
metres of the point on the curb nearest the hydrant;
3)
within 1.5 metres of an access to a garage, private road, driveway, or vehicle crossway
over a sidewalk.
c)
Obstruction or Hazard
1)
alongside or opposite any street excavation or obstruction where stopping or parking
would obstruct traffic;

2)
at or near the site of any fire, explosion, accident, or other incident if stopping or
parking would obstruct traffic or hinder Enforcement Officers, Firefighters,
Ambulance Crews, Rescue Officers, or Volunteers;
3)
at any location where a traffic control device prohibits stopping or parking during the
times indicated.
d)
Improper Positioning
1)
on the roadway side of a vehicle parked or stopped at the curb or edge of the highway
(double-parking);
2)
with the vehicle facing against the authorized direction of travel for that highway.
6.2
Obstruction of Traffic
a)
No person shall park a vehicle on a highway in a manner that blocks, obstructs, impedes,
or hinders traffic.
b)
Where obstruction is unavoidable due to mechanical failure, the operator is not in breach
of this section if prompt measures are taken to remove the vehicle.
6.3
Vehicle Condition Requirements
a)
Except as otherwise provided in this Bylaw, no person shall park a vehicle on a highway that
is:
b)
not in running condition;
c)
unregistered; or
d)
uninsured.
6.4
Fire and Emergency Access
a)
No person shall park a vehicle:
1)
where it interferes with the use of a doorway intended as a fire or emergency exit from
any building abutting the street;
2)
in the entrance to any fire hall;
3)
where a sign restricts parking to a specific class of vehicles only.
6.5
Loading and Unloading
a)
No person shall park on any municipal highway where a sign prohibits parking, except for
the purpose of loading or unloading goods from a commercial establishment.
b)
No person shall stop or park a vehicle in any lane or alleyway except while actively loading
or unloading goods or passengers.
6.6
Parking on Private or Municipal Property
a)
No person shall park a vehicle on private land without permission of the owner, tenant,
occupant, or person in charge, and the vehicle must be on an approved parking pad.
b)
No person shall park any vehicle or equipment on land owned or controlled by the Village
of Beiseker except where public parking spaces or areas are provided.
6.7
Vehicle Repairs on Highway
a)
No person shall stop or park a vehicle on a highway for the purpose of greasing or repairing
the vehicle, except for emergency repairs.
6.8
Leaking Vehicles
a)
No person shall park a vehicle on a highway if the vehicle is leaking engine, transmission, or
any other fluids.
6.9
Commercial and Construction Vehicles in Residential Areas
a)
No person shall park a commercial vehicle with a gross vehicle weight rating exceeding
5,500 kg in a residential area for longer than is reasonably necessary to load or unload.

b)
No person shall park a construction vehicle in a residential area except when required
pursuant to a development or building permit for that site.
6.10 Driveways, Sidewalks, and Oversized Vehicles
a)
No person shall park a vehicle on a driveway or entranceway to any building so that any
part of the vehicle extends across any portion of a sidewalk.
b)
The restriction in subsection (a) does not apply to vehicles parked for the purpose of
loading or unloading goods to or from premises abutting the highway, provided that during
periods of restricted visibility the vehicle displays illuminated front and rear parking lights.
6.11 Restricted Parking Zones
a)
No person shall park a vehicle, except while actively taking or discharging passengers:
1)
in a passenger loading or unloading space marked with a sign;
2)
on any portion of a highway marked by a sign as "No Parking";
3)
in a designated "Handicapped Parking" space unless a valid handicap marker is
displayed on the front windshield area of the vehicle.
6.12 Idling Causing Nuisance
a)
No person shall park a vehicle with the motor running in such a manner or location as to
cause a nuisance.
6.13 Unsafe Unattended Vehicles
a)
No person shall leave a vehicle unattended on a highway if:
1)
the vehicle is placed on a jack or similar device;
2)
one or more wheels have been removed; or
3)
any part of the vehicle is raised.
6.14 Maximum Parking Duration
a)
No registered vehicle shall remain parked on any highway for more than seventy-two (72)
hours without being moved a minimum of four (4) metres from its previous parking
location.
b)
Subsection (a) does not apply to a vehicle that meets all the following conditions:
1)
the address shown on the vehicle registration matches the municipal address of the
adjacent property to the portion of the highway where the vehicle is parked;
2)
the vehicle is parked directly in front of that residence;
3)
the vehicle is an operational vehicle; and
4)
the vehicle is not an unsightly vehicle.
c)
The exemption in subsection (b) does not apply where the parked vehicle interferes with
snow removal, street maintenance, emergency access, or creates a traffic or pedestrian
hazard.
d)
For certainty, the exemption in subsection (b) does not apply to highways adjacent to
parcels designated as commercial, industrial, public service, or urban reserve districts
under the Land Use Bylaw.
SECTION 7 RECREATIONAL VEHICLES AND TRAILERS
7.1
No driver shall park any trailer, or permit any trailer whether designed for occupancy by persons
or for the carrying of goods or equipment to be parked upon any highway within the Village unless
the said trailer is attached to a vehicle by which it may be propelled or drawn; when the trailer is

attached it shall be deemed to be part of the vehicle to which it is attached, and shall be deemed
part of the vehicle and subject to the regulations pertaining to vehicles.
7.2
No person shall reside in a recreational vehicle on private property for more than two (2) weeks
without written permission from the Village of Beiseker.
7.3
No person shall occupy, camp or dwell in a recreational vehicle as a temporary or permanent
dwelling place, living abode or sleeping place on a highway that has not be designated by the
Village of Beiseker as a campground.
7.4
No person shall stand or park any trailer in any lane or alleyway except for loading or unloading
goods or passengers.
7.5
No driver shall park or permit any trailer to be parked in a manner which obstructs any sidewalk,
highway or pathway unless otherwise authorized by the Village of Beiseker.
7.6
No person shall park or permit any trailer to be parked with the jacks down and resting upon a
highway.
7.7
No person shall park or permit a Recreational Vehicle to be parked with the slides extended on
any highway if the extension encroaches onto a highway or sidewalk.
SECTION 8 HEAVY VEHICLES AND TRUCK ROUTE
8.1
1st Avenue, 5th Avenue, Highway 72, Highway 9, & 7th Street between Highway#9 and 5th
Avenue are designated as truck routes for the purposes of this Bylaw.
8.2
No person shall drive, operate, or park a heavy vehicle on any other highway other than 1st
Avenue, 5th Avenue, Highway72, Highway 9 & 7th Street between Highway#9 and 5th Avenue
except:
a)
when so directed by an Enforcement Officer;
b)
when following posted directional signs or directions of a flag person indicating that the
truck route or portions thereof have been closed for purposes of maintenance,
construction, or repairs.
c)
or for the purpose of loading or unloading.
8.3
The following shall not be deemed to be operating a vehicle in contravention of Section 8.2 if the
vehicle was being operated on the most direct and practicable route between the premises or
location concerned and the nearest truck route:
a)
persons delivering or collecting goods or merchandise to or from the premises of a bona
fide customer;
b)
persons moving a house for which the necessary proper permits have been issued by the
Village;
c)
persons going to or from premises for the servicing or repairing of the heavy vehicles;
d)
persons driving a public passenger vehicle;
e)
persons operating a tow truck for the purpose of towing or pushing a disabled vehicle from
a highway prohibited to heavy vehicles;
f)
persons driving a vehicle owned by or in the service of the Village of Beiseker.
8.4
The Village of Beiseker may have appropriate signs placed and maintained wherever necessary
on the highways of the Village of Beiseker to indicate to drivers of heavy vehicles the highways
that are restricted to the use of heavy vehicles and designate those highways which are truck
routes.
SECTION 9 DANGEROUS GOODS ROUTE
9.1
The dangerous goods route is HWY 72 and HWY 9

9.2
No person shall drive or park a vehicle or a trailer for the conveyance of flammable liquids,
explosive materials, or other contents dangerous to human safety upon a municipal highway
other than the Dangerous Goods route.
9.3
No person transporting dangerous goods for which placards are required shall stop within the
municipality except:
a)
at an approved location;
b)
to load or unload;
c)
in compliance with an Enforcement Officer, an inspector or traffic control device; or
d)
to refuel or repair a vehicle.
9.4
The provisions of the Dangerous Goods Transportation and Handling Act, R.S.A. 2000, c. D-4,
and the Dangerous Goods Transportation and Handling Regulation, A.R. 157/97, apply to any
highway within the Village of Beiseker. No person shall violate any provision of the Act or its
regulations within the Village.
SECTION 10 OPERATION OF OFF-HIGHWAY VEHICLES
10.1 All off-highway vehicles must comply with the Traffic Safety Act.
10.2 The operation of Off-Highway Vehicles within the Village of Beiseker is governed by the
Off-Highway Vehicle Bylaw. No provision of this Traffic Bylaw shall be interpreted as regulating
Off-Highway Vehicles except where expressly stated.
SECTION 11 PEDESTRIANS
11.1 No person shall so conduct himself or otherwise position himself on a highway in such manner
as to obstruct vehicular or pedestrian traffic or as to inconvenience any other person upon the
highway.
11.2 No person shall sell or solicit anything on the highways within the municipality without prior
authority of the Village.
11.3 No person shall stand on any municipal highway for the purpose of soliciting a ride from the
operator of any vehicle.
11.4 No person shall allow himself to be drawn by a moving vehicle while he is riding upon a sled,
toboggan, bicycle, skis or other conveyance, upon a highway except during an authorized parade
or procession or special roadway event.
11.5 No person shall climb, place feet on seat or interfere with any street furniture or Traffic Control
devices, or any other similar property place within the village or any other utility system or work
of the village.
SECTION 12 HORSES AND HORSE-DRAWN VEHICLES
12.1 No person shall drive a horse-drawn vehicle or ride a horse within the village limits without prior
authorization from the Village of Beiseker.
12.2 The driver or other person in charge of any horse-drawn vehicle on a highway shall remain up on
such vehicle while it is in motion or shall walk beside the horse drawing such vehicle.
12.3 Anyone operating a horse-drawn vehicle or riding a horse within the Village of Beiseker shall:
a)
clean up all excrement deposited by said horse;
b)
assume full liability for any injury or loss which may occur as a result of said activity.
SECTION 13 CYCLISTS, SCOOTERS, ROLLER SKATES, IN-LINE SKATES, SKATEBOARDS
13.1 No person shall cycle, inline skate, roller blade or skateboard upon a highway in such a manner
as to endanger public safety.
13.2 No person shall ride a bicycle, roller skate, in-line skate, skateboard, or a scooter:
a)
without yielding to the right of way of pedestrians;

b)
without giving an audible signal within a reasonable time before overtaking a pedestrian, by
voice, bell or other warning device which is audible to the pedestrian;
c)
without use of care and control required to ensure the safety of a pedestrian or other
person;
d)
without a helmet (if under the age of 18);
e)
on any property if prohibited from doing so by a Traffic Control Device;
f)
on private property without the expressed prior written consent of the property owner.
13.3 Notwithstanding any penalties specified, any person who operates a bicycle or skateboard
within the corporate limits of the Village in contravention of any of the provisions of this Bylaw or
any other Bylaw of the Village, or any Act of Alberta, may have the said bicycle or skateboard or
scooter impounded by and at the discretion of any Enforcement Officer for a period not
exceeding sixty(60) days. The Owner shall pay to the Village of Beiseker all storage and impound
fees associated. Such charges shall be in addition to any fine or penalty imposed in respect of
any such contravention of this bylaw.
SECTION 14 PARADES, PROCESSIONS AND DEMONSTRATIONS
14.1 No person shall hold any parade or procession or special roadway event without first obtaining a
permit from the Village of Beiseker, subject to such terms and conditions that the Village of
Beiseker deems advisable, for the parade or procession to be held.
14.2 Any person desiring to hold a parade or procession or special roadway event within the Village
shall at least fifteen (15) calendar days prior to the desired date, make application in writing to
the Village providing the following information:
a)
the name and address of the applicant or organization;
b)
the nature and object of parade or procession;
c)
the day, date, and hours during which same will be held;
d)
the intended route thereof;
e)
the approximate number of persons and vehicles who will take part in the event;
f)
proof of comprehensive general liability insurance of at least 1,000,000 (1,000,000.00)
dollars;
g)
and such written application shall bear the signatures and addresses of the persons who
will be in control of such parade or procession and who undertake to be responsible for the
good order and conduct thereof.
14.3 The Chief Administrative Officer may waive the fifteen (15) calendar day notice requirement in
subsection 14.2 for funeral processions or in emergency circumstances where public safety will
not be compromised.
14.4 The Village may specify the hours and route of the requested application if in the Village's
opinion will prevent any unnecessary or unreasonable obstruction to the highway or tend to
prevent a breach of the peace.
14.5 Where a permit has been granted for a parade or procession the Village of Beiseker may
temporarily close for all or some types of traffic all or portions of the streets along or near the
route set out in the permit for the anticipated time of the parade and for such additional time is
necessary to again clear the street or streets for normal traffic.
14.6 The Village of Beiseker may temporarily suspend parking and loading privileges on all or a portion
of the street(s) on the route of the parade.

14.7 No person shall enter within the route of a parade or procession and shall be restricted to the
sidewalk if not part of the parade or procession.
14.8 No parade or procession shall obstruct the movement, use or operation of any fire apparatus,
police vehicle, or emergency vehicles or equipment.
14.9 Where permission is obtained allowing floats, vehicles or animals to be placed in or on the route
of a parade, the person or persons sponsoring the parade shall indemnify and save harmless the
Village from and against any and all claims for injury to any person or persons and damage to any
real or personal property arising by reason of or in any way connected with the entry, placing or
operation of the vehicle or float in the parade or procession whether prior to, during or after the
parade or procession, and whether arising out of, or directly or indirectly caused by, any act,
omission or negligence of the Village, its employees or agents.
14.10 Notwithstanding Section 14.8 of this bylaw, the driver or operator of the vehicle or float and all
persons on such vehicle or float, taking part in the parade or procession shall ensure that;
a)
no part of the vehicle or float will damage any highway, electric or telephone poles or wires,
streetlights, cables or supports, traffic signs, fire hydrants or any other property of the
Village or a public utility in, upon, over or beside a street;
b)
the vehicle the float or anything there on or attached thereto will not injure any person or
cause damage to any real or personal property.
SECTION 15 MISCELLANEOUS
15.1 No person shall cause pedestrians to walk on a roadway by loading or unloading goods or
merchandise across the sidewalk or boulevard.
15.2 When a vehicle is driven, used, parked or left in contravention of any provision of this Bylaw, the
owner of the vehicle is responsible for the contravention and liable to the penalty provided herein
unless they prove to the satisfaction of the Enforcement Officer or a Provincial Court that at the
time of the contravention the vehicle was not driven, used, parked or left by them or by any other
person with their consent, express or implied. The word "Owner" as used in this section means,
in the case of a vehicle registered pursuant to the Traffic Safety Act R.S.A 2000, Chapter T-6, the
person named on the Certificate of Registration.
SECTION 16 PERMITS
16.1 Every person who fails to obtain or to comply within the provisions set out in a permit shall be
guilty of an offence and shall, in addition to any other penalty, cause the removal of the
obstruction or cease the activity forthwith after being notified to do so by the Village of Beiseker.
16.2 The Village of Beiseker may cause the removal of the obstruction or disbandment of the activity,
and such shall be at the expense of the person causing, placing, or permitting the infraction on
any highway or public place.
16.3 The Village of Beiseker retains the authority to revoke any permits issued to the individual,
organization or corporation who was named in the application or the name of the individual,
organization or Corporation that appears on the permit.
SECTION 17 ENFORCEMENT AUTHORITY OF AN ENFORCEMENT OFFICER
17.1 An Enforcement Officer is authorized to enforce this Bylaw and may issue a Penalty Tag or
Violation Ticket to any Person who contravenes a provision of this Bylaw.
17.2 A Penalty Tag may be served by:
a)
delivering it personally to the Person;
b)
leaving it at the Person's residence;
c)
sending it by ordinary mail.
17.3 A Penalty Tag shall state:

a)
the name of the Person (if known);
b)
the offence;
c)
the penalty amount as set out in Schedule A;
d)
the date the penalty is due.
17.4 If the voluntary penalty is paid within the time specified on the Penalty Tag, the Village shall
accept the payment in lieu of prosecution.
17.5 If payment is not made within the time specified on the Penalty Tag, a Violation Ticket may be
issued pursuant to the *Provincial Offences Procedure Act*.
17.6 No person shall obstruct or hinder any Village personnel in the exercise or performance of that
person's power pursuant to this bylaw.
17.7 No person shall obstruct or hinder an Enforcement Officer in the exercise or performance of that
Enforcement Officer's power pursuant to this bylaw.
SECTION 18 PENALTIES AND VOLUNTARY PAYMENT
18.1 Any person who contravenes a provision of this Bylaw is guilty of an offence and liable to a fine as
set out in the Village of Beiseker Fees & Charges Bylaw, established pursuant to MGA s.8(c).
18.2 Where a Penalty tag has been issued under this Bylaw, the following voluntary payment amounts
shall apply:
a)
Early Payment Amount 1: If the fine is paid within 15 days after the date of the offence, the
amount payable shall be 40% of the fine.
b)
Early Payment Amount 2: If the fine is paid between 16 and 45 days after the date of the
offence, the amount payable shall be 60% of the fine.
c)
Standard Fine: If payment is not made within 45 days in accordance with the Penalty tag, a
Violation Ticket may be issued pursuant to the Provincial Offences Procedure Act, R.S.A.
2000, c. P 34, and the Provincial Violation Ticket Amount shall be payable.
d)
If any payment deadline established in this section falls on a non-business day, the
deadline is deemed to be extended to the next business day.
18.3 Payment of the voluntary penalty within the time specified shall constitute satisfaction of the
offence.
SECTION 19 PENALTY TAGS AND VIOLATION TICKETS
19.1 Where an Enforcement Officer believes that a vehicle or trailer is parked in contravention of this
bylaw, he may:
a)
place a Penalty Tag on the vehicle or trailer; or
b)
send the Penalty Tag to the registered owner of the vehicle or trailer by ordinary mail.
19.2 A Penalty Tag shall be in form approved by the Village and shall state:
a)
the license plate of the vehicle or trailer;
b)
the offence;
c)
the appropriate penalty for the offence as is specified in Schedule "A" of this bylaw;
d)
the date that the penalty is due.
19.3 If a person who is responsible for a contravention of a provision of this bylaw, pays the specified
penalty amount within the times and in the manner set out on the Penalty Tag, such payment will
be accepted in lieu of prosecution.
19.4 If payments referred to in Section 19.3 are not made within the times and in the manner set out
on the Penalty Tag, a Violation Ticket may be issued to the registered owner of the vehicle or
trailer in accordance with the Provincial Offences Procedure Act, R.S.A 2000, c. P-34.
19.5 Nothing in this section shall;

a)
prevent any person from exercising the person's right to defend any charge of committing a
breach of any Section of this bylaw; or
b)
prevent any Enforcement Officer in lieu of serving a Penalty Tag from issuing a Violation
Ticket to a person or owner pursuant to the Provincial Offences Procedures Act R.S.A.
2000, c. P-34;
c)
from issuing a Violation Ticket requiring the court appearance of the defendant, pursuant to
the provisions of the Provincial Offences Procedures Act, R.S.A 2000, c. P 34, or from laying
an information instead of issuing a Violation Ticket.
19.6 No person(s) other than an Enforcement Officer shall place a Penalty Tag on any vehicle.
19.7 No person other than the owner or operator of a vehicle shall remove any Penalty Tag placed on
or affixed to a vehicle by an Enforcement Officer in the course of performing enforcement duties.
19.8 Where a contravention of this bylaw is of a continuing nature, further Penalty Tags may be issued
by an Enforcement Officer provided that no more than one Penalty Tag is issued for each day that
the contravention continues.
19.9 In order to determine the time which a vehicle or trailer has been parked an Enforcement Officer
may;
a)
take a time and date stamped photo or
b)
place an erasable chalk mark on the tire of the parked or stopped vehicle or trailer without
such Enforcement Officer or other person or the Village incurring any liability for so doing.
19.10 No person(s) shall remove an erasable chalk mark placed under Section 19.9 while the vehicle or
trailer remains parked in the location where it was marked.
SECTION 20 VEHICLE SEIZURE NOTICES
20.1 A Vehicle Seizure Notice may be issued allowing the owner a specific time in which to move a
vehicle or trailer.
20.2 An Enforcement Officer may place a Vehicle Seizure Notice on the parked or stopped vehicle or
trailer. The Vehicle Seizure Notice will display;
a)
the hours to correct the violation;
b)
date and time of offence;
c)
the licence number;
d)
the infraction or violation.
20.3 An Enforcement Officer may place a Vehicle Seizure Notice on the parked or stopped vehicle or
trailer without such Enforcement Officer or other persons or the Village incurring any liability for
so doing.
20.4 An Enforcement Officer may remove the vehicle or trailer, at the Owner's expense, after the time
specified has lapsed, to a location designated by an Enforcement Officer where it will remain
until claimed by the Owner or the Owner's authorized agent. All removal and storage costs shall
be paid by the Owner.
20.5 No person shall remove a Vehicle Seizure Notice placed under section 20.1 while the vehicle or
trailer remains parked in the location where it was marked.
SECTION 21 REMOVAL OR SEIZURE OF VEHICLES
21.1 An Enforcement Officer is hereby authorized to remove or cause to be removed any vehicle,
Recreational Vehicle, Off-Highway Vehicle, or trailer:
a)
parked in contravention of a provision of this bylaw or;
b)
where emergency conditions require removal of the vehicle or trailer from a highway.
21.2 Any such vehicle or trailer may be removed to a location designated by an Enforcement Officer
where it will remain until claimed by the Owner or the Owner's authorized agent.

21.3 The Owner or the Owner's authorized agent that has had any vehicle or trailer removed due to a
contravention of this bylaw shall pay to the Village of Beiseker or Impound Owner all storage
and/or removal charges. Such charges shall be in addition to any fine or penalty imposed in
respect of any such contravention of this bylaw.
SECTION 22 GENERAL
22.1 The provisions of this bylaw do not apply to the following vehicles:
a)
emergency vehicles;
b)
vehicles owned or within the lawful position of the Village;
c)
vehicles engaged in maintenance or repair of a public utility as defined in the Municipal
Government Act;
d)
a vehicle operated by a federal, provincial, or municipal government, or with the approval of
the federal, provincial, or municipal government for the purpose of constructing or
maintaining a highway;
e)
school buses when authorized or buses for the handicapped while transporting loading or
unloading passengers during the ordinary course of business.
SECTION 23 SEVERABILITY
23.1 If any Section or parts of this bylaw are found in any court of law to be illegal or beyond the power
of Council to enact, such Section or parts shall be deemed to be severable and all other Section
or parts of this bylaw shall be deemed to be separate and independent there from and to be
enacted as such.
SECTION 24 RESCINDED BYLAW
24.1 Bylaw No. 2020-09-Streets-and-Traffic is hereby rescinded.
SECTION 25 EFFECTIVE DATE
25.1 This Bylaw shall take effect upon the date of passage thereof.
