## VILLAGE OF BITTERN LAKE
## BYLAW # 07/20 - TRAFFIC BYLAW
A BYLAW OF THE VILLAGE OF BITTERN LAKE IN THE PROVINCE OF ALBERTA TO REGULATE AND CONTROL VEHICLE TRAFFIC WITHIN THE VILLAGE.
WHEREAS the Traffic Safety Act, being Chapter T-6 of the Revised Statutes of Alberta, 2000, as amended, authorizes a Municipal Council of a municipality to make bylaws to govern the use and operation of vehicles, pedestrians and highways which are under its direction, control and management and
THEREFORE, the Council of the Village of Bittern Lake, in the Province of Alberta, duly assembled hereby enacts as follows:
## 1. TITLE
This bylaw may be cited as the "Traffic Bylaw".
## 2. DEFINITIONS
- A. Village means the Village of Bittern Lake.
- B. Council means the Council of the Village of Bittern Lake.
- C. Enforcement Officer means any peace officer or other person appointed by the Council to enforce the provisions of this bylaw.
- D. Emergency Vehicle means fire fighting vehicles, public utility vehicles while being used in an emergency, police vehicles, ambulances or a vehicle being used by a medical doctor responding to an emergency call.
- E. Parade and/or processions means and includes any group or train of person and/or animals and vehicles using any road, highway, or public place within the Village for show, display, or demonstration.
## 3. PROTOCOL
- A. Except when authorized, all vehicles will be parked parallel to the curb, facing the line of traffic, with the right-hand wheels not more than forty-six (46) centimeters or eighteen (18) inches from the curb.
- B. No person may double park.
- C. No person will park any trailer, whether designated for occupancy or load carrying unless such a trailer is attached to a vehicle. In which case, no vehicle and trailer combo may be parked in such a way as to cause an obstruction or traffic hazard and are not allowed within one (1) meter or three point three 3.3 feet of roadway to allow for sightlines.
- D. No person will park a vehicle at the curb within seven (7) meters or 23 feet of any intersection.
- E. Parking and other traffics sign may be erected in certain areas within the Village by the direction of Council.

- F. No vehicle may be parked on any roadway within the Village for a continuous period of more than forty-eight (48) hours.
- G. Parking areas will be designated and approved by Council.
- H. A 75% load ban is always in effect.
- I. No vehicles more than one (1) ton will enter the Village except on designated truck routes or special permission of Council.
- K. No person will park any vehicle or trailer containing any volatile or flammable liquid, gas, or other dangerous substance:
- J. No person will, except in the case of an emergency or mechanical failure, stop or park a vehicle upon any roadway in a manner that may impede or obstruct the free movement of traffic.
- i. Upon any roadway within the Village or
- ili. This clause will not apply where a vehicle is obliged to park for the purpose of loading or unloading its cargo and such vehicle is clearly marked with a warning notice identifying the nature of the cargo.
- ii. Upon any roadway closer than fifteen (15) meters or 49.5 feet to any building.
## 4. RIGHT OF WAY
- A. Any vehicle driver will yield right of way to pedestrians crossing any intersection or roadway.
- B. Any vehicle driver entering any highway from any land, driveway, garage parking lot or parking area will yield the right of way to all vehicles and pedestrians.
## 5. SPEED
- i. Except Roper Road and Martin Avenue, which will be given a speed maximum of fifty (50) kilometers (31 miles) an hour.
- A. No vehicle will be driven within the Village limits at a speed greater than thirty (30) kilometers (18.6 miles) an hour.
- B. No person will drive a motor vehicle at a speed greater than thirty (30) kilometers (18.6 miles) an hour in a playground zone or twenty (20) kilometers (12.4 miles) an hour in any lane or alley within the Village.
## 6. CONSTRUCTION
- B. No person will cause an obstruction of any street, road, foot path or any other public place by the act of parking or leaving, whether attended or unattended vehicle.
- A. No person will without legal authority, place any obstruction upon any street, lane, or public place.

## 7. PARADES AND PROCESSIONS
- A. No person will hold or take part in any parade or procession unless a permit has been obtained from the authority of the Village Office.
## 8. NO RIDING OF BICYCLES ON SIDEWALKS
- A. No person will ride a bicycle or any sidewalk. Children's tricycles are exempt from this provision.
## 9. MISCELLANEOUS
- A. No person will tow anything behind a vehicle unless attached to the towing vehicle by means of a solid hitch.
- B. No person will drive any vehicle within the Village limits in a dangerous or reckless manner.
- C. No person will deposit, drop, or leave any litter including cans and bottles of any description on any road, lane highway or public place within the Village.
## 10. PENALTIES
- B. The owner of such a vehicle moved by an enforcement officer under the provisions of this section will pay upon demand the cost of removing such vehicle and such reasonable storage and other charges as may be incurred in addition to any time for the original offense.
- A. In case of where a vehicle is parked in violation of any provisions of this bylaw, any enforcement officer may cause such vehicle to be moved to a place designated by Council or to a location on the highway where such parking is permitted.
- C. Any person who violates or contravenes any provision of the bylaw or any person responsible for such violations or contravention is guilty of such offenses will be liable on summary conviction before a provincial court judge to a penalty of:
- ii. For a second offence - a minimum fine of $250 to a maximum fine of $750.
- i. For a first offence - a minimum fine of $100 to a maximum fine of $500.
- ili. For a third and subsequent offence - a minimum fine of $500 to a maximum fine of $1000.
- D. In addition to fines stipulated in section 10C, a provincial court judge may order imprisonment for any period not exceeding six (6) months or make any order deemed appropriate concerning a breech of any section of this bylaw or concerning the recovery of costs resulting from the removal of vehicles parked in violation of this bylaw, the storage of said vehicles or any other costs that may be incurred by the Village in respect of said vehicles.
- E. Notwithstanding any other provisions for penalties in this bylaw, an enforcement officer may, in lieu of laying an information in respect to the alleged breach for the first offense or for a second subsequent offense in respect to the said breach, issue a violation ticket to the accused specifying that:

- i. A voluntary payment may be made as set out in the Schedule A of this bylaw or
- ii. If it is in the public interest to compel the accused to appear before justice, issue a summons respecting any offense for which a voluntary payment may be made requiring the accused to appear before a justice on the initial appearance date without the alternative of making a voluntary payment.
- ili. Schedule A attached hereto forms a part of this bylaw.
## 11. COME INTO FORCE
- A. Bylaw #07/20 is to replace Bylaw #01/03 to update speed limits and more provided by this bylaw. Bylaw #01/30 is hereby rescinded.
- B. This Bylaw shall come into force and effect upon the date of the final passing thereof.
