BYLAW 04-25
A BYLAW TO PROHIBIT THE USE OF FIREWORKS WITHIN THE SUMMER VILLAGE
BOUNDARIES
WHEREAS the Municipal Government Act, RSA 2000, Chapter M-26, as amended, provides that
a municipal council may pass bylaws for municipal purposes regarding the safety, health, and
welfare of people and the protection of property;
AND WHEREAS the Council of the Summer Village of Bondiss deems it necessary to prohibit the
use of fireworks within the Summer Village to ensure the safety of residents, protect property,
and reduce the risk of fire hazards;
NOW THEREFORE the Council of the Summer Village of Bondiss, duly assembled, enacts as
follows:
1. TITLE
1.1 This bylaw may be cited as the "Fireworks Prohibition Bylaw."
2. DEFINITIONS
2.1 "Council" means the duly elected Council of the Summer Village of Bondiss.
2.2 "Fireworks" means any explosive device or composition used for the purpose of
producing visual or audible effects, including but not limited to firecrackers,
sparklers, roman candles, and aerial shells, as defined in the Alberta Fire Code.
2.3 "Person" means any individual, corporation, business, partnership, association, or
other entity.
2.4 "Summer Village" means the Summer Village of Bondiss.
3. PROHIBITION
3.1 No person shall ignite, discharge, or use fireworks within the boundaries of the
Summer Village.
3.2 No person shall sell, offer for sale, or store fireworks within the Summer Village
boundaries.
3.3 The provisions of this bylaw apply to both private and public properties within the
Summer Village.

4. EXEMPTIONS
4.1 The prohibition under this bylaw does not apply to:
a) Fireworks displays authorized in writing by the Summer Village and conducted
by a certified professional, in accordance with the Alberta Fire Code and other
applicable regulations.
b) Fireworks used by law enforcement, emergency services, or other government
agencies for official purposes.
5. ENFORCEMENT
5.1 A Peace Officer, as defined in the Municipal Government Act, is authorized to
enforce the provisions of this bylaw.
5.2 A Peace Officer may enter onto any property to inspect for compliance with this
bylaw.
6. PENALTIES
6.1 Any person who contravenes any provision of this bylaw is guilty of an offense and
liable for the following fines:
a) First offense: $250.00
b) Second offense: $500.00
c) Subsequent offenses: $1,000.00
6.2 In addition to fines, any fireworks found in violation of this bylaw may be confiscated
and disposed of at the discretion of the enforcement officer.
6.3 A violation ticket may be issued under the Provincial Offences Procedure Act for any
offense under this bylaw.
7. SEVERABILITY
7.1 If any provision of this bylaw is found to be invalid by a court of competent
jurisdiction, the invalid provision shall be severed, and the remainder of the bylaw
shall remain in effect.
8. EFFECTIVE DATE
8.1 This bylaw shall come into force upon third and final reading by the Council of the
Summer Village of Bondiss.
