Page 1 of 3 BYLAW 10-25 A BYLAW OF THE SUMMER VILLAGE OF BONDISS, IN THE PROVINCE OF ALBERTA, TO REGULATE NOISE WITHIN THE MUNICIPALITY. WHEREAS, pursuant to the Municipal Government Act, R.S.A. 2000, Chapter M-26, and amendments thereto, a municipality may pass bylaws respecting nuisances, including noise; AND WHEREAS it is desirable to regulate and prohibit certain activities creating noise, which may disturb residents and visitors of the Summer Village of Bondiss; NOW THEREFORE, the Council of the Summer Village of Bondiss, duly assembled, enacts as follows: 1. TITLE 1.1 This bylaw may be cited as the "Noise Control Bylaw." 2. DEFINITIONS 2.1 "Council" means the duly elected municipal council of the Summer Village of Bondiss. 2.2 "Municipality" means the Summer Village of Bondiss. 2.3 "Noise" means any loud, unnecessary, or unusual sound which disturbs the peace, comfort, or repose of individuals. 2.4 "Person" includes an individual, corporation, partnership, or any other legal entity. 2.5 "Residential Area" means any area designated for residential use in the municipal land use bylaw. 2.6 "Officer" means a Bylaw Enforcement Officer or a Peace Officer authorized to enforce municipal bylaws. 3. GENERAL PROHIBITIONS 3.1 No person shall cause or permit noise that disturbs or is likely to disturb the peace of others within the municipality. Page 2 of 3 3.2 No person shall operate any equipment, machinery, or motor vehicle in a manner that creates excessive noise between the hours of 11:00 PM and 8:00 AM. 3.3 Outdoor music, amplified sound, or public address systems shall not be operated in a manner that unreasonably disturbs residents, particularly between 11:00 PM and 8:00 AM. 3.4 Construction-related noise shall be limited to weekdays only, wherever possible, and shall not occur on weekends unless explicitly approved by the municipality. 4. EXEMPTIONS 4.1 The following activities are exempt from this bylaw: a) Emergency services, including police, fire, and ambulance operations; b) Snow removal, road maintenance, or other municipal services; c) Agricultural operations lawfully conducted in designated agricultural areas; d) Special events approved by Council or the Chief Administrative Officer (CAO). 5. ENFORCEMENT 5.1 An Officer may investigate any complaints related to noise disturbances and take necessary enforcement action. 5.2 Any person found in violation of this bylaw may be issued a warning or a violation ticket. 6. PENALTIES 6.1 A person who contravenes this bylaw is guilty of an offense and is liable to: a) First Offense: $250 fine; b) Second Offense (within 12 months): $500 fine; c) Subsequent Offenses: $1,000 fine. 6.2 Failure to comply with an Officer's direction may result in additional fines or legal action. 7. SEVERABILITY 7.1 Should any section of this bylaw be found invalid by a court, such section shall be severed, and the remainder of the bylaw shall remain in effect. Page 3 of 3 8. REPEAL 8.1 Bylaw 3-13 is hereby repealed. 9. EFFECTIVE DATE 9.1 This bylaw shall come into force upon third and final reading by the Council of the Summer Village of Bondiss. Read a first time this 22nd day of April, 2025. Read a second time this 22nd day of April, 2025. Consent to proceed to third reading this 22nd day of April, 2025.
