Page 1 of 3 BYLAW 12-25 A BYLAW OF THE SUMMER VILLAGE OF BONDISS TO DESIGNATE ALL RESERVE LANDS AS PARKS AND TO PROHIBIT OVERNIGHT CAMPING WHEREAS, pursuant to the Municipal Government Act, R.S.A. 2000, c. M-26, and amendments thereto, a municipality has the authority to pass bylaws respecting the use and protection of municipal lands, including reserve lands; AND WHEREAS the Council of the Summer Village of Bondiss deems it necessary and in the public interest to designate all reserve lands as parks and to regulate their use; NOW THEREFORE, the Council of the Summer Village of Bondiss, in the Province of Alberta, duly assembled, enacts as follows: 1. TITLE 1.1 This Bylaw may be cited as the "Reserve Lands Designation and Camping Prohibition Bylaw." 2. DEFINITIONS 2.1 "Council" means the Council of the Summer Village of Bondiss. 2.2 "Municipality" means the Summer Village of Bondiss. 2.3 "Park" means any land designated as a reserve, municipal reserve, environmental reserve, or public utility lot owned by the Summer Village of Bondiss that is intended for public use and enjoyment. 2.4 "Overnight Camping" means the use of tents, trailers, campers, recreational vehicles, or any other temporary shelters for the purpose of staying overnight. 2.5 "Person" means any individual, partnership, corporation, or other legal entity. 3. DESIGNATION OF RESERVE LANDS 3.1 All reserve lands within the Summer Village of Bondiss, including but not limited to municipal reserves, environmental reserves, and public utility lots, are hereby designated as parks for public use and enjoyment. Page 2 of 3 3.2 The use of these lands shall be in accordance with municipal regulations and any other applicable provincial or federal legislation. 4. PROHIBITION OF OVERNIGHT CAMPING 4.1 No person shall engage in overnight camping on any reserve lands designated as parks within the Summer Village of Bondiss. 4.2 No person shall set up, place, or maintain a tent, trailer, camper, or any other temporary shelter on reserve lands for the purpose of overnight accommodation. 4.3 Any person found in violation of this section shall be subject to the penalties outlined in Section 6 of this Bylaw. 5. ENFORCEMENT 5.1 This Bylaw shall be enforced by a designated bylaw enforcement officer, peace officer, or any other person appointed by the Council to enforce municipal bylaws. 5.2 Any person who refuses to comply with this Bylaw may be directed to vacate the reserve lands immediately by an enforcement officer. 6. PENALTIES 6.1 Any person who contravenes any provision of this Bylaw shall be subject to fines as per the Fees and Penalties Bylaw. 6.2 Each day that a violation continues shall constitute a separate offense. 6.3 In addition to any fine imposed, the Municipality may remove or cause to be removed any tent, trailer, camper, or other temporary shelter found in violation of this Bylaw at the expense of the offender. 7. EXCEPTIONS 7.1 This Bylaw does not apply to municipal employees, contractors, or emergency personnel engaged in their official duties. 7.2 Council may grant temporary exemptions for special events by written approval and subject to any conditions it deems necessary. 8. SEVERABILITY 8.1 If any provision of this Bylaw is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall remain in full force and effect. Page 3 of 3 9. REPEAL 9.1 Bylaw 3/83 is hereby repealed. 10. EFFECTIVE DATE 10.1 This Bylaw shall come into force and effect upon the date of its third and final reading.
