Bylaw No. 167-2020 establishes the Subdivision Authority and Development Authority for the Summer Village of Bonnyville Beach, as required under the Municipal Government Act (MGA). This bylaw defines the roles, responsibilities, and administrative processes governing subdivision and development decisions within the municipality. ## Purpose: This bylaw is enacted to: * Comply with Sections 623 and 624 of the MGA, which require municipalities to create both a Subdivision Authority and a Development Authority. * Formally establish the individuals or bodies responsible for processing development permit applications and subdivision applications. * Provide clarity, structure, and consistency in municipal planning decision-making. * Adopt Bylaw 167-2020 as the official Subdivision and Development Authority Bylaw of the Summer Village of Bonnyville Beach. ## Key Provisions ## Title & Interpretation * Official short title: "Summer Village of Bonnyville Beach Subdivision and Development Authority Bylaw." * Defines important terms, including: + Act (the MGA) + Development Authority + Subdivision Authority + Development Officer + Municipal Planning Commission (MPC) + Designated Officer + Authorized Persons These definitions ensure consistency in interpretation and alignment with provincial legislation. ## Development Authority Establishment The Development Authority for the municipality may be: 1. The Development Officer, or 2. The Municipal Planning Commission (MPC). Powers & Duties The Development Authority exercises all powers and responsibilities assigned through: * The Municipal Government Act * Municipal Land Use Bylaw * The Municipal Planning Commission Bylaw * This Bylaw or Council resolution * Any applicable provincial regulations Appointment of Development Officer * Council may appoint one or more Development Officers by resolution. * Their powers and duties are further defined in the municipality's Land Use Bylaw. ## Subdivision Authority Establishment * The Municipal Planning Commission (MPC) is designated as the Subdivision Authority for all subdivision applications. Powers & Duties * The MPC carries out all subdivision-related functions assigned under: + The MGA, and + Any related regulations. Administrative Functions * The Chairperson of the MPC, or their delegate, serves as the signing authority for all subdivision matters. * The signing authority may accept minor modifications to subdivision plans submitted for endorsement, provided that: + The number of parcels does not increase. + Municipal, school, or environmental reserves are not negatively affected. + Municipal road standards are maintained. + Changes comply with municipal bylaws, except where minor adjustments are allowed under Section 654(2) of the MGA. ## Enactment * The bylaw comes into force upon third reading and signing by the Mayor and Chief Administrative Officer (CAO). * First reading occurred on October 28, 2020.
