## VILLAGE OF BOYLE ## BYLAW 07-23 ## A BYLAW OF THE VILLAGE OF BOYLE, IN THE PROVINCE OF ALBERTA, TO ESTABLISH A MUNICIPAL PLANNING COMMISSION ## WHEREAS Section 625 of the Municipal Government Act, R.S.A. 2000, c. M-26, requires that a Council may by bylaw, establish a municipal planning commission NOW THEREFORE, the Council of the Village of Boyle, duly assembled, hereby enacts as follows: ## Part! 1. This Bylaw may be cited as the "Municipal Planning Commission Bylaw." 2. That a Commission known as the Municipal Planning Commission of the Village of Boyle, hereinafter called "the Commission" is hereby established. 3. The Commission shall consist of at least three (3), and up to five (5) members, to be appointed by resolution of Council, from the members of Council, at the annual organizational meeting or as required due to vacancies occurring. 4. Term of Office: - a. Each member shall be appointed for a one year term, and shall be eligible to be re-appointed. Council may revoke an appointment to the Commission at any time by way of motion. - b. Upon ceasing to be a member of Council, a person shall no longer be eligible to be a member of the Commission. 5. That the Commission shall elect a Chairman and Vice-Chairman from its members. 6. That a simple majority of the members of the Commission shall constitute a quorum for making of all decisions and for doing any action required or permitted to be done by the Chairman. 7. That a member of the Commission who is for any reason unable to attend the whole or a part of any meeting on an application, shall not participate in the deliberations or decision of the Commission upon that application. 8. That the decision of the majority of the members present at a meeting duly convened shall be deemed to be the decision of the whole Commission. 9. That the Commission shall hold such meetings as are necessary to fulfill the Commission's responsibilities. 10. That the Commission shall have prepared and maintain a file of written minutes of the business transacted at all meetings of the Commission, copies of which shall be regulary filed with the Council. 11. That per diem remuneration and expenses incurred directly related to performance of Municipal Planning Commission duties shall be established from time to time by Village Council. 12. That the Commission may make rules as are necessary for the conduct of its meetings and its business that are consistent with the Municipal Development Plan, Land Use Bylaw, and the Municipal Government Act. 13. That the setting of fees for any matter coming before the Commission shall be established by Council as outlined in the "Fees and Charges Bylaw". 14. That the Secretary of the Commission shall be appointed by the Chief Administrative Officer of the Village of Boyle. <!-- image --> ## Part I! 15. That the Commission shall advise and assist the Council with regard to the planning of orderly and economical development within the municipality and shall seek to ensure that any proposed development is in accordance with the purpose scope or intent of the Land Use Bylaw and Municipal Development Plan. 16. That the Commission is hereby authorized and assigned by the Council to assist the Development Officer when required, and if requested by the Development Officer, to consider and decide on applications for development permits in the manner prescribed in the Land Use Bylaw. 17. That the Commission may make its orders, decisions, development permits and approvals and issue notices with or without conditions. ## BYLAW 1-92 IS HEREBY REPEALED. THIS BYLAW SHALL TAKE FULL FORCE AND EFFECT UPON DATE OF FINAL READING.
