## CITY OF BROOKS BYLAW NO. 24/01
## A BYLAW OF THE CITY OF BROOKS TO REGULATE HIGHWAY TRAFFIC.
Pursuant to The Traffic Safety Act, R.S.A. 2000, c. T-6, the City of Brooks enacts as follows:
## 1. Short Title:
100. This Bylaw may be cited as the "City of Brooks Traffic Bylaw."
## 2. Definitions:
200. For the purpose of interpretation this Bylaw accepts and encompasses all definitions as set out in the Act, and all such definitions in that Act shall apply to those terms when used in this Bylaw.
201. Notwithstanding Section 200 above:
202. "Act" means The Traffic Safety Act, R.S.A. 2000, c. T-6, as amended or replaced from time to time;
203. "Boulevard" means that part of a Highway in an urban area that is not a roadway and is that part of the Sidewalk that is not especially adapted to the use of or ordinarily used by pedestrians;
204. "Bylaw" means the City of Brooks Traffic Bylaw No. 24/01 as may be amended from time to time;
205. "Chief Administrative Officer" means the Chief Administrative Officer of the City of Brooks regardless of any subsequent title that may be conferred on that officer by Council or statute, or their designate;
206. "City" means the City of Brooks, a Municipal Corporation in the Province of Alberta, or the geographical area contained within the boundaries of the City of Brooks, as the context may require;
207. "Commercial Vehicle" means a Vehicle operated on a Highway by or on behalf of a person for the purpose of providing transportation and/or any Vehicle that a Peace Officer has reasonable grounds to believe is a Commercial Vehicle and includes any goods carried by the Vehicle but does not include a private passenger Vehicle;
208. "Council" means the Municipal Council of the City of Brooks;
209. "Disabled Parking Space" means a portion of a Highway or private property designated by signage, pavement markings, or both, for the exclusive use of disabled persons who operate or travel by motor Vehicles;
210. "Gross Vehicle Weight" shall mean the aggregate weight of the unloaded Vehicle and the weight of the load which that Vehicle is licensed to carry and for the purpose of enforcing this Bylaw, the terms "GVW", "Gross Vehicle Weight", "Licensed Mass", "Licensed Maximum Gross Weight", "Maximum Gross Weight" and "Registered Weight" shall carry the same meaning;
211. "Heavy Vehicle" shall mean a Commercial Vehicle, with or without a load that exceeds any one of the following: A Gross Vehicle Weight in excess of 7,500 kilograms, or an overall length, inclusive of any attached commercial trailer, of 11 meters, or an overall height of 2.74 meters or an overall width of 2.25 meters;
212. "Highway" means any thoroughfare, Highway, road, trail, avenue, parkway, driveway, viaduct, lane, alley, square, bridge, causeway, trestleway or other place or any part of any of them, whether publicly or privately owned, that the public is ordinarily entitled or permitted to use for the passage or parking of Vehicles and includes a Sidewalk, including a Boulevard adjacent to the Sidewalk, if a ditch lies adjacent to and parallel with the roadway, the ditch, and if a Highway right of way is contained between fences or between a fence and one side of the roadway, all the land between the fences, or all the land between the fence and the edge of the roadway, as the case may be, but does not include a place declared by regulation not to be a Highway as defined in The Traffic Safety Act, R.S.A 2000, c. T-6;
213. "Live" means occupying a space for longer than 72 hours;
214. "Mobility Aid" means a device used to facilitate the transport, in a normal seated orientation, of a person with a physical disability;
215. "Off-Highway Vehicle" means any motorized mode of transportation built for cross-country travel on land, water, snow, ice, marsh or swamp land or on other natural terrain;
216. "Peace Officer" means a Bylaw Enforcement Officer appointed by the City of Brooks pursuant to Section 555 of the Municipal Government Act and for the purpose of enforcement of this Bylaw, also includes a Community Peace Officer or a member of the Royal Canadian Mounted Police;
217. "Recreation Vehicle" shall mean a Vehicle or combination of a Vehicle and trailer designed for vacation, camping or similar recreation purposes and shall include but not be limited to light trailers designed for hauling watercraft, snowmobiles and all-terrain vehicles;
218. "Registrar" means the Registrar of Motor Vehicle Services and includes any person who, on the directions of the Registrar, is acting on behalf of the Registrar of Motor Vehicle Services;
219. "Sidewalk" means that part of a Highway especially adapted to the use of or ordinarily used by pedestrians, and includes that part of a Highway between the curb line (or the edge of the roadway where there is no curb line) and the adjacent property line, whether or not it is paved or improved;
220. "School Patrol" shall mean any authorized member of a School Patrol program of a local school division controlling an intersection or crosswalk being used by students;
221. "Tare Weight" shall mean the weight of the Vehicle when it is not carrying a load;
222. "Traffic Control Device" means any sign, signal, marking or device placed, marked or erected under the authority of the Act for the purpose of regulating, warning or guiding traffic;
223. "Truck Route" means a Highway or any portion thereof which has been designated as a Truck Route in the City of Brooks as per Schedule "A";
224. "Vehicle" means a device in, on or by which a person or thing may be transported or drawn on a Highway and includes a combination of Vehicles but does not include a Mobility Aid;
225. "Violation Tag" means a tag or similar document issued by the City pursuant to the Act; and,
226. "Violation Ticket" means a ticket issued pursuant to the Provincial Offences Procedures Act, RSA 2000, c P-34, as amended and any Regulations thereto.
## 3. Authority of Chief Administrative Officer
300. The Council of the City of Brooks hereby delegates to the Chief Administrative Officer power to prescribe where Traffic Control Devices are to be located.
301. Without restricting the generality of the above Subsection 300 the Chief Administrative Officer is authorized to:
302. Designate playground zones, school zones, safety zones, passenger and truck loading zones and cause same to be marked with signs or pavement markings or both;
303. Designate those intersections where right turns, left turns, Uturns or any turns may be prohibited and shall cause those intersections to be marked with signs;
304. Designate those areas where angle or parallel parking is permitted for a specified period of time or where parking is prohibited and shall cause those areas to be marked with signs, curb or pavement markings or both;
305. Designate any Highway as one which is closed temporarily in whole or in part and shall cause such Highway to be marked by signs or suitable warning devices;
306. Fix a maximum speed limit in respect of any part of a Highway under construction or repair or in a state of disrepair
307. Designate residential parking zones and designate employees or agents of the City of Brooks to issue residential parking zone permits.
## 4. General Rules
400. No Vehicle operator shall drive, stop or park a Vehicle upon a Highway in such a manner as to block, obscure, impede or hinder traffic thereon. Where the obstruction is unavoidable due to mechanical failure, the operator will not be in breach of this section provided they promptl akes measures to clear the faulty Vehicle from the Highway
401. When the Chief Administrative Officer has caused any intersection to be marked by signs or otherwise indicating that left turns, right turns, U-turns or any turns are prohibited, no operator of a Vehicle shall make suct prohibited turn.
402. Every person shall comply with any traffic signal or direction of a Peace Officer or a person directed by a Peace Officer.
403. Every person shall comply with any traffic signal or direction of a member of the School Patrol.
404. No operator of any Vehicle shall drive over any Sidewalk or Boulevard except at a permanent or temporary driveway.
405. No Vehicle with steel lugs or cleats may be operated or propelled on any paved or hard-surfaced Highway, land or roadway.
406. No operator of any Vehicle shall fail to obey a Traffic Control Device.
407. Where an unprotected hose of the Fire Department has been laid down on any Highway or driveway for use at a fire or alarm of fire, no person shall drive any Vehicle over such hose except with the consent of a member of the Fire Department.
408. Where a newly painted line on any roadway is indicated by signs, flags or other warning devices, no person shall willfully drive or walk over such lines.
409. When repairs or alterations are in progress on or adjoining any roadwork and such work is being indicated by barricades, signs or by flagperson, no person shall disregard the warning given thereby and every operator shall obey any signal of a flagperson on duty at the site of the work.
410. No occupier of any premises shall permit the unrestricted flow of any water from such premises over any Highway, Sidewalk or Boulevard.
411. No person shall, without authorization from the City, deposit any earth, rocks, trees or other substances or objects on any Highway, Sidewalk or Boulevard within the City, and if such deposits have been made without authorization and the City removes the same, the expense therefore shall be chargeable to the person responsible, which shall be in addition to any fine or penalty imposed by this Bylaw.
412. Operators of motor Vehicles and trailers used for the purpose of carrying any cargo must adequately enclose, secure or cover the cargo to prevent any portion of the load from falling or blowing onto any public or private property.
413. No person shall apply or engage engine retarder brakes on any truck in any part of the City.
414. No person shall operate or park a school bus, as defined by The Traffic Safety Act, R.S.A. 2000, c. T-6, School Bus Operation Regulation 437/86 as amended, in excess of 6.75 meters in overall length, off the City of Brooks scheduled Truck Route except while transporting pupils to or from a school or school event.
415. No person shall allow any leaked, spilled or otherwise emitted fuel, solvents, other petroleum based products or other liquids, including water, to be leaked, spilled or otherwise emitted onto any Highway from any Vehicle or container located on or in a Vehicle.
416. Any leaked, spilled or otherwise emitted fuel, solvents or other petroleum based products or other liquids, including water, may be subject to clean-up by the City of Brooks if they are not cleaned up to the satisfaction of a Peace Officer within twenty-four (24) hours of the time of the leak, spill or emission. Any costs for the clean-up or repairs for damage caused, will be payable by the registered owner of the Vehicle involved in the leak, spill or emission.
417. No person shall allow trees, hedges, shrubs or any other object on private property within five (5) meters of a Highway and/or Highway intersection whether planted or placed before or after the date of the passing of this Bylaw, to interfere with vision or safe movement of Vehicles and pedestrians.
418. A Peace Officer may require any person concerned to comply with the provisions of subsection 417 hereof within fourteen (14) days of being notified to do so. If the person fails to comply with such notice, the Peace Officer may direct employees or agents of the City to enter upon the private property to carry out the necessary work and may charge the cost of so doing against the person in default.
419. A person who enters the City of Brooks shall comply with:
420. Any lawful orders and instructions made or issued pursuant to the Act or this Bylaw; and,
421. The instructions, prohibitions and directions prescribed by all lawfully designated and erected signs and notices.
422. No person shall operate or park a Vehicle or trailer on a Highway with expired registration.
423. No person shall do any of the following on a Highway:
424. Display any goods for sale;
425. Offer any goods for sale;
426. Sell any goods; and/or,
427. Park a Vehicle that is being displayed for sale or that is displaying advertising directing persons to a commercial premises.
## 5. Speed
500. All school zones within the corporate limits of the City will be in effect from 8:00 a.m. to 5:00 p.m. inclusive, on any day which school is held.
501. All playground zones within the corporate limits of the City will be in effect from 8:30 a.m. to one hour after sunset, inclusive.
## 6. Truck Routes and Weight Restrictions
600. Except where specific exemption is allowed elsewhere in this Bylaw, no person shall operate or park a Heavy Vehicle on any Highway other than a Highway designated as a Truck Route in Schedule "A" of this Bylaw.
601. No person shall operate or park a Vehicle on any Highway in excess of the weight and size limits established by The Traffic Safety Act, R.S.A. 2000, c. T-6 of the Province of Alberta and Regulations passed there under without first obtaining a permit similar to Form "A" as attached to this Bylaw from the Chief Administrative Officer or their designate. A fee of $25.00 for this permit shall be submitted with the request for the permit and a copy of this permit must be in possession of the operator of the Vehicle and they shall produce the permit to a Peace Officer when requested to do so.
602. Subsection 600 shall not apply to a Heavy Vehicle if the operator and/or owner proves it was operated in the most direct and practical route between the location off the Truck Route and the nearest Truck Route, and it was also:
603. Delivering or collecting goods or merchandise to or from the premises of bona fide customers;
604. Proceeding to or from a location located in a non-residential area for servicing or repair of the Heavy Vehicle; or,
605. Towing or transporting a disabled Vehicle to or from a location off the Truck Route.
606. Subsection 600 shall not apply to a Heavy Vehicle if the operator and/or owner proves it is:
607. A public transit Vehicle;
608. A Vehicle owned by or in the service of the City;
609. An empty, single axle dual wheel truck, without a trailer, and a Gross Vehicle · Weight exceeding 7,500 kilograms, and with a Tare Weight not exceeding 7,300 kilograms;
610. Being used by any person while conducting bona fide repairs or work at a location off the Truck Route;
611. A Recreation Vehicle as defined in this Bylaw; or,
612. A private or farm Vehicle, towing an empty livestock trailer with a Tare Weight not exceeding 7,300 kilograms.
613. The Chief Administrative Officer, may impose such temporary weight restrictions on any Highway and temporarily vary the provision of sections of this Bylaw as may be necessary to protect the Highway.
614. No person shall operate a Vehicle on a Highway contrary to the temporary weight restriction as set out by the Chief Administrative
Officer.
615. Where the Chief Administrative Officer has imposed temporary restrictions under Subsection 613 above, a person operating a Vehicle which would otherwise be prohibited from the use of a particular Highway may obtain a special permit similar to Form "B" of this Bylaw from the Chief Administrative Officer or their designate prior to being allowed movement on restricted Highways. Such permits shall be issued only in exceptional circumstances.
616. No person shall prevent, obstruct or refuse to allow any Peace Officer to conduct the examination, measuring or weighing on any stationary scale certified under the Weights and Measures Act, of a suspected Heavy Vehicle, to determine its status under this Bylaw.
617. A Peace Officer shall have authority to conduct examination, measuring or weighing of any suspected Heavy Vehicle and shall not incur any liability in this action and any costs arising from the measuring or weighing of the Vehicle shall be borne by the registered owner of the suspected Heavy Vehicle.
## 7. Off-Highway Vehicles
700. No person shall operate an Off-Highway Vehicle on any Highway or public property within the boundaries of the City unless use is expressly permitted by Council or the Chief Administrative Officer.
701. No person shall operate an Off-Highway Vehicle on private property without the owner's consent.
## 8. Parade and Processions
800. No person shall organize or hold any parade or procession unless a permit has been obtained from the office of the Chief Administrative Officer.
801. Any person desiring to hold a parade or procession shall, at least thirty (30) days prior to the time they desire to hold the same, make application in writing to the office of the Chief Administrative Officer and such an o dang too to the application shall contain the following information:
802. The names and addresses of the applicant, and if the applicant is an organization, the names and addresses of the executive thereof;
803. The day, date and hours during which the same will be held;
804. The intended route of the parade and certification;
805. The approximate number of persons who will be taking part;
806. The nature and object of the parade and procession; and,
807. The signatures and addresses of the persons who will be responsible for the orderly conduct thereof.
808. The Chief Administrative Officer or a person appointed by him/her, is hereby authorized to issue permits for parades or processions if he/she deems it in order. The Chief Administrative Officer is also authorized to waive the time requirements set out in Subsection 801 should a situation occur where that is required. In the event the Chief Administrative Officer retuses to issue a permit for any reason, the applicants may apply to Council who may, by resolution, direct the issuance of such permit with or without conditions, or uphold the original refusal, subject to the provisions of this Bylaw.
809. No person shall throw from floats along the parade route, any materials, either before, or during the parade. Anyone doing so will be immediately withdrawn from the parade.
810. The leaders of an organization thereto shall be guilty of an offense for each and every violation of Section 8.
811. Funeral processions shall not be subject to the provision of this section provided that the procession is conducted in accordance with The Traffic Safety Act, R.S.A. 2000, c. T-6.
## 9. Parking
900. No person shall park a Vehicle for any period of time whatsoever at the following locations, namely:
901. In any bus stop properly marked by a sign;
902. Where the Vehicle will in any way interfere with the use of a doorway intended as a fire or emergency exit from any building abutting the Highway; Or
903. In the entrance to any fire hall or the ambulance entrance way to any hospital.
904. Notwithstanding any other provision in this Bylaw, the Chief Administrative Officer may cause moveable signs prohibiting stopping or parking to be placed on or near a Highway.
905. After such signs are placed on or near a Highway, no person shall park or leave a Vehicle on the signed portion of Highway until the signs are removed
906. Any Vehicle that is on such Highway when signs are placed thereon shall be removed promptly by its owner or operator.
907. When snow removal, Highway cleaning or Highway maintenance commences on the signed Highway, then the owner of any Vehicle parked after the placement of the appropriate signs shall be in contravention of Section 9.
908. No person shall park a Vehicle on any land, whether public or private property, without the consent of the owner, tenant or their agent. A person shall be presumed to have such consent to park a Vehicle in a parking lot that is accessible to the public, unless the person who owns or occupies the land gives notice to the contrary, whether verbally, in writing or by signs. Such consent shall not be presumed in any other case.
909. An owner, tenant, occupant or person in charge of land, whether public or private property, who is satisfied that any person is violating the prohibition set forth in this section may report to a Peace Officer the license number and location of the illegally parked Vehicle.
910. After the issuance of a Violation Tag concerning a Vehicle for a first violation of Section 9 hereof and a Vehicle remaining parked in excess of the time permitted on the sign for a further period, a second offence shall be deemed to have occurred.
911. No person shall park any trailer upon any Highway unless the said trailer is attached to a Vehicle by which it may be propelled or drawn and when so attached the trailer shall be deemed part of the Vehicle and subject to the regulations pertaining to Vehicles.
912. No person shall Live in a Recreation Vehicle that is parked on a Highway.
913. No person shall wash any Vehicle on any Highway in such a manner as to constitute a nuisance or hazard.
914. No person shall park any Vehicle on any Highway for the purpose of greasing or repairing such Vehicle, except for emergency repairs.
915. A Vehicle shall not be parked and left unattended on a Highway if:
916. The Vehicle is on a jack or similar device; or,
917. One or more wheels have been removed from the Vehicle or part of the Vehicle is raised.
918. Unless required or permitted by this Bylaw or The Traffic Safety Act, R.S.A. 2000, c. T-6, as amended, or by a Traffic Control Device, or in compliance with the direction of a Peace Officer, or to avoid conflict with other traffic, a driver shall not stop or park their Vehicle:
919. In any location designated as a Disabled Parking Space unless the Vehicle:
920. Displays a valid disabled placard or license plate issued or recognized by the Registrar; and,
921. Is being used for the transportation of a person with a disability.
922. On a Sidewalk or Boulevard;
923. On a crosswalk or on any part of a crosswalk;
924. Within an intersection other than immediately next to the curb in a "T" intersection;
925. At an intersection nearer than 5 meters to the projection of the corner property line immediately ahead or immediately to the rear except when their Vehicle is parked in a space where a parking meter or other Traffic Control Device indicates parking is permitted;
926. Within 5 meters upon the approach to any stop sign or yield sign;
927. Within 5 meters of any fire hydrant, or when the hydrant is not located at the curb, within 5 meters of the point on the curb nearest the hydrant;
928. Within 1.5 meters of an access to a garage, private road or driveway, or a Vehicle crossway over a Sidewalk;
929. Within 5 meters of the near side of a marked crosswalk;
930. Alongside or opposite any Highway excavation or obstruction when the stopping or parking would obstruct traffic;
931. At any other place where a Traffic Control Device prohibits stopping or parking, during such times as stopping or parking is so prohibited; or,
932. On the roadway side of a Vehicle parked or stopped at the curb or edge of the roadway.
933. When parking on a roadway, a driver shall park their Vehicle with the sides of it parallel to the curb edge of the roadway, and:
934. With the right hand wheels thereof not more than 500 millimeters from the right hand curb or edges of the roadway; or,
935. In the case of a one-way Highway where parking on either side is permitted, with the wheels closest to a curb or edge of the roadway not more than 500 millimeters from the curb or edge and with the Vehicle facing the direction of travel authorized for that Highway.
936. When a sign indicating that angle parking is permitted or required a driver shall park their Vehicle:
937. With its sides at an angle of between 30 and 60 degrees to the curb or edge of the roadway; and,
938. With one front wheel not more than 500 millimeters from the curb or edge of roadway.
939. When parking guide lines are visible, a person shall park a Vehicle with the Vehicle's sides between and parallel to any of the two guidelines.
940. No person shall park a Vehicle, Heavy Vehicle or Recreation Vehicle on any Highway within the City of Brooks for any period in excess of seventytwo (72) hours.
941. No person shall park a Vehicle on any portion of a Highway marked by signs or Traffic Control Devices as a residential parking zone unless a permit authorizing parking within that residential parking zone is attached to or displayed through the front window hanging from the rear view mirror of the Vehicle.
942. Up to three (3) permits may be issued to the residents of each residential dwelling unit located within a residential parking zone.
943. No permit shall be issued to any person who does not reside within a residential parking zone and when a person ceases to reside within a residential parking zone he/she shall remove the permit from their Vehicle and return it to City Hall.
944. Upon evidence being produced to the City of Brooks that a person to whom a permit has been issued is no longer a resident within the residential parking zone, a replacement permit may be issued to a new resident. Any misuse of a permit is subject to a penalty.
945. Notwithstanding Subsection 911, an unattached trailer may be parked on a City Highway, subject to the following conditions:
946. A valid parking permit has been approved and/or issued by the Chief Administrative Officer;
947. The applicant holds a valid City business licence;
948. The applicant has obtained a valid building and/or development permit; if applicable;
949. The trailer is parked wholly in front of the property where the work is being completed;
950. The trailer is parked in the same location for no longer than fourteen (14) days;
951. The trailer does not obstruct traffic flow and/or visibility; and,
952. Each application will be assessed on a case by case basis.
953. No person shall operate or park a Vehicle or trailer on a Highway unless the subsisting licence plate issued for that Vehicle is displayed on that Vehicle.
954. No person shall park a Vehicle unless it is on an approved surface such as concrete, asphalt or gravel.
## 10. Pedestrians
1000. Pedestrians shall cross Highways only in crosswalks where such are designated and when crosswalks are not marked pedestrians shall cross Highways at intersections.
1001. No person shall stand upon or walk along a roadway for the purpose of soliciting a ride from the driver of any Vehicle.
1002. No person shall obstruct vehicular or pedestrian traffic so as to impede any other person lawfully upon a Sidewalk or Highway.
1003. Three or more persons shall not stand in a group or so near to each other on any Highway as to obscure the entrance of buildings or to obstruct or prevent other persons using such Highway; and forthwith after request has been made by any Peace Officer or other person duly authorized so to do, shall disperse and move away.
1004. Nothing in the above Subsection 1003 shall be construed as prohibiting the assembling of persons for the purpose of watching a parade or procession duly authorized by the Chief Administrative Officer.
## 11. Bicycles
1100. No person shall drive a bicycle on any Sidewalk or Boulevard except where expressly permitted to do so by this Bylaw. Children with bicycles having a wheel diameter of less than 508 mm (20 inches) are exempted from this provision.
1101. In addition to any penalty provided in this Bylaw, a Peace Officer may impound any bicycle used or operated in contravention of this Bylaw for a period not to exceed seven (7) days for the first offence, fourteen (14) days for the second offence and thirty (30) days for the third and subsequent offences.
## 12. Penalties and Enforcement
1200. A Peace Officer is for the purposes of enforcement of this Bylaw, a designated officer of the City.
1201. Any person who contravenes any provision of the Bylaw is guilty of an offence and is liable upon summary conviction, to a maximum penalty of $10,000 and a minimum penalty equal to the specified penalty for that offence.
1202. A Peace Officer is hereby authorized and empowered to issue Violation Tags to any person who the Peace Officer has reasonable and probable grounds to believe has contravened any provision of this Bylaw.
1203. A Violation Tag may be issued to such Person:
1204. Either personally;
1205. By leaving it in a conspicuous location on the Vehicle; or,
1206. By mailing a copy to such Person at their last-known post office address.
1207. A Violation Tag issued pursuant to this Bylaw shall be in a form approved by the Chief Administrative Officer and shall state:
1208. The name of the person or other information to adequately identify the person;
1209. The offence;
1210. The appropriate penalty for the offence and specified in "Schedule B" of this Bylaw;
1211. The time period in which the specified penalty must be paid in order to avoid prosecution for the alleged offence; and,
1212. Any other information as may be required by the Chief Administrative Officer.
1213. Where a Violation Tag has been issued pursuant to this Bylaw, the person to whom the Violation Tag has been issued may, in lieu of being prosecuted for the offence, pay to the City, the penalty specified on the Violation Tag.
1214. In those cases where a Violation Tag has been issued and the penalty specified on the Violation Tag has not been paid within the prescribed time, a Peace Officer is hereby authorized and empowered to issue a Violation Ticket.
1215. A Peace Officer is authorized and empowered to immediately issue a Violation Ticket to any person who the Peace Officer has reasonable and probable grounds to believe is responsible for a contravention of this Bylaw.
1216. A Violation Ticket issued with respect to a contravention of this Bylaw shall be served upon the person responsible for the contravention in accordance with the Provincial Offences Procedure Act.
1217. The person to whom the Violation Ticket may, in the case of a Violation Ticket issued pursuant to the Provincial Offences Procedure Act, plead guilty by making a voluntary payment in respect to the summons by delivering to the Provincial Court, on or before the initial appearance date, the Violation Ticket together with an amount equal to the specified penalty for the offence as provided for in Schedule "B" to this Bylaw.
1218. When a clerk of the Provincial Court records the receipt of a voluntary payment pursuant to Subsection 1217 and the Provincial Offences Procedure Act, the act of recording constitutes acceptance of the guilty plea and also constitutes the conviction and imposition of a fine in the amount of the specified penalty.
1219. A Peace Officer is hereby authorized to remove or cause to be removed any Vehicle:
1220. that is parked in contravention of this Bylaw; or,
1221. that is not registered under The Traffic Safety Act, R.S.A. 2000, c. T-6.
1222. Any Vehicle removed pursuant to Subsection 1219 shall be removed to a place designated by the Chief Administrative Officer where it shall remain until claimed by its owner or agent or until disposed of under the provisions of The Traffic Safety Act, R.S.A. 2000, c. T-6.
## 13. APPEAL PROCESS
1300. A person affected by an order or decision of the City's Chief Administrative Officer or a Peace Officer under the authority of this Bylaw may appeal to Council by filing a written appeal within fourteen (14) days of the date of the order or decision that was issued. The written appeal shall include a description of the circumstances giving rise to the appeal; the reasons for the appeal; all supporting documentation and the remedy requested by the appellant. Council's decision with regard to the appeal shall be final and binding
## 14. SEVERABILITY:
1400. Should any provision of this Bylaw be found invalid, the invalid provision shall be severed and the remaining Bylaw shall be maintained.
## 15. REPEAL OF BYLAW
1500. That the following Bylaws and all amendments be hereby repealed 14/01, 15/22, 16/15 and 21/03.
## 16. EFFECTIVE DATE:
1600. This Bylaw shall take effect at the date of final passing thereof.
