## SUMMER VILLAGE OF BURNSTICK LAKE BYLAW 20-95
## BEING A BYLAW OF THE SUMMER VILLAGE OF BURNSTICK LAKE IN THE PROVINCE OF ALBERTA TO ESTABLISH A SUBDIVISION AUTHORITY
WHEREAS Section 623 of the Municipal Government Act being Chapter 26.1 RSA 1995 and amendments thereto requires each Municipality to provide for a Subdivision Approving Authority;
AND WHEREAS Section 623 of the Municipal Government Act, RSA 1995 allows each Municipality to delegate the authority to exercise subdivision powers and duties;
NOW THEREFORE the Council of the Summer Village of Burnstick Lake in the Province of Alberta duly assembled, hereby enacts as follows:
THAT the administration of the subdivision approval process be delegated to the Subdivision Officer as appointed by resolution of Council, except that the decision to grant approval (with or without conditions) or refuse subdivision approval, be retained by the Subdivision Approving Authority of the SUMMER VILLAGE OF BURNSTICK LAKE;
THAT the Subdivision Approving Authority be delegated to TWO (2) MEMBERS OF COUNCIL OF THE SUMMER VILLAGE OF BURNSTICK LAKE as appointed by Council during their annual organizational meeting;;
THAT the Subdivision Officer be entitled to receive subdivision applications and endorsement fees, paid by the applicant for subdivision approval, at the rates established by resolution of Council;
THAT the Subdivision Officer be authorized to endorse plans of subdivision, separation documents, descriptive plans, transfers of land and any other documents required to register an approved subdivision at the Land Titles office, on behalf of the Summer Village of Burnstick Lake. and the Registrar of Land Titles be authorized to accept the Agent's endorsement as if it were that of the Summer Village of Burnstick Lake.
THAT the adoption of this Bylaw is effective upon the date of the passing of third and final reading of this Bylaw.
READ a first, second and third time this 14th day of November, AD 1995.
