## THE SUMMER VILLAGE OF BURNSTICK LAKE BYLAW NUMBER 67-16
A BYLAW of the Summer Village of Burnstick Lake in the Province of Alberta to amend the Burnstick Lake Traffic Bylaw known as Bylaw 11-1994.
WHEREAS it is deemed necessary and expedient to amend the present Burnstick Lake Traffic Bylaw 11-1994, and,
WHEREAS the Municipal Government Act, R.S.A. 2000, M-26 and amendments thereto allows a municipality to pass bylaws and delegate authority with respect to streets, green spaces or Summer Village owned land under its direction, control and management and transportation thereon; and
WHEREAS under the authority of the Traffic Safety Act, R.S.A. 2000, T-6 and amendments thereto, the Council of a municipality may pass bylaws to regulate, manage and control vehicle traffic; and
NOW THEREFORE the Council of the Summer Village of Burnstick Lake duly assembled enacts as follows:
## Section 1: Definitions
- 1.1 Definitions in the Traffic Safety Act and the Provincial Offences Procedures Act are hereby incorporated as part of this Bylaw.
- 1.2 In this Bylaw:
- 1.2.1 "Act" means the Traffic Safety Act, R.S.A. 2000, Chapter T-6 and amendments thereto.
- 1.2.2 "Commercial Vehicle" means a vehicle operated on a highway by or on behalf of a person for the purpose of providing transportation but does not include a private passenger vehicle.
- 1.2.3 "Peace Officer" means:
- a) a member of the Royal Canadian Mounted Police;
- b) a Bylaw Officer as appointed by the Summer Village of Burnstick Lake, or
- c) a Community Peace Officer as appointed by the Solicitor General of Alberta.
- 1.2.4 "Recreation Vehicle" means a vehicle primarily designed as temporary living quarters for recreational camping or traveling, which either has its own motor power or is mounted to or drawn by another vehicle.

- 1.2.5 "Traffic Ticket" means any summons, ticket, or notice to appear that shall be written or issued because of a violation of this Bylaw.
## Section 2: Parking
- 2.1 No person shall keep or maintain in their yards any unlicensed, dismantled, wrecked or dilapidated vehicle for more than 14 consecutive days.
- 2.2 No person shall keep or maintain in their yards any oversize vehicles that obstruct the view of other property owners.
- 2.3 No person shall keep or maintain in their yards or park on any highway within the Summer village any commercial vehicle loaded or unloaded with a gross vehicle weight rating in excess of 4000 kg. (8818.50 Ibs).
- 2.4 No more than one recreational vehicle shall be permitted on a regular basis on a lot.
- 2.5 No recreational vehicle shall be kept and occupied on a lot for more than 14 consecutive days.
- 2.6 The parking of private recreation vehicles, which includes all terrain vehicles, or the riding or driving of all terrain vehicles and motor vehicles, other than those areas so designated for such purpose, on Municipal or Environmental Reserve lots or Public Utility lots is prohibited.
## Section 3: Penalties and Authority of Peace Officers
- 3.1 Any person who contravenes any of the provisions or requirements of this Bylaw is guilty of an offense and is liable for and subject to the penalties herein provided.
- 3.2 Any Peace Officer or R.C.M.P. Officer is hereby authorized by the Summer Village of Burnstick Lake to enforce the provisions of this Bylaw and Burnstick Lake Traffic Bylaw 111994 and to issue traffic tickets to any person to whom they reasonably believe has contravened the provisions of this Bylaw and Burnstick Lake Traffic Bylaw 11-1994.
- 3.3 Any Peace Officer or R.C.M.P. Officer is duly authorized to impound and remove from the highway or public parking place, a vehicle in violation of provisions of this Bylaw and Burnstick Lake Traffic Bylaw 11-1994 and all costs incurred being the responsibility of the vehicle owner.
- 3.4 Service of a traffic ticket shall be in such form as provided for in the regulations pursuant to the Provincial Offenses Procedure Act and service of any such traffic ticket shall be sufficient if it is:
- a) personally served;

- b) attached to the vehicle in respect of which an offense is alleged to have been committed;
- c) mailed to the address of the registered owner of the vehicle which the offense occurred;
- d) mailed to the address of the registered owner of the property or to the person in possession of the property.
4. 3.5 If the person upon whom any such traffic ticket is served fails to pay the said sum within the allotted time, the person may be prosecuted pursuant to the provisions of the Provincial Offenses Procedure Act.
5. 3.6 Any person who contravenes any provisions of this Bylaw or Burnstick Lake Traffic Bylaw 111994 for which no penalty has herein been specified, shall be liable by the Provincial Offenses Procedures Act of a fine not exceeding $500.00 exclusive of costs, and in case of non-payment of the penalty and costs imposed by the Court, and subject to Section 160(1) & (2) of the Traffic Safety Act.
## Section 4: Schedule "A"
- 4.1 Schedule "A" attached hereto shall form part of this Bylaw.
- 4.2 Schedule "A" attached hereto may be reviewed and amended separately from this bylaw by resolution of Council.
This bylaw shall come into effect on the final passing thereof.
