BY-LAW NO. 1416
BY-LAW NO.1416
A By-law of Camrose County in the Province of Alberta, introduced for
the Controlling and Regulating the use of highways within the Camrose
County.
1. Subject to the Traffic Safety Act R.S.A. 2000 Chapter T-6 and the
Dangerous Goods Transportation and Handling Act and
amendments thereto, a council of a municipality may for the
physical preservation of a highway under its direction, control and
management, including any bridge that forms part of that highway,
make By-laws restricting the weight of a commercial vehicle or a
commercial vehicle and any goods being carried by the vehicle, to
weight that is less than the weight that may be borne under the
Traffic Safety Act.
NOW THEREFORE
Council of the Camrose County in the Province of Alberta duly
assembled hereby enacts as follows:
This By-law may be cited as "Weight Restriction By-law".
2.
Where there is a conflict between a By-law made under
subsection (1) and a provision of the Traffic Safety Act or a
permit, the Traffic Safety Act or the permit, as the case may be,
prevails.
3.
Council is authorized to
(a)
prohibit the use of a highway by a traction engine or
commercial vehicle, for a period or periods that Council
determines.
(b)
Increase, limit or restrict the maximum gross weight that
may be borne by a tire or axle or an axle group, or any of
them, or combination of vehicles on a highway, for a period
or periods that the Council determines when the Council is
of the opinion that the prohibition, limitations or restriction
is necessary for the preservation of the highway.
4.
No person may operate a vehicle on a highway if the gross weight
borne on an axle, axle group or all axles is in excess of the
maximum allowable weights established by a Vehicle Weight
Committee Order unless authorized by the County.
5.
County Council may delegate its authority to issue Special
Permits to the County Administrator or his delegate(s).
By-law 1045 is hereby rescinded.
