BY-LAW NO. 1019
BY-LAW NO. 1019 A by-law of the County of Camrose No. 22 in the Province of
Alberta for the purpose of establishing permissible noise levels for certain parts of the
County and during certain periods of the day.
WHEREAS
Pursuant to Section 7 of the Municipal Government Act, R.S.A. 1994 C.
M-26.1, and amendments thereto, Council may pass a by-law for the purpose of
prohibiting, eliminating or abating noise and establishing permissible noise levels for all
or various periods of the day, in all or a designated part of location of the municipality,
and
WHEREAS
Council deems it expedient to pass a by-law to establish permissible noise
levels to be in effect adjacent to County Parks during the evening, and prohibiting noise
above such level.
NOWTHEREFORE Council of the County of Camrose No. 22 in the Province of
Alberta, duly assembled, hereby enacts as follows:
1.
SHORT TITLE
1.1
This by-law may be cited as the "Noise By-law".
2.
DEFINITIONS
2.1
"Designated Area" means those parts of the County of Camrose No. 22 which is
adjacent to either the Tillicum Beach Park or Pelican Point Part and which are
shown outlined in red on the maps attached to this by-law as Schedules "A" and
"B";
2.2
"County Park" means Tillicum Beach Park or Pelican Point Park, being those
areas of the County of Camrose No. 22 which are shown outlined in yellow on the
maps attached to this by-law on Schedules "A" and "B" respectively;
2.3
"Peace Officer" means a member of the Royal Canadian Mounted Police or a
Special Constable of the County of Camrose No. 22;
2.4
"Noise" includes any sound, howsoever produced, and includes the sound of
human voices, sounds emitted by any machinery or equipment or radio or
television or record or tape player or musical instrument or any other apparatus
which produces sound;
2.5
"Occupant" means any person who is found on any property, whether or not he is
the owner or tenant of the property and whether or not he resides on the property.
3.
PROHIBITED NOISE
3.1
No person shall, between the hours of 11:00 p.m. of one day and 7:00 a.m. of the
next day, while being in a Designated Area, make or cause to be made or permit
to make any noise of such a volume that such noise can be easily heard by a
person who is within the boundaries of the nearest County Park.
3.2
A person who contravenes the provisions of Section 3.1 of this by-law is guilty of
an offence and is liable in the case of a first offence to a fine of not less than
$50.00 and not more than $200.00 and in default of payment to imprisonment for
a term not exceeding 30 days, and in the case of a second or subsequent offence to
a fine of not less than $100.00 and not more than $2,500.00 and in default of
payment to imprisonment for a term not exceeding 6 months.
4.
STOP ORDER
4.1
A Peace Officer may, in addition to or in lieu of issuing any warning or laying
any complaint or ticket or information with respect to an alleged breach of the
provisions of Section 3.1 of this by-law, order any occupant of property from
which the noise originated to forthwith cease making or causing or permitting to
be made such noise, and to prevent the continuation or resumption of such noise.
4.2
A person who disobeys an order made under Section 4.1 of this by-law is guilty of
an offence and is liable in the case of a first offence to a fine of not less than
$100.00 and not more than $500.00 and in default of payment to imprisonment
for a term not exceeding 30 days, and in the case of a second or subsequent
offence to a fine of not less than $200.00 and not more than $2,500.00 and in
default of payment to imprisonment for a term not exceeding 6 months.
By-law No. 736 is hereby rescinded.
