1 BY-LAW 1232 BY-LAW 1232 Being a By-law of Camrose County in the Province of Alberta regulating and providing for the use of water from the Camrose County Bulk Water Truck Fills and Reservoirs WHEREAS Pursuant to the provisions of the Municipal Government Act, being Chapter M-26, R.S.A., 2000, Sections 7 - 8 and amendments made thereto, the Council of Camrose County may pass By-Laws for municipal purposes respecting the regulating or prohibiting of services provided by or on behalf of the municipality, and subsequent enforcement, offenses and fines or penalties. AND WHEREAS Council deems it expedient to pass a By-Law to regulate and control the use of water at the Camrose County Bulk Water Truck Fills and Reservoirs. AND WHEREAS Camrose County and the City of Camrose agree that water from the Ohaton Regional Water System - Reservoir will be for "Domestic Use" only. NOW THEREFORE The Municipal Council of Camrose County duly assembled enacts as follows: Bylaw 1232 - Water Use - Truck Fills and Reservoirs Definitions "Domestic Use" means water used normally for residential purposes, including household use, personal hygiene, drinking, washing clothes and dishes, flushing toilets, watering of domestic animals, and outside uses such as car washing, swimming pools, and for lawns, gardens, trees and shrubs. "Agricultural Use" means water from the Camrose County truck fills used for the purpose of cultivating land, raising crops, and feeding, breeding, raising livestock, cultivating fruits, vegetables, flowers, or ornamental plants, hydroponics - cultivating plants in water, aquafarming - farming of aquatic organisms such as fish, crustaceans, and aquatic plants, and orchards Water Use 1. Ohaton Regional Water System - Reservoir - Domestic Use Only 2. Camrose County Truck Fills - Agricultural Use Only 3. To provide Camrose County Agriculture Services and Public Works with water to assist in completion of County projects and services. 4. To supply Fire Departments and residents within Camrose County with water for firefighting and training purposes. 5. Special consideration given to allow other users access to water for discretionary purposes as approved by the Agricultural Fieldman. Violation Tickets Where a By-Law Officer has reasonable and probable grounds to believe that an offense has been committed, the By-Law Enforcement Officer is authorized and empowered to immediately issue a Camrose County Violation Ticket to any person to whom the By-Law Enforcement Officer has reasonable and probable grounds to believe has contravened any provision of this By-Law. Where a Violation Ticket has been issued to a person and/or company pursuant to this By-Law, the person may plead guilty to the offense by submitting to Camrose County the specified penalty set out on the Violation Ticket within 30 days from the date on the violation ticket. 2 Fine for Violation It is an offense under this bylaw to use the water at any municipal reservoir or truck fill, except for purposes listed herein and posted by Camrose County at the location. Every person who violates any provision of this By-Law is guilty of an offence and shall be liable on summary conviction to a fine as follows: 1st Offense - $1000.00 2nd Offense - $2500.00 3rd or more Offenses - $5000.00 per offense Appeal Where a Violation Ticket has been issued to a person pursuant to this By-Law, the person and/or company may appeal the offense by submitting to Camrose County in writing the reasons for the appeal.
