BYLAW 3268- 23 OF THE CITY OF CAMROSE PROVINCE OF ALBERTA A BYLAW OF THE CITY OF CAMROSE IN THE PROVINCE OF ALBERTA TO PROVIDE FOR THE CARE OF ANIMALS WITHINTHE SAID CITY. WHEREAS the Municipal GovernmentAct, being Chapter M--26of the Revised Statutes of Alberta 2000 and amendments thereto, provides that a Council may pass Bylaws for municipal purposes respecting the safety, health and welfare of people and the protection of people and property, wild and domestic animals and activities in relation to them, and the regulation, prohibition and licensing thereof; WHEREAS the Council of the City of Camrose deems it advisable to pass a Bylaw that includes powers of a Peace Officer when it comes to Animal Care. NOW THEREFORE the Municipal Council of the City of Camrose duly assembled enacts as follows: TITLE 1. This Bylaw may be cited as "The Animal Care Bylaw". PURPOSE 2. The purpose of this Bylaw is to establish a level of care for Animals. DEFINITIONS 3. In this Bylaw unless the context otherwise requires: (1) "Abandon" means for an Owner to release their Dog in the City or refuse to claim their Dog from the Pound. (2) "Altered" means an Animal that has been spayed or neutered. (3) "Animal" means a Cat or Dog. Bylaw 3268-23 (5) (7) (8) (9) (10) (11) (12) (13) PART I "City"means the City of Camrose. "City Manager" means a person appointed by Council as the Manager of the City of Camrose or their delegate. "Council" means the Council of the City of Camrose. "Dog" means any domesticated animal of the Canine family, female or male of the species, intact or Altered. "Enforcement Officer" means a member of the Camrose Police Service, Community Peace Officer, or any other person appointed by Council or the City Manager to enforce the provisions of this Bylaw. "lnjury"means any physical injury to another animal or person, caused by a Dog that results in bleeding, bruising, tearing of skin, or any other injury that is not life threatening, disfiguring or debilitating. "Owner" unless the context othen/vise requires, means any person, partnership, association or corporation who has legal title or possession of a Dog or who harbours, keeps or has the care or control of a Dog, and includes temporary care or control. "Violation Ticket" means a summons Violation Ticket, Part 2, of the Provincial Offences Procedure Act, R.S.A 2000, c. P-34. DOMESTIC ANIMALCARE 1. No Owner or person shall Abandon their Dog within the City or Pound. The Owner of an Abandoned Dog shall be responsible for all costs/fees as outlined in the City of Camrose Annual Fees and Charges Bylaw and in Schedule A. 2. No person shall in any way permit an Animal to be in distress by: (8) (b) causing any unnecessary physical pain to the Animal, or neglecting to provide food, potable water, care or shelter as is necessary to Bylaw 3268-23 3. If an Animal is in distress, an Enforcement Officer may take any action they consider necessary to locate the Animal and relieve its distress, including taking the Animal into custody, pursuant to the Animal Protection Act.in the case where: (a) the Owner does not forthwith take steps that willrelieve its distress, or (b) the Owner cannot be found immediately and informed of the Animal's distress, In alignment with Section 4 of the Animal Protection Act, RSA 2000, Chapter A--41 and amendments thereto, and subject to available resources, a Peace Officer may take any action the Peace Officer considers necessary to locate an Animal and relieve its distress, including taking custody of the Animal in accordance with the regulations and arranging for transportation, food, water, care, shelter and veterinary treatment for the Animal if necessary. PART II OFFENSES AND PENALTIES 5. Where an Enforcement Officer has reasonable grounds to believe that a person has contravened any provision of this Bylaw, they may serve upon such person an offence ticket allowing payment of the specified penalty as set out in Schedule "A" to this Bylaw, which shall be accepted by the City in lieu of prosecution for the offence or, may issue a Violation Ticket requiring a person to appear in court without the alternative of making a voluntary payment or may lay an information in respect of the offence. When a penalty is not specified under this Bylaw, a person who is guilty of an offence is liable to a fine not exceeding ten thousand ($10,000) dollars or imprisonment for not more than six (6) months for non--paymentof the fine. The levying and payment of any penalties shall not relieve a person from the necessity of paying any fees, charges or costs from which they are liable under the provisions of this Bylaw. Schedule "A""attached hereto forms part of this Bylaw. This Bylaw shall come into force and effect on the date of final passing thereof.
