i i ii E: management. 1.1 2.1 2.2 2.3 2.4 2.5 2.6 2.7 BYLAW 3276-23 CITY OF CAMROSE PROVINCE OF ALBERTA A BYLAW OF THE CITY OF CAMROSE, PROVINCE OF ALBERTA, TO REGULATE AND CONTROL TRAFFIC WITHINTHE CITY OF CAMROSE WHEREAS The Traffic Safety Act, being Chapter T6 of the Revised Statutes of Alberta, 2000, as amended, authorizes a Municipal Council of a municipality to make bylaws to govern the use and operation of vehicles, pedestrians and highways which are under its direction, control and NOW THEREFORE, the Council of the City of Camrose, inthe Province ofAlberta duly assembled, hereby enacts as follows: PART I - TITLE,DEFINITIONS AND INTERPRETATION 1. SHORT TITLE This Bylaw may be called the "Camrose Traffic Bylaw." 2. DEFINITIONS In this Bylaw, all definitions and interpretations of the Traffic Safety Act shall apply and the following definitions shall apply: "Alley" means a narrow Highway intended chiefly to give access to the rear of buildings and parcels of land. "Bicycle" means a vehicle composed of two wheels held in a frame one behind the other, propelled by pedals and steered with handlebars attached to the front wheel including E-Bicycles. "Bylaw Enforcement Officer" means a Bylaw Enforcement Officer appointed by the City of Camrose. "Chief of Police" means a municipal official appointed by Council as the Chief of Police of the Camrose Police Service, or anyone appointed to act in their stead. "City" means the Corporation of the City of Camrose, or the corporate limits of the City of Camrose, as the context requires. "City Manager" means a municipal official appointed by Council as the City Manager, or anyone appointed to act in their stead. "Commercial Vehicle" means a Vehicle owned by a registered company or person and being used in person to conduct business. EE Zr EEi Bylaw 3276--23 2.11 2.12 2.13 2.14 2.15 2.10.1 Has an integrated motor for propulsion; 2.10.2 Must not be more powerful than 500 watts; 2.10.3 Has fully operational pedals; 2.10.4 May not be primarily electronically propelled; and 2.10.5 Has a maximum speed of 32 km/h; "Emergency Vehicle" means fire--fightingvehicles, public utility vehicles while actually being used in an emergency, police vehicles, ambulances, or a Vehicle being used by a medical doctor responding to an emergency call. "E--Scooter" means a vehicle that: 2.12.1 Has steering handlebars and a hand break; 2.12.2 is designed to travel on not more than three wheels in contact with the ground; 2.12.3 is equipped with a standing surface and is to be operated by a single occupant from a standing position; 2.12.4 Is not equipped with a seating surface, and is not designed to be operated from a seated position; 2.12.5 is capable of being propelled by muscular power; 2.12.6 Has one or more electric motors that have, singly or in combination, the following characteristics: 2.12.6.1 The total continuous power rating, measured at the shaft of each motor, of 500W or less; 2.12.6.2 Power assistance immediately ceases when the brakes are app?ed; 2.12.6.3 Has a headlamp and red tail lamp; and 2.12.6.4 Has at least one red reflector mounted on the rear. "General Manager of infrastructure" means a municipal official appointed by the City Manager as the General Manager of Infrastructure, or anyone appointed to act in their stead. "Heavy Vehicle" means a Vehicle, or a Vehicle with a Trailer attached, having a maximum gross vehicle weight of 4500 kg or more, or exceeding 10.7m in total length, Recreation Vehicles excepted. "Highway" means any thoroughfare, street, road, trail, avenue, parkway, driveway, viaduct, lane, Alley, square, bridge, causeway, trestle way or other place or any part E r Bylaw 3276-23 2.16 2.17 2.18 2.19 2.20 2.21 2.22 2.23 2.24 2.25 2.15.3 if a Highway right of way is contained between fences or between a fence and one side of the Roadway, all the land between the fences, or all the land between the fence and the edge ofthe Roadway, as the case may be, but does not include a place declared by regulation not to be a Highway. "Holiday" means any day officially proclaimed a Holiday by any Federal. Provincial, or Municipal authority, and which is in effect in the City of Camrose. "Industrial Zone" means the area ofthe City east ofthe CN tracks and including 39 Street to the north city limitand 54 Avenue from 39 Street to 46 Street, as shown in Schedule "2--C". "Micro-mobility Device" means any mode of sing|e~user transportation that has wheels including roller blades, skateboards of any type, nonmotorized scooters, and Shared E--Scooters, and other similar devices, but not including Bicycles nor privately owned E--Scooters, "Peace Officer" means a member of the Royal Canadian Mounted Police, a member of the Camrose Police Service, or special constable. "Pedestrian" means a person afoot or a person in a wheelchair and has the right of way on any Sidewalk. "Permit" means permission in written or electronic format, granted by the General Manager of Infrastructure as authorized in this Bylaw, to carry on the activity specified therein. "Public Vehicle" means a Vehicle operated on a Roadway by or on behalf of a person for the transportation of: 2.22.1 Passengers, 2.22.2 Goods, or 2.22.3 the Vehicle itself, but does not include a private passenger Vehicle. "Recreation Vehic|e" ("RV") means a Vehicle used or intended for primarily recreational use, and without restricting the generality of the foregoing, includes any motor home, holiday trailer, Trailer, camper, tent trailer, any van or bus converted for use as a Recreation Vehicle, boat trailer, ATVtrailer, ski-do trailer or non--commercial utilitytrailer. "Registrar" means the Registrar of Motor Vehicle Services for the Province of Alberta and includes any person who, on the directions of the Registrar, is acting on behalf of the Registrar of Motor Vehicle Services. "Roadway" means that part of a Highway intended for use by vehicular traffic. El E Bylaw 3276~23 2.27 2.28 2.29 2.30 2.31 "Scooter" means a foot propelled footboard with two wheels and a long steering handle but does not include Scooters forthe physically challenged nor E--scooters. "Shared E-Scooter" means an E--Scooter, which is owned by a business whose primary function is the operation of E--Scooters within the City of Camrose, as established in the Business License Bylaw. "Traffic Control Device" shall mean any sign, signal, marking or device placed, marked or erected for the purpose of regulating, warning or guiding traffic and Pedestrians. "Trailer" means a Vehicle so designed that it may be attached to or drawn by a motor vehicle and intended to transport property or persons. "Vehicle" means a device in, on or by which a person orthing may be transported or drawn on a Highway and includes a combination of Vehicles but does not include a wheelchair or similar device. 3. Rules for Operation of Vehicles (Refer to Schedule "3" for Specified Penalties) 3.1 3.2 3.3 3.4 3.5 3.6 Funeral Procession Any Vehicle in a funeral procession, except the lead Vehicle, may during daylight hours, enter an intersection without stopping as long as itis done in accordance with the Use of Highway and Rules of the Road Regulation of the Traffic Safety Act. Speed Limits The speed limits for all Roadways in the City are specified in Schedule "1" of this Bylaw. Passing on a Bridge No driver of a Vehicle shall overtake and pass any other moving Vehicle, proceeding in the same direction, on any bridge having not more than two lanes for traffic. Maximum Weight on Bridge No person shall operate upon a bridge with or without a load, a Vehicle weighing more than the permitted maximum weight as specified by the General Manager of infrastructure. Weight Certificate In case of any dispute arising as to the weight of any Vehicle, the same shall be weighed upon a certified scale, and the certificate of the person weighing the Vehicle shall be deemed conclusive. Securing Loads Bylaw 3276--23 3.7 3.8 3.9 Metal Spikes, Lugs, or Cleats and Studded Tires Unless a Permit to do so has been issued by the General Manager of Infrastructure, no personshall operate on any Roadway: 3.7.1 A Vehicle or Trailer having metal spikes, lugs, or cleats or bands projecting from the surface of the wheel or tire of such Vehicle; or 3.7.2 Any Vehicle or Trailer having skids or tracks. 3.7.3 The provisions of this section shall not apply to Vehicles equipped with studded tires that are designed to increase traction on ice or packed snow. 3.7.4 The provisions of this section shall not apply to construction equipment involved in the construction of municipal services or Roadways on the said Highway and under the direction of the City's Engineering Services department. Heavy Vehicle Off Truck Route No person shall, without a Permit, operate a Heavy Vehicle on any Roadway in the City, except on a Roadway designated as a truck route as specified in Schedule "2~ A" of this Bylaw. 3.8.1 The General Manager of Infrastructure may issue Permits to the operators of Vehicles referred to in Section 3.8 herein for the purpose of allowing Heavy Vehicles on Roadways other than those designated as truck routes within the City of Camrose, in accordance with Section 4 of this Bylaw. Heavy Vehicle Exemptions Notwithstanding the provisions of Section 3.8 herein, the following Heavy Vehicles are hereby authorized to be operated on Roadways other than truck routes: 3.9.1 Tow trucks, while actually being operated for the purpose of servicing disabled Vehicles. 3.9.2 Public passenger Vehicles being operated for the purpose of receiving or delivering passengers provided that the most direct route to or from the nearest truck route is used. 3.9.3 Public utilityVehicles being operated for the purpose of installing, servicing, or repairing public utilities. 3.9.4 City owned or other Vehicles being operated in the service of the City. 3.9.5 Commercial Vehicles delivering or collecting goods, provided that the most direct route to or from the nearest truck route is used, and if such iEi iil Ei i EE Bylaw 3276-23 No person shall, without a Permit, load or unload a Vehicle, designed forthe purpose of carrying other motor Vehicles for delivery to commercial businesses on any Highway other than an Alley or service road within the City of Camrose. 3.10.1 The General Manager of infrastructure may issue Permits to the operators of Vehicles referred to in Section 3.10 herein for the purpose of loading or unloading other Vehicles on a Roadway within the City of Camrose in accordance with Section 5 of this Bylaw. 3.11 Engine Retarder Brakes No person shall operate engine retarder brakes within the City limits. 3.12 Operation of School Buses The operator of a school bus shall not activate the alternately flashing red lamps and stop arms on the school bus while loading or unloading passengers on any Highway where such Highway has been constructed with Curbs and gutters. 3.13 Riding on Roadway No person shall ride any Micro--mobilityor any other similar device on any Roadway. 4. PARKING 4.1 Unauthorized Stopping or Parking Unless required or permitted by this Bylaw or the Traffic Safety Act, or by a Traffic Control Device, or in compliance with the directions of a Peace Officer, or other authorized person, orto avoid conflict with othertraffic, or with a Permit as approved by the General Manager of infrastructure, a driver shall not stop or park a Vehicle at the following locations: 4.1.1 Ambulance and Fire Driveways: in any driveway designated for use by ambulances or fire fighting vehicles, Emergency Vehicles excepted as authorized by the Fire Chief, or 4.1.2 Restricted Parking: where parking is restricted to designated Vehicles as indicated on a sign or painted Curb placed at that location by authority of the City Manager, or 4.1.3 Emergency Exits: where such Vehicle willobstruct, or in any way interfere with, the use of any doonNay intended to be used as a fire or emergency exit from any building, provided that such doorway is marked by a sign, authorized by the Fire Chief, indicating an Emergency Exit or Fire Exit, or 4.1.4 Passenger Loading: in an area marked by signs, authorized by the City Manager, designating a passenger loading zone, except while actually engaged in taking on or discharging passengers, or E V E E tE E 5E 1 Bylaw 3276-23 4.2 4.3 4.4 4.5 4.6 4.7 4.8 Disabled Persons Parking No person shall park a Vehicle in an area designated as a parking place for the use of persons with disabilities, unless: 4.2.1 The Vehicle displays a handicap placard or license plate that is issued or recognized by the Registrar, and 4.2.2 The Vehicle is operated by, or is being used to transport, a disabled person. Disabled Persons Loading Zone No person shall stop a Vehicle in an area designated as a loading zone for the use of persons with disabilities, unless: 4.3.1 The Vehicle displays a handicap placard or license plate that is issued or recognized by the Registrar, and 4.3.2 The Vehicle is operated by, or is being used to transport, a disabled person. Stop for Passengers No driver, except while actually taking on or discharging passengers, shall park a Vehicle on any portion of a Roadway marked by a Traffic Control Device as "No Parking". Park in AlleylObstruct Alley No driver shall park in any Alley, except that: 4.51 A Commercial Vehicle may park thereon for a period not exceeding thirty (30) minutes while actually engaged in loading or unloading goods, or 4.5.2 A Vehicle other than a Commercial Vehicle may park thereon for a period not exceeding ten (10) minutes while actually engaged in loading or unloading goods or passengers. 4.5.3 No driver shall park in an Alley in such a manner as to prevent other persons or Vehicles from passing the parked Vehicle. Time Limit Parking No person shall park a Vehicle for a longer period oftime than that indicated on any sign placed in a parking area by authority of the City Manager. Unattached Trailer No person shall, without a Permit, park a Trailer upon any Roadway unless said Trailer is attached to a Vehicle by which it may be legally towed. Reserved Taxis Bylaw 327623 4.10 4.11 4.12 4.13 4.14 No person shall, except in case of emergency or mechanical failure or with an approved Permit, stop or park a Vehicle upon any Highway in a manner that may impede or obstruct the free movement of traffic or may constitute a hazard to other persons or Vehicles using the street. Heavy Vehicle Parking In Residential Districts No person shall, without a Permit, park any Heavy Vehicle or any type of construction or farming machine or equipment on any Highway, in the City, in an area designated in the City of Camrose Land Use Bylaw as a residential district or which abuts a residential development. 4.10.1 Section 4.10 shall not apply to: 4.10.1.1 Recreation Vehicles, or 4.10.1.2 Commercial Vehicles while actually loading or unloading goods, or 4.10.1.3 Construction equipment being used during construction or improvement of property, provided that such equipment is parked adjacent to the property where such work is being done. Recreational Vehicle Parking On Public Property, including roadways: In Subsection 4.11, capitalized terms carry the same definition as the Land Use Bylaw. 4.11.1 May 15*to Nov 15'--An RV may be parked on a roadway for a maximum of 48 hours as long as itdoes not impede the normal traffic flow of the road or sidewalk. Once the maximum 48 hours has been reached, the RV must be moved to an off--streetlocation for at least 48 hours, before it can return to the street. 4.11.2 Nov 2""to April 30"' -- RVs are prohibited from parking on public property, including roadways. Parking -- Fire Lanes No person shall, without a Permit, park a Vehicle upon a Highway providing Emergency Vehicle access, Emergency Vehicles exempted, where such Roadway is marked by signs, approved by the Fire Chief, on or near the Highway. Angle Parking Over 6.3 Meters No person shall, where angle parking is permitted or required, park any Vehicle, or combination of Vehicle and Trailer, exceeding 6.3 meters in length. Temporary Signs No person shall park or allow a Vehicle to remain parked where temporary or portable signs authorized by the General Manager of Infrastructure have been Bylaw 3276--23 4.16 4.17 Sidewalk or Roadway in such a manner as to obstruct a Sidewalk or Roadway. Nor shall such device be parked in a way deemed to be a public nuisance. Separate Parking Offence In the event that a Vehicle remains parked after a traffic tag has been issued for a violation of this Bylaw, for a further period of time exceeding that indicated on the sign, a separate offence shall be deemed to have been committed. Chalking Tires For the purposes of this part, itshall be lawful for any person authorized to enforce this Bylaw to place an erasable chalk mark on the tread face of a tire on any Vehicle found parked on any Roadway or City owned parking lot. 5. EXTRAORDINARYUSE OF HIGHWAYS (Refer to Schedule "3" for Specified Penalties) 5.1 5.2 Application for Permit 5.1.1 Every person who desires to obtain a Permit, included as Schedule "4-A" herein, as required inthis Bylaw shall make application therefore in writing to the City's Engineering Services Department and provide such information as may be requested by the issuing authority. 5.1.2 A Permit shall not be valid until it has been signed by both the General Manager of infrastructure and the Chief of Police, and the permit fee has been paid, pursuant to Section 5.5 herein. 5.1.3 Notwithstanding the above, the City may also choose to utilize internal or external software, whether online or electronic, to issue Permits. Permit Required for Overweight Vehicle 5.2.1 Overweight Restrictions No person shall operate, or allow the operation of, a Vehicle on any Highway, other than 48 Avenue (Highway 13) or 68 Street and Camrose Drive (Provincial Highway 13A) or the Camrose Industrial Zone within the City, it such Vehicle is in excess of the weight limitsestablished by the TrafficSafety Act Commercial Vehicle Dimension and Weight Regulation, as amended from time to time, without having first obtained from the City a Permit to do SO. 5.2.2 Permits The General Manager of Infrastructure may issue Permits forthe operation of Heavy Vehicles or auto carriers on Highways otherthan those designated as truck routes as specified in Schedule "2-A" hereof and in so doing may specify such conditions, as amended, necessary with respect to the safety of persons and/or property and to ensure the smooth uninterrupted flowof Bylaw 3276-23 5.4 5.5 5.6 5.7 No person shall operate, or allow the operation of, a Vehicle on any Roadway within the City, other than 48 Avenue (Provincial Highway 13) or within the Camrose industrial Zone, when the width ofthe Vehicle and/or load exceeds the limits prescribed inthe Traf?c SafetyActCommerciai Vehicle Dimension and Weight Regulation, as amended from time to time, without having first obtained from the City, a Permit to do so. 5.3.2 Over-heightl Over-length No person shall operate, or allow the operation of, a Vehicle on any Roadway within the City other than 68 Street and Camrose Drive (Provincial Highway 13A) or within the Camrose Industrial Zone when the height or length of the Vehicle and/or load exceeds the limits prescribed in the Traffic Safety Act Commercial Vehicle Dimension and Weight Regulation, as amended from time to time, without having first obtained from the City a Permit to do so. Vehicle Dimensioning Restrictions on Oversize Vehicle Routes Notwithstanding Sections 402 or 403 herein, no person shall operate, or allow the operation of a Vehicle on an approved route, as outlined in Sections 5.2 and 5.3, without a Permit when one or more of the dimensions of the said Vehicle are in excess of those values found in Schedule "2-B"herein. Fees for Permits 5.5.1 Every person who desires to obtain a Permit, where required under this Bylaw, shall pay a fee as prescribed inthe City of Camrose Annual Fees and Charges Bylaw. 5.5.2 in addition to the Permit fee, described in the City of Camrose Annual Fees and Charges Bylaw, the said Permit holder shall reimburse the City for any additional costs incurred by the City as a result of the actions for which the Permit was obtained. Permit Offence Any person who violates any of the conditions contained in a Permit issued pursuant to this Bylaw, or who fails to obtain a Permit where required by this Bylaw, shall be guilty of an offence. Failure to Produce Permit Any person who is the authorized holder of a Permit where required by this Bylaw, shall carry such a Permit with them while engaged in that activity and shall produce the permit to a Peace Officer on demand. Any person who fails to produce said Permit willbe subject to a Fine as enumerated in Schedule "3"herein. 6. AUTHORITY OF MUNICIPAL OFFICIALS Bylaw 327623 6.2 General Manager of Infrastructure The General Manager of Infrastructure is hereby authorized to undertake the following duties and responsibilities under this Bylaw: 6.2.1 Load Limits Prescribe load limits on Roadways in the event of unfavorable road conditions and on any bridge and arrange for the necessary placement of signs to notify the motoring public. 6.2.2 Permits for Extraordinary Use of Highways Issue "Extraordinary Use of Highway Permits" and establish such conditions as they deem necessary to ensure the protection of persons and property and without the undue interference to the flow of Pedestrians and traffic. 6.2.3 Temporary Speed Limits Designate temporary maximum speed limits in respect to any Highway under construction or repair, or in a state of disrepair, or during a special event. 6.2.4 Temporary Signs for Snow Removal and Street Cleaning Cause moveable signs to be placed on or near a Roadway to restrict parking to facilitate snow cleaning, street cleaning, or other Public Works operations. 6.2.5 Traffic Control Devices Prescribe the location and placement of every Traffic Control Device and traffic control signal inthe City and shall keep a record of such locations and placements; such records to be available to the public for inspection during normal business hours. 7. AUTHORITY OF PEACE OFFICERS (Refer to Schedule "3" for Specified Penalties) 7.1 Impoundment of Vehicle and Release 7.1.1 Any Peace Officer is hereby authorized to remove and impound, or cause to be removed and impounded any Vehicle or Trailer, parked on any Roadway, parked in contravention of any provision of this Bylaw. 7.1.2 Any Vehicle impounded under this Section may be released to the owner or his agent upon proof that any charges or costs imposed for towing and/or storage have been paid. 7.2 Removal of Vehicle for City Purposes 7.2.1 Any Peace Officer of the City of Camrose is hereby authorized to remove or cause to be removed, any Vehicle or Trailer, legally parked on any Roadway which may interfere with public works operations being carried on bythe City. Bylaw 3276-23 7.4 7.5 7.3.1 A Peace Officer may place in or upon any Vehicle found parked in contravention of this Bylaw, a notice in the form prescribed by the Lieutenant Governor in Council, to be known as a Parking Tag. 7.3.2 A Bylaw Enforcement Officer may issue a notice in the form prescribed by the Lieutenant Governor in Council, to be known as a Parking Tag, for any contravention of Section 4 of this Bylaw. Parking Tag Not Paid in the event that a Parking Tag is not paid within seven days (7) of the issuance thereof, a Peace Officer may lay an information with respect to the alleged breach for which the Parking Tag was issued. Seizure 7.5.1 A Peace Officer may seize any Bicycle, Micro--mobi|ityDevice, or any similar device, that is operated, parked or left in contravention ofthis Bylaw and such device, may be impounded for a period not exceeding sixty (60) days. 7.5.2 Any Bicycle, Micro-mobility Device, or any similar device that has been impounded may be redeemed by the owner at the end of the impounded period upon payment to the City of a storage fee as enumerated in Schedule "3"herein. 7.5.3 Any Bicycle Micro--Mobi|ityDevice, or any similar device, which has been impounded and not redeemed by the owner withinsixty (60) days ofthe date of expiration of the period of impoundment, shall become the property ofthe City. 8. MISCELLANEOUS 8.1 8.2 Visibility at Intersection No owner or occupant of any land within the City shall allow any hedge or shrub or tree or fence or sign or a structure or thing located thereon, within 4.6 meters of a Roadway intersection, to be of such a height as to interfere withthe good visibilityof any person using the Roadway adjacent to such land. Notice to Remedy Visibility 8.2.1 The General Manager of Infrastructure, or anyperson appointed by them to act in their stead, may by written notice, require any person who contravenes Section 8.1 herein to remedy the condition within ten (10) days and ifsuch person fails to comply with said notice, the General Manager of infrastructure may direct employees or agents ofthe City to enter any property and remedy such condition and charge the cost of the work done to the owner or occupant as a debt due and owing the City. » E E iiEE 25 E E Bylaw 3276-23 8.3 Hitch-Hiking Except in cases of City--approved public or private transit service, no person shall stand upon or walk along a Highway for the purposes of soliciting a ride from the driver of any Vehicle. 8.4 Obstruction of Sidewalks No person shall, without a Permit, place any object on a municipal Sidewalk which willimpede the progress of Pedestrian safety. 8.5 Highway Signslconstruction SignslBarricades No person shall tamper with or remove any construction sign, Highway sign or any barricades without first obtaining authorization from the General Manager of Infrastructure or their designate. 8.6 Construction andlor Maintenance Construction or maintenance Vehicles, Trailers and equipment are exempt from the provisions of this Bylaw with respect to parking, stopping and oversize restrictions if required for, and participating in, construction of maintenance on municipal right of way and a Traffic Safety Plan is in place which has been approved by the General Manager of lnfrastructure. 9. PENALTIES 9.1 Speed Penalty The penalties provided by the Traffic Safety Act, relating to speed violations shall apply herein. 9.2 General Penalty Except as otherwise provided herein, any person who contravenes any provision of this Bylaw is guilty of an offence, and shall be liable on Summary Conviction to a fine of not less than two hundred ($200.00) dollars or more than one thousand ($1,000.00) dollars and in default of payment to be imprisoned for a term not exceeding sixty (60) days. 9.3 Specified Penalties Every person who contravenes any provision of this Bylaw, as enumerated in Schedule "3" herein, is guilty of an offence and shall be liable on Summary Conviction to the penalty specified therein for such offence and indefault of payment to imprisonment for a term not exceeding sixty (60) days. 9.4 Penalty in Lieu 9.4.1 Notwithstanding any other provisions for penalties, a Peace Officer may, in a breach of this Bylaw, issue a Bylaw 3276-23 9.5 9.6 9.7 specified thereon and, in the event, that such penalty is not paid within seven (7) days, a Peace Officer may thereafter lay an Informationwith respect to the breach for which said form or notice was issued. 9.4.3 When a voluntary penalty ticket is issued by a Peace Officer for an offence which is not enumerated in Schedule "3"herein, the monetary penalty shall be the minimum fine that may be imposed under the Section 9.2 of this Bylaw. Traffic Ticket Summons A Peace Officer may, in lieu of laying an information with respect to an offence under this Bylaw, issue a ticket in the form prescribed by the Lieutenant Governor in Council and the provisions of the Provincial Offences Procedure Act, Chapter P-34, RSA 2000, and all amendments thereto, respecting the issuance of said ticket shall apply herein. Owner Responsible The owner of a motor Vehicle or Trailer which is involved in any contravention ofthis Bylaw, is guilty of an offence unless the owner proves to the satisfaction of thejudge that at the time of the offence, the motor Vehicle or Trailer was not being driven or was not parked or left by the owner or by any other person with the ownersconsent, expressed or implied. Certificate Prima Facie Proof 9.7.1 In a prosecution under this Bylaw or any order made under this Bylaw, a certificate purporting to be issued and signed by an inspector under the Weights and Measures Act (Canada) and bearing a date not more than one year either before or after the date of the offence charged, shall be admitted in evidence as prima facie proof of the facts stated in the certificate without proof of the signature or official character ofthe person signing the certificate. 9.7.2 Notwithstanding Subsection 9.7.1, in a prosecution under this Bylaw, a certificate purportedly signed by a Peace Officer or a person appointed by the Weights and Measures Board stating: 9.7.2.1 That the weight was measured on a portable scale of either: 9.7.2.1.1 the gross weight of: a) a Public Vehicle, or b) a combination of Vehicles and the load being carried thereby, Oi" 9.7.2.1.2 The gross axle weight transferred to the road through any Bylaw 3276-23 shall be admitted in evidence as prima facie proof of the facts stated therein without proof of the signature or official character of the person signing the certificate. 10. EFFECTIVE DATE 10.1 This Bylaw shall come into effect on the date of final passing thereof and Bylaw 3274-23 is hereby rescinded. E Ei 2 E 11.
