## VILLAGE OF CLIVE ## BY-LAW #570-25 ## GOLF CART (PILOT PROJECT BYLAW A bylaw of Village of Clive, in the province of Alberta, authorizing the operation, regulation, and control of vehicles on highways in the Village of Clive. WHEREAS the Municipal Government Act provides that a council of a municipality may pass bylaws for the safety, health and welfare of people and the protection of people and property. municipality may by bylaw authorize or issue a permit authorizing persons to AND WHEREAS the Traffic Safety Act provides that a council of a trive colfcatons on and in thoril riget ago anth Reunicipality subject highways which are subject to the direction, control and management of the municipality may by bylaw regulate and control the operation of golf carts on AND WHEREAS the Traffic Safety Act further provides that a council of a municipality and on property that is not a highway and is located within the AND WHEREAS the Council of Village of Clive believes that it is in the best interests of the residents of the Village of Clive that a bylaw be passed to regulate and control the operation of golf carts pursuant to the powers granted to municipalities under the Traffic Safety Act: NOW THEREFORE, the Council of the Village of Clive in the Province of Alberta, duly assembled, enacts as follows: 1) TITLE This bylaw shall be known as the "Pilot Project (Golf Carts) Bylaw." This bylaw applies to all golf carts operated on highways within the Village 2) APPLICATION of Clive. Definitions in the Pilot Project (Golf Carts) Regulation, and definitions in the Traffic Safety Act and its regulations, as applicable, are adopted for the purposes of the interpretation and the application of this bylaw. In this bylaw: (a) "Act" means the Traffic Safety Act, RSA 2000, cT-6; (b) "Council" refers to the Council of the Village of Clive, and as defined in the Municipal Government Act, RSA 2000, M-26; (c) "The Village" means Village of Clive; (d) "CAO" means the Chief Administrative Officer of the Village of Clive, or designate; (e) "Village Owned Land" means any real estate that is directly owned, leased, or managed by a municipality for public use and benefit; (f) "Designated Highway" means a highway identified by the Council and approved by the Registrar as a highway that golf carts may operate on; (g) "Owner" has the same meaning within the Act and further includes a person who is identified in a Permit issued under Section 7 of this bylaw. <!-- image --> has a structure that cannot attain a speed of more than 40 km/h on a paved level surface, (h) "Golf Cart" means a 4-wheel motor vehicle that: is designed by a manufacturer primarily for use on golf courses or paved surfaces, (1) partially or fully encloses its operator and passengers, has a gross vehicle weight rating of less than 1361kg; (2) is not less than 1.2 m above the ground, and (i) "Peace Officer" means a Lacombe County Peace Officer, a member of the Royal Canadian Mounted Police, or a Bylaw Enforcement Officer; (i) "Permit" means a permit issued in accordance with this Bylaw under Section (k) "Nighttime" means the period commencing one hour after sunset and ending one hour before the following sunrise; Municipality pursuant to the Municipal Government Act, R.S.A. 2000, (1) "Violation Tag" means a tag or similar documents issued by the c. M-26, and amendments thereto; (m) "Violation Ticket" means a ticket issued pursuant to the Provincial Offences Procedure Act, R.S.A. 2000, c.P-34, as amended and the regulations there under. 4) OPERATION RESTRICTIONS FOR GOLF CARTS No person shall: (a) Operate a golf cart in a manner contrary to the Act, its regulations, or this bylaw. (b) Operate a golf cart unless they are the holder of a valid operator's license (Class 1-7), issued pursuant to the Act. highway. Which has not been maintained as prescribed by the manufacturer or has faulty or inoperable equipment, operator and service manuals. <!-- image --> (g) Operate a golf cart on village owned land, green spaces, sidewalks or boulevards without permission granted by the CAO - (h) Stop/Park golf cart on sidewalk or boulevard. (i) Operate a golf cart outside of daylight hours. Operation is only permitted from one hour before sunrise until one hour after sunset. 5) OPERATOR RESPONSIBILITIES FOR GOLF CARTS Every operator of a golf cart shall: (a) When approaching an oncoming vehicle, pass the vehicle on the right, (b) Yield the right of way to vehicles approaching from their right, (c) When overtaking another vehicle, pass that vehicle on the left, to present a hazard, and (d) Yield the right of way to all pedestrians that are approaching so close as distance behind any other vehicle. (e) Except when overtaking another vehicle, maintain a safe following 6) SIGNALLING INTENTIONS (a) A person driving a golf cart shall indicate that person's intention to carry out the following by doing the following: i. In the case of turning left, by extending that person's left hand and arm horizontally from and beyond the left side of the and downward. In the case of turning right, by extending that person's left hand and arm beyond the left side of the vehicle and upward, In the case of stopping or decelerating speed, by extending that person's left hand and arm beyond the left side of the vehicle In the case of starting from a parallel park position on the right side of the roadway, by extending that person's left hand and arm horizontally from and beyond the left side of the vehicle, As indicated in the following diagram: <!-- image --> ## 7) DESIGNATED HIGHWAYS Council hereby designates those highways included in Schedule 'B' as designated highways for the purposes of this bylaw. for approval. (a) Any changes to designated highways shall be submitted to the Registrar (b) Designated highways shall be posted at a speed of no more than 50km/h. (c) The Chief Administrative Officer shall ensure signs are erected on designated highways. - Signs shall be in the form and manner set out in Schedule 'C'. <!-- image --> ## 8) PERMITS Council hereby authorizes the CAO to issue permits, attach conditions, and to charge a fee to regulate and control golf carts within the village. (b) When signaled or directed to stop by a Peace Officer, a driver of a golf cart shall: Forthwith bring the vehicle to a stop, Their operator's license issued pursuant to the Act, Forthwith furnish to the Peace Officer: Any permit issued pursuant to this bylaw, and Any other information respecting the driver or the vehicle that the Peace Officer requires, and Remain stopped until permitted by the Peace Officer to leave. 10) OFFENCES (a) The operator of a golf cart that is involved in a contravention of this bylaw is guilty of an offence and liable upon summary conviction to a fine specified in Schedule 'A' of this bylaw. (b) The owner of a golf cart involved in a contravention of this bylaw is guilty of an offence and liable upon summary conviction to a fine specified in Schedule 'A' of this bylaw. ## 10) VIOLATION TAG Violation Tag to any person who the Peace Officer has reasonable and probable grounds to believe has contravened any provision of this (a) A Peace Officer is hereby authorized and empowered to issue a ## 11) VIOLATION TICKET (a) A Peace Officer is hereby authorized and empowered to issue a violation ticket, pursuant to Part II of the Provincial Offences Procedure Act (Alberta), to any person who the Peace Officer has reasonable and probable grounds to believe has contravened any provision of this <!-- image --> ## 12) SEVERABILITY (a) Should any ecsion or al be dear bef be severate fom all ther sections of this bylaw. 13) GENERAL (a) This bylaw shall be in effect on: The date of the final passing thereof, and ili. Upon the approval of the Registrar. (b) This bylaw shall expire on June 14, 2029. 14. Bylaw #568-25 is hereby repealed. 15. This bylaw shall take effect on the date of the third and final reading.
