VILLAGE OF CONSORT
BYLAW A777
Being a Bylaw of the Village of Consort in the Province of Alberta regulating the cost of Fire
Department Inspections.
WHEREAS the Safety Codes Act, Chapter S-1 as amended, provides for municipalities to enact Bylaws respecting
the implementation of fees for the carrying out of its powers and duties as an accredited municipality.
AND WHEREAS the Council of the Village of Consort deems it necessary to implement fees for the carrying out its
powers and duties as an accredited municipality within the corporate limits of the Village of Consort;
NOW THEREFORE the Council of the Village of Consort duly assembled and pursuant to the provisions of the said
Safety Codes Act and amendments thereto, enacts as follows:
1.
Title:
1.1
This Bylaw may be cited as the "Fire Department Inspection Fees Bylaw".
2.
Definitions
2.1
In this Bylaw, unless the context other requires:
a)
Group "A" Division "1" Assembly occupancies intended for the production and viewing of the performing
arts;
b)
Group "A" Division "2" Assembly occupancies not elsewhere classified in Group A;
c)
Group "A" Division "3" Assembly occupancies of the arena type;
d)
Group "A" Division "4" Assembly occupancies in which occupants gather in the open air;
e)
Group "B" Division "1" Care or Detention occupancies in which persons are under restraints or are
incapable of self-preservation because of security measures not under their control;
f)
Group "B" Division "2" Care or Detention occupancies in which persons have cognitive or physical
limitations require special care treatment;
g)
Group "C" Residential Occupancies;
h)
Group "D" Business and personal services occupancies;
i)
Group "E" Mercantile occupancies;
j)
Group "F" Division "1" High Hazard Industrial Occupancies;
k)
Group "F" Division "2" Medium Hazard Occupancies;
l)
Group "F" Division "3" Low Hazard Industrial Occupancies;
m) Safety Codes Officer (SCO) means an individual designated as a safety codes officer under the Safety
Codes Act.
3.
Inspections and Record Keeping
3.1
All inspections and record keeping shall be undertaken in accordance with the inspection and record
keeping requirements of the Village of Consort Quality Management Plan as adopted by Council.

3.2
Each A, B, C, D, E, F, type occupancy in the Village of Consort requires one (1) Fire Safety Inspection
annually.
3.3
No personal residence under the C type occupancy will have a Fire Safety Inspection conducted, unless by
written request of the owner.
3.4
Only Safety codes Officers and those training to be Safety Codes Officers (under the guidance of a
certified and designated Safety Codes Officer) can conduct a Fire Safety Inspection.
3.5
In the event that re-inspection(s) are required, the time limit accorded shall be at the sole discretion of
the SCO and shall, at all times, be reasonable and based on the safety concerns related to the
infraction(s).
4.
Fees
4.1
The fees charges to the owner and/or operator of the facility (as applicable), as per Schedule "A" Fire
Inspections Fees shall be payable in advance or upon receipt of invoice.
5.
Enforcement
5.1
The Village is not required to enforce this bylaw. In deciding whether to enforce this Bylaw, the Village
may take into account any practical concerns, including available municipal budget and personnel
resources.

Severability
6.1
Despite that any section or sections of this bylaw, or any part or parts thereof, may be found by any court
of law to be invalid or illegal that section or sections or part or parts thereof shall be deemed to be
severable, and all other sections of this bylaw, or parts thereof, are separate and independent there-from
and enacted as such.
This Bylaw will come into force and effect on the date of successful third reading and signing in
accordance with the Municipal Government Act (R.S.A. 2000, c. M-26) as amended.
