- . . .. ) COUNTY or BARRHEAD NO.l1 PROVINCE or ALBERTA BY-LAW NO. 50-85 PUBLIC RESERVES BY-LAW PURSUANT to the Municipal Government Act, Reviaed Statutea of Alberta, 1980, Chapter H-26 and amendmenta thereto, the Council of the County of larrhead Ho. 11 duly aaaeabled, hereby enacta aa follova: PAllT I - GENERAL: 1. PURPOSE: The purpo;e of thia By-law ia to regulate and control the uae and operation of Public leaerve Landa within the County of Barrhead Ho. 11 in order to inaure public aafety and natural preaervation. 2. INTERPRETATION: In thll By-law: (a) "CountyH aeana the County of Barrhead No. 11; (b) -Development OfficerH means: i) a peraon appOinted aa a developaent officer purauant to a reaolution of council, or; ii) where a municipal planning commia8ion ia authorized to act aa a development officer, the municipal planning co.-1asion, or; iii) where a municipal planning commis8ion ia authorized to act aa a development officer, in addition to a person appointed aa a development officer, either or both of them; (c) "Off-highway vehicleH means an off-highway vehicle as defined in the Off-Highway Vehicle Act, 1980, Revised Statutes of Alberta, Chapter 0-4, and amendmenta thereto; (d) "Peace OfficerH means a member of the Royal Canadian Mounted Police, and when authorized, a member of a municipal police force, a special constable, a By-Law enforcement officer, or a member of the patrol division of the Department of the Solicitor General; (e) HRecreation Department" means the County Recreation Depart .. nt; (f) HReserve Land- means environmental reserve, municipal reserve or school reserve or municipal and achool reserve as defined under the Planning Act, Revised Statutes of Alberta. 1980, Chapter P-9, and amendments thereto; (g) HReserves" means landa which have been dedicated to the County for park purpoaes during the subdivision procesa in accordance with the Planning Act, levi sed Statutea of Alberta, 1980, Chapter P-9, and amendments thereto. (h) ·Service VehicleH meana a vehicle, as defined in thi8 by-lsw, uaed for the purpoae of aervicing lots within the various subdivisiona, vith such commoditiea aa fuel, boat gaa, propane, fire wood, etc. Service Vehicle a180 .. ana a vehicle used to pump out sewage holding tanka and septic tanks. Fire trucks, water trucks, delivery trucks, etc., viII a180 fall under this definition. (i) "Vehicle" lIeans a device in, on or by which a person or thing lI&y be transported or drawn on s highwsy; --- 2 j , - COUNTY OF BARRHEAD NO.11 PROVINCE OF ALBERTA BY-LAW NO. 50-85 PAGE 2 PUBLIC RESERVES BY-LAW PART II - OFFENCES: 3. For the purposes of this By-law, everyone who: (a) not being in a dwelling house causes a disturbance in or near a public place; i) by fighting, acreaming, shouting, awearing, singing or uaing insulting or obscene language; ii) by being drunk, or; iii) by t.peding or moleating other persona; (b) openly expoaea or exhibita an indecent exhibition in a public place; (c) loitera in a public place and in any way obatructa peraona who are there; is guilty of an offence, puniahable on sumaary conviction, in addition to but not in aubstitution for an offence created by Section 171 of the Cria1nal Code, Chapter C-34, Revised Statutea of Canada, 1970 and amendaenta thereto, and for the purpoaea of interpretation the definitiona included in the aaid Criminal Code ahall apply to the offence aet out in Section 3 of thia By-Law. 4. No peraon ahall deface or in any way diarupt the natural growth of any tree or plant life (except weed a identified in the Weed Control Act, aeviaed Statutea of Alberta, 1980, Chapter W-6, and amendmenta thereto) within a public reaerve. 5. No doga, other than d~ga rea trained on a leaah, are permitted in public reservea. 6. No peraon ahall tease, moleat or injure any vertebrae animal or throw any aubatance at or near such animals in a public reaerve in such a way aa cauaes, or ia likely to cauae, injury to any such ani .. l. 7. No peraon shall play golf within any public reserve excepting golf courses. 8. Except for personal recreational purposea, no peraon shall tranaport any goods or chattels over, or place and leave chattela upon, any public reserve without authorization from the developaent officer; and further, any goods and chattela used for personal recreational purposes ahall be removed from public reaervea prior to 11:00 p --- and ahall not be left within public reservea overnight except for camping in deaignated campsites. 9. Fires are permitted in public reserves only in deaignated fire pits and stoves; otherwise, no firea are permitted without first obtaining a fire permit from a duly authorized fire guardian appointed by County Council. 10. Except for cluba, organizations and community. league a regiatered with the Recreation Departaent, no group; or peraon ahall diatribute or cauae to be diatributed any advertising .ateriala, pamphleta, billa or circulara within public reservea without the authorization of the development officer. 11. No peraon, firm, agency or corporation ahall advertiae, promote or carry on commercial or rental aalea within any public reserves without firat obtaining authorization fro. the developaent officer. ·" . . The holdina of any and all aausa.enta, entertaia.enta, paradea and pro.oted spectator sportinl events, where a fee ia collected, ia prohibited within public rea~rvea without first obtaining authorisation froa the develo~ent officer. 13. No person shall operate, drive or abandon a vehicle or off-highway vehicle except for a service vehicle witbin or upoo aoy public reserve. 14. No persoo shall conduct any diggins, excavatloa, or build in, operstiona witbin or upon any public reserve without first obtaioinl the written autborisation of the develo~eot officer. 15. The provisions of this By-Law do not apply to actions and operations of the County, or persons actinl upon the instructiona of the County in respect to any .. intenance and construction witb public reaervea. PART III - PBHALTIBS: 16. A person who contravenes any provision of tbia By-law eitber by doing aoaiethin, which he is probibited from doinl or failinl to do soaethinl which be is required to do is guilty of an offence and is liable on sw.aary conviction to a fine not in excess of $2,500.00, exclusive of costs; or, in default of payaent of the fine and coata of tbe ca..ittal, to lapriaonaent for a period not exceeding 6 montha or until auch fine and costa are sooner paid.
