## TOWN OF DAYSLAND
## BYLAW No. 2009-478
## A WATER REGULATION BYLAW OF THE TOWN OF DAYSLAND, IN THE PROVINCE OF ALBERTA
(hereinafter referred to as "the Municipality")
## THE PURPOSE OF THIS BYLAW IS TO REGULATE THE PROVISION OF POTABLE WATER WITHIN THE TOWN OF DAYSLAND.
## WHEREAS:
The Town of Daysland is in need of conserving water to ensure an adequate volume is available for public use and fire protection, and;
The Town of Daysland is implementing a town-wide water metering project.
NOW THEREFORE, pursuant to the provisions of the Municipal Government Act, Statutes of Alberta, the Council of the Town of Daysland, duly assembled, enacts as follows:
1. That all water users shall comply with the watering restrictions set out in Schedule "A" to this bylaw. In addition to Schedule 'A' of this bylaw, the Daysland Council, Chief Administrative Officer, or designate may impose additional restrictions they deem appropriate in order to regulate the amount of water used within the Town of Daysland in an effort to maintain an adequate supply of water for the community during a drought or other water related emergency or concern. Upon notice of such additional restrictions being imposed, all water users shall comply with such additional restrictions.
2. That the Town of Daysland shall supply, install, own and maintain all water meters installed in the Town of Daysland.
3. That no person other than an employee of the Town, or person authorized by the Town shall install, test, remove, repair, replace, disconnect, or tamper with a water meter.
4. That any person who contravenes any provision or requirement of this bylaw is guilty of an offence and is liable upon prosecution under the Provincial Offences Procedures Act, to the penalty set out in Schedule "B".

That where a Designated Officer or a Peace Officer believes that a person has contravened any provision of this bylaw, a Violation Tag or a Violation Ticket may be served upon the person, allowing payment of the specified penalty set out in Schedule "B" for the offence and the recording of such

- payment by the Court shall constitute acceptance of a guilty plea and the imposition of a fine in the amount of the specified penalty; and
- b. That section 4(a) shall not prevent a Designated Officer from issuing a ticket requiring a Court appearance of the Defendant pursuant to the provisions of the Provincial Offences Procedures Act or from laying an information in lieu of issuing a Violation Ticket.
6. That the fines imposed for a breach of this bylaw are as currently set out in Schedule 'B' of this bylaw or as established in the future in the Town of Daysland Master Rates bylaw. If there is any discrepancy between this bylaw and the Town of Daysland Master Rates bylaw, the Master Rates bylaw will prevail.
7. That the supply of water by the Town of Daysland is subject to customers complying with the terms of this bylaw. In addition to any fines which may be issued for breach of this bylaw, any person who contravenes this bylaw forfeits the privilege to be supplied with water. The Town of Daysland shall be entitled to disconnect water service to any property after giving 14 days notice of the breach and the intention to terminate, and place any outstanding fees for service, disconnections or reconnections on the respective utility roll.
8. This bylaw comes into force on the date it is passed.

## SCHEDULE 'A'
## WATERING REGULATIONS
Effective May 1 each year watering of lawns and gardens may ONLY be done from 7:00 a.m. - 9:00 a.m. and from 7:00 p.m. - 10:00 p.m. AND ONLY on the following days:
EVEN DATES - EAST OF 50 STREET ODD DATES - WEST OF 50 STREET
NEW grass seed, sod or trees may be watered each day but ONLY at the stated times.
