f Being a bylaw of the Village of Delia, Alberta to provide for the establishment of user fees and charges for municipal services, interest charges and penalties for late or non-payment of property taxes. WHEREAS the Municipal Government Act, Chapter M-26, Revised Statutes of Alberta, 2000 as amended, is the authority for Councils to pass bylaws in order to charge for various services provided, collect interest on overdue accounts and/or to make certain information available to the public, and WHEREAS the Municipal Government Act, Chapter M-26, Revised Statutes of Alberta, 2000 as amended, is the authority for Councils to establish methods of tax payments, impose penalties for non-payment or late payments of taxes, and WHEREAS in accordance with Section 8 of the Municipal Government Act and Section 93 of the Freedom of Information and Protection of Privacy Act, Council may pass a bylaw establishing fees to charge for providing information and services, NOW THEREFORE the Council of the Village of Delia, duly assembled, enacts as follows: Short Title 1) The short title of this Bylaw shall be the "Municipal Fees, Charges and Penalties Bylaw". Definitions 2) In this bylaw the following terms shall have the meanings shown: a) "Business Day" shall mean every day of the week, Monday through Friday, excepting statutory holidays and other holidays as designated by the Village of Delia; b) "Taxes" includes all property taxes, local government taxes and all other taxes lawfully imposed by the Village of Delia pursuant to the Municipal Government Act, or any other Statute of the Province of Alberta; and shall mean all taxes which are imposed or levied in the current year; c) "Tax Arrears" means taxes that remain unpaid after December 31 of the year in which they are imposed. Conditions 3) That user fees and charges are established by this bylaw as detailed in the attached Schedule "A". 4) That the imposition of interest charges on general accounts payable to the municipality that remain unpaid after 30 days from the date of mailing of the account are detailed in the attached Schedule "A". Village of Delia - Province of Alberta By-Law #647-2019 - Municipal Fees, Charges, and Penalties Bylaw 5) That payment of Taxes and Tax Arrears are to be made by every taxable person at the administration office of the Village of Delia during regular business hours or by other approved means such as but not limited to electronic banking. 6) That in the event that any taxes remain unpaid as per the tax notification delivered in accordance with the Municipal Government Act, penalties shall be applied as per the attached Schedule A. 7) That any penalties imposed shall be added to and form part of the unpaid taxes. Severability 8) Each separate provision of this Bylaw shall be deemed independent of all provisions, and if any provision of this bylaw be declared invalid, all other provisions shall remain valid and enforceable. Repeal 9) By-Laws #432, #606-13, and #612-15 are repealed. In Force 10) This by-law shall come into full force and effect on the day that it is finally passed by Council by giving it third and final reading and it is signed in accordance with the MGA. READ A THIRD TIME AND FINALLY PASSED THIS _____ DAY OF ____________, 2019. _______________________________ Mayor David Sisley _______________________________ Chief Administrative Officer Mark Nikota Bylaw #647-2019 - Municipal Fees, Charges, and Penalties Bylaw Schedule 'A' Account Payable Interest Charges  Interest charged at 1.5% per month on accounts that remain unpaid after 30 days Appeal Fees  Assessment Appeals o Business Tax - $50 o Equalized Assessment - $650 o Linear (Power Generation) - $650 o Linear (other) - $50 per LPAUID o Non-Residential - $650 o Residential of 3 or fewer dwellings and farm land - $50 o Residential of 4 or more dwellings - $650  Subdivision and Development Appeals - $200 Fire Services  As per the Regional Fire Agreement in effect Planning and Development Fees  Compliance Letter - $50  Demolition Permit - $50  Demolition Permit in conjunction with Development Permit - $0  Development Permit - $50  Development Permit for Home Based Business (must have a valid business license) - $0  Development Permit for Signage - $10  Land Use Rezoning Application - $200 Public Works  Any work completed on behalf of a property owner will be charged at $100 per hour (includes 1 staff person and equipment if necessary)  Appliance Disposal - $50 plus any applicable waste transfer site fees (unless part of a planned Village clean up)  Purchase of clean fill - $3 per yard (not including delivery charges) Tax Penalties  Any taxes unpaid after September 15th will be charged a 5% penalty to be applied on the next business day  Any taxes unpaid after October 31st will be charged an additional 5% penalty to be applied on the next business day  Any tax arrears outstanding as of December 31st in any year will be charged a 0.75% penalty per month (equal to 9% per annum) to be applied on the first business day of each month User Fees and Charges  Copy of Documents - $25 per hour plus photocopying charges  Faxing - $1 per page  Laminating - $2 per sheet  NSF Cheque - $50 plus bank fees if applicable  Photocopying per page - $0.25 black & white / $0.50 colour  Photocopying per page non profit organization - $0.10 black & white / $0.25 colour  Tax Certificates and Assessment Letters (other than first notice) - $20  Title Searches - $10
