## VILLAGE OF DONNELLY PROVINCE OF ALBERTA
A BYLAW OF THE VILLAGE OF DONNELLY IN THE PROVINCE OF ALBERTA PROVIDING FOR THE ESTABLISHMENT OF RULES AND REGULATIONS PERTAINING TO THE MOVEMENT OF VEHICLES AND PEDESTRIAN TRAFFIC IN THE VILLAGE OF DONNELLY.
WHEREAS, pursuant to The Traffic Safety Act, R.S.A. 2000C. T-6 Section 13 provides that a Municipal Council may pass a Bylaw with respect to regulation of parking and the use of highways under its direction, control and management.
## DEFINITIONS:
This Bylaw may be cited as "The Donnelly Traffic By-Law".
1. "Alley" means a narrow lane intended chiefly to give access to the rear of buildings and parcels of lands;
2. "Bicycle" means a cycle propelled by human power on which a person can ride, regardless of the number of wheels it has;
3. "Boulevard" means, in an urban area, that part of a highway that:
- i) Is not roadway, and
5. ii) Is not part of the sidewalk that is not especially adapted to the use of or ordinarily used by pedestrians;
4. "Centre Line" means the centre of a roadway measured from the curbs or, in the absence of curbs, from the edges of the roadway;
5. "Commercial Vehicle" means a vehicle operated on a highway by or on behalf of a person for the purpose of providing transportation but does not include a private passenger vehicle as defined in section (h) of the Traffic Safety Act;
6. "Driveway" means a road, especially a private one leading from the street to a building.
7. "Emergency Snow Removal" means a heavy snowfall and or blowing snow;
8. "Heavy Snowfall" means (3) three inches or more;
9. "Highway" means any thoroughfare, street, road, trail, avenue, parkway, lane, alley, square, bridge, public utility lot or other place, whether publicly or privately owned, any part of which the public is ordinarily entitled or permitted to use for the passage or parking of vehicles.
10. "Motor Vehicle" means a motor vehicle as defined in section (x) of the Traffic Safety Act;
11. "Municipality" means the Village of Donnelly, in the Province of Alberta;
12. "Peace Officer" means a member of the Royal Canadian Mounted Police, an Inspection Services Officer or a Peace Office or Bylaw Enforcement Officer appointed by the Village of Donnelly;
13. "Pedestrian" means a person afoot or a person in a wheel-chair;
14. "Roadway: means that part of a highway intended for use by vehicular traffic;
15. "Traffic Control Device" means any sign, signal, marking or device placed, marked or erected under the authority of the Traffic Safety Act for the purpose of regulating, warning, or guiding traffic;
16. "Vehicle" means a device in, on, or by which a person or thing may be transported or drawn on a highway.

## VEHICLE TRAFFIC:
101. The Council is hereby authorized to cause the installation of any traffic control device to govern and direct traffic within the Municipality.
102. The speed limit for all vehicles in all streets of municipality shall be fifty (50) kilometers per hour, except where otherwise posted.
103. The speed limit for all vehicles in all alleys of the municipality shall be twenty-five (25) kilometers per hour, except where otherwise posted.
104. No person shall drive any vehicle at a greater rate of speed than fifteen (15) kilometers per hour when leaving any alleys or other driveway or when crossing any sidewalk.
105. No vehicle operator shall drive or stand a vehicle upon any roadway in such a manner as to block, obstruct, impede or hinder traffic thereon; where the obstruction is unavoidable due to mechanical failure, the operator will not be in breach of this section provided he promptly takes measures to clear the faulty vehicle from the roadway.
6. 106 (1) When repairs or alterations are in progress on or adjoining any highway within the municipality and such work is being indicated by barricades or signs or by a flag person, no person shall disregard the warning given thereby and every operator shall obey any signal of a flag person on duty at the site of the work.
(2) When a vehicle is engaged in such highway repairs or alterations within an area controlled by a flag person the provisions of this by-law relating to backing, turning, stopping, crossing the centre line and making other movements shall not apply to such vehicle.
107. No person shall drive any vehicle over the centre line of a highway except at properly identified intersections.
108. The Council is hereby authorized to designate highway which shall be used by "heavy vehicles". No person shall park a commercial vehicle over one ton on a residential street or highway for more than 60 minutes, therefore allowing to load or unload.
## PARKING:
201. No person shall park a vehicle upon any highway in such a manner that any part of the vehicle is within ten (3.05) meters / (10) feet of the centre line of the highway whether or not such centre line is marked on the highway provided that the foregoing shall only apply to highways where the portion thereof intended for vehicular traffic is (12.20) meters / (40) feet or more in width.
202. Where a vehicle parking space is marked out or designated upon a highway, every driver of a vehicle using the same shall park such vehicle wholly within the limits of the space.
203. No person shall park a vehicle for any period of time whatsoever at the following locations namely:
- (1) Upon any highway in front of any building in course of erection or repair when such parking will impede or obstruct traffic.
- (2) In any truck loading or unloading space properly marked by a sign.
- (3) Where the vehicle will in any way interfere with the use of a doorway intended as a fire or emergency exit from any building abutting the highway.
- (4) In the entrance way to any fire hall.
204. (1) Notwithstanding any other provision in this by-law, the Village Foreman may cause movable signs to be place on or near a highway, prohibiting parking for emergency purposes or street work cleaning.
- (2) (a) After such signs are placed on or near a highway no person shall park or leave a vehicle on the signed portion of highway for any part of the duration of the sign posting.
10. (b) Any vehicle that is on such roadway when such signs are placed thereon shall be removed promptly by its owner or operator.
- (3) (a) When any emergency snow removal or street cleaning commences on the signed roadway then the owner of any vehicle found thereon shall be charged with unlawful parking and the vehicle may be removed.
12. (b) The council is hereby authorized to designate that there should be no parking between 7:00 am - 8:30 am on the designated snow route.
205. (1) Except when actually taking or discharging passengers no person shall park a vehicle at the following locations:
14. (a) In a passenger loading or unloading space marked with a sign.
15. (b) On any portion of a highway marked by a sign as "No Parking".
- (2) No person shall park a vehicle between designated "School Bus Parking", between the hours of 8:30 a.m. and 9:30 a.m. and 2:30 p.m. and 4:30 p.m. Monday through Friday.
206. No parking in lanes shall be permitted, unless a sign directs otherwise but lanes may be used for:
18. (a) The loading or unloading of goods or passengers from a commercial vehicle for a period not exceeding thirty (30) minutes, or
19. (b) The loading or unloading of goods or passengers from a vehicle other than a commercial vehicle for a period not exceeding five (5) minutes, or
20. (c) That the vehicle concerned in such loading or unloading of passengers or goods does not so obstruct the lane as to prevent other vehicles or persons from passing along such lanes, while the loading or unloading of passengers or goods is taking place.
207. No person shall park any vehicle upon any land owned by the Village of Donnelly which the said Village uses or permits to be used as a playground, recreation area or public park, except on such part thereof as may be designated by a sign or signs for vehicular parking.
208. No person shall park any trailer for more than 72 hours (whether designated for occupancy by persons or for the carrying or of goods or equipment) upon any highway unless the said trailer is attached to a vehicle by which it may be propelled or drawn and when so attached the trailer shall be deemed part of the vehicle and subject to the regulations pertaining to vehicles.
209. No person shall angle park any vehicle or trailer which singly or together exceeds (5.80) meters / nineteen (19) feet in overall length upon any roadway except at such locations as have been designated either by a sign or in writing.
210. (1) No person shall park a vehicle upon any highway for more than 72 hours.
- (2) The foregoing restrictions shall not apply so as to prohibit such vehicle being parked on a highway for the purpose of unloading or loading of goods to or from premises abutting such highway proved that if the loading or unloading is taking place during a period of restricted visibility, then the vehicle and its trailer shall have all front and rear parking lights illuminated.

(3) No person shall operate or move over any highway any traction engine or public service or commercial vehicle having cleats or other devices attached to its wheels or made a part thereof which will injure the said highway except with the consent of the Administrator.
(4) No person shall operate or move upon, or over any highway that is surfaced with asphalt or concrete or is prepared with a base suitable for asphalt or concrete surfacing, any motor vehicle, tractor, traction engine or any other vehicle equipped to run on tracks and running on tracks except with the consent of the Administrator.
211. (1) No person shall park a vehicle or trailer used for the conveyance of flammable liquid, an explosive material, or other contents dangerous to human safety nearer than (15.24) meters / (50) feet to a substantial building likely to contain persons or valuable goods, and it shall have a warning notice clearly displayed.
(2) No person shall park a vehicle or a trailer used for the conveyance of flammable liquid or an explosive material upon a highway.
(3) This section shall not apply where a vehicle or trailer is obliged to be parked while making deliveries in the course of its ordinary business and having a warning notice clearly displayed.
212. The Council may at its discretion impose and lift a ban for vehicles exceeding a load weight of nine hundred ten (910) kilograms.
213. Council is hereby authorized to designate angle and parallel parking on any highway.
214. No person shall drive or park a vehicle on any boulevards.
215. (1) The Village of Donnelly is authorized to remove and have impounded or cause to be removed and impounded any Vehicle Parked in contravention of any provision of this Bylaw.
- (2) No impounded Vehicle shall be released to its Owner or his agent until the impounding charge and removal charge against the Vehicle has been paid.
- (3) The impounding charge and removal charge shall be in addition to any fine or penalty imposed by the provisions of this Bylaw, as per Schedule "A".
216. A person being in charge or control of a garage, service station, radio shop, auto dealership, or other premises where repairs or installations are made to vehicles for compensation shall not leave or cause or suffer or permit to be left on any street a vehicle which is left in his/her possession for carrying out of repairs or making installations or for any other purpose whatsoever.
217. No person shall repair any vehicle on a highway.
## PEDESTRIAN TRAFFIC:
301. No person shall cross any highway at a point where a sign prohibits such crossing.
302. No person shall stand, sit or lie on any highway in such a manner as to obstruct vehicular or pedestrian traffic or as to annoy or incommode any other person lawfully upon the highway.
## BICYCLES:
401. No person shall ride a bicycle on any sidewalk except where expressly permitted to do so by this by-law. Children's bicycles or tricycles having a wheel diameter of less than twenty (20) inches are exempted from this provision.
402. No person shall ride a bicycle on any highway after sunset unless the said bicycle is equipped with functional lighting equipment.
403. All bicycles must be equipped with light reflectors.

## GENERAL:
501. No person shall erect or cause to be erected, built or placed, a fence, wall, or other object on private property within fifteen (15) feet of a highway intersection, so that good visibility is interfered with.
502. (1) No person shall construct or cause to be constructed or erect any doorstep, porch, storm door, sign, awning or railing or other erection or obstruction or make or place any movable traps or doors for entrance to cellars which shall in any way encroach upon the sidewalks or highways without the consent of the Village Council.
- (2) No person shall dump, place abandon, unload or push any dirt, ice, snow or any other deleterious matter onto any street, alley or boulevard which in the opinion of the Village foreman in any matter obstructs or impedes traffic, or drainage.
503. No person shall pass beyond a point designated by a Police Constable or a member of the fire department near the location of a fire.
504. No person shall allow himself to be drawn by a moving vehicle while he is riding upon a sled, toboggan, bicycle, skis or other conveyance.
505. No person shall coast on a sled, toboggan or other conveyance except a bicycle, upon a roadway.
506. No person shall wash a vehicle upon a highway or so near a highway as to result in depositing mud or creating slush or ice upon a public sidewalk or roadway.
507. No person shall pour anti-freeze or any type of oil upon a highway.
