## BYLAW NO. 2026/01/P Name of Bylaw: Policing Committee Bylaw -2026/01/P
WHEREAS, the Municipal Government Act provides that a Council may, by bylaw, establish Council committees and other bodies and authorizes a Council to pass Bylaws;
AND WHEREAS, the Police Act and associated Regulations, provides that a municipality which has entered into a Municipal Police Service Agreement with the Government of Canada for the provision of policing services to the municipality by the RCMP shall establish a municipal policing committee;
AND WHEREAS, in accordance with the Police Governance (Ministerial) Regulation, the Government of Alberta has granted an exemption to the Town to forego joining a regional policing committee and to establish a local Municipal Policing Committee.
NOW THEREFORE the Council of the Town of Drayton Valley, duly assembled, hereby enacts as follows:
## TITLE
1. This Bylaw may be cited as the "Policing Committee Bylaw" of the Town of Drayton Valley.
## DEFINITIONS
2. In this bylaw, unless context otherwise requires:
2. 2.1. "Act" means the Police Act.
3. 2.2. "Administrative Liaison" means a Town staff member designated by the CAO to serve as the primary point of contact between the Town and the Committee.
4. 2.3. "Chair" means the person presiding at the Policing Committee Meeting.
5. 2.4. "Chief Administrative Officer" or "CAO" means the Chief Administrative Officer of the Town, or an employee of the municipality as designated by the CAO.
6. 2.5. "Committee" means the Town of Drayton Valley's Policing Committee.
7. 2.6. "Council" means the duly elected officials of the Town.
8. 2.7. "MPSA" means the Municipal Police Service Agreement between the Town and the Government of Canada for the provision of policing services by the RCMP.
9. 2.8. "Officer in Charge" means the officer in charge of the Drayton Valley RCMP detachment providing policing services to the Town.
10. 2.9. "Public Member" means an individual who is not a member of Council and is appointed by Council to the Committee.
11. 2.10. "RCMP" means the Royal Canadian Mounted Police
12. 2.11. "Town" means the Town of Drayton Valley in the Province of Alberta.
13. 2.12. "Vice-Chair" means the Committee member elected annually to fulfil the Chair's duties in the absence of the Chair.

## DUTIES, FUNCTIONS, RESPONSIBILTIES AND MANDATE
3. The specific duties and functions of the Committee will be set out in the Act and association Regulations, and by the Town through this bylaw.
2. The mandate of the Committee does not include direction of administration on programs, services, business plans, finances, funding or detachment structure.
5. The Committee will be an ambassador for the Town's policing services.
6. All members of the policing committee shall follow any policies and procedures established by Council, by resolution, in addition to requirements under the Act and associated Regulations.
## MEMBERSHIP
7. The Committee shall have no less than five (5) Voting Members and no more than seven (7) Voting Members and shall be comprised of:

3. 7.1.1. No less than one (1) and no more than two (2) members of Council;
4. 7.1.2. No less than three (3) and no more than six (6) Public Members.
5. 7.2. Advisory non-voting attendees:
6. 7.2.1. The Officer in Charge, or their designate;
7. 7.2.2. The Chief Administrative Officer, or their designate;
8. 7.2.3. Administrative Liaison;
9. 7.2.4. One (1) representative from the Youth Council over the age of 16 - Optional Appointment by Council;
10. 7.2.5. One (1) representative from Brazeau County over the age of 18 - Optional Appointment by Council.
11. 7.3. Provincially Appointed Members:
12. 7.3.1. As appointed by the Minister, at their discretion, in accordance with the Act and associated Regulations.
8. Appointments to the policing committee shall be made by resolution of Council, at the Organizational Meeting of Council.
9. The term of members shall be from January 15 of the year commencing after appointment to December 31s' of the second- or third year following appointment.
10. In the event that there is a membership vacancy on the policing committee that is not filled prior to January 15* (e.g., due to a resignation or lack of suitable candidates), Council may fill that vacancy at any other Council meeting but that appointment shall be with a term to expire December 315 of the two or three year appointment.
11. All members appointed to the policing committee must pass an enhanced security check, and meet any requirements as outlined in the Act and associated Regulations.
12. All Public Member appointee requirements:
6. 12.1. Public Member appointees shall meet any requirements as outlined under the Act and associated Regulations, and approved policies by Council.
7. 12.2. Public Members shall be residents of the Town of Drayton Valley.
8. 12.3. Public Members shall not be:
9. 12.3.1. A current employee of the Town.
10. 12.3.2. A member or employee of the RCMP, any Provincial or Municipal Police or Peace Officer service or agency.
11. 12.4. Public Member Appointments:
12. 12.4.1. Will be for no less than two (2) years and no more than three (3) years.
13. 12.4.2. May be staggered between two (2) to three (3) years to ensure continuity in the committee.
14. 12.4.3. May not exceed a cumulative total of more than nine (9) years unless approved by Council by special motion.
15. The Committee shall annually elect a Chair and Vice-Chair from the voting members. No Member shall serve as Chair or Vice-Chair for more than two (2) consecutive years. 12.5.
16. 12.6. A member who is a chief elected official (Mayor) of the Town is not eligible to be elected as chair or vice-chair of the policing committee.
17. 12.7. A member appointment to the policing committee may be revoked by council at any time, for cause, in accordance with the Act and associated Regulations, by resolution.
18. 12.8. If a person who is a member of Council is also appointed as a member of the policing committee, that person's appointment to the policing committee terminates on that person's ceasing to be a member of Council.
## EXPENSES AND REMUNERATION
13. Within budget, Committee Members may be eligible to attend related training subject to review and approval of the Chair and in consultation with the Administrative Liaison.
2. 13.1. Expenses will be reimbursed in accordance with Town policies.
3. 13.2. Expenses must be authorized by the Chair before being incurred and must be approved by the Chair before being reimbursed.
4. 13.3. The chair will confirm budget expenses with the Administrative Liaison before committing to an expense.
14. Members of the Committee will not be eligible for any remuneration for their time on the Policing Committee.
## POLICY MANUAL
15. Council may establish and approve, by resolution, a policy and or policy manual to govern, guide and assist the policing committee.
## MISCELLANEOUS
16. In the event of a conflict between the MPSA and this bylaw that cannot be resolved by application of rules of interpretation established by statute or common law, the provisions of the MPSA shall prevail over the provision of this bylaw.
17. This bylaw authorizes the consolidation of the Policing Committee Bylaw and all amendments thereto, in accordance with section 69 of the Municipal Government Act.
18. This bylaw authorizes a designated officer for the Town to make changes, without materially affecting the bylaw in principle or substance, to correct clerical errors, technical, grammatical or typographical errors in the Policing Committee Bylaw and all amendments thereto.
## SEVERABILITY
19. If any provision of this Bylaw is held be invalid by a court of competent jurisdiction, that decision will not affect the validity of the remaining provisions of the Bylaw.
NOW THEREFORE this Bylaw shall come into force and have effect from and after the date of third reading thereof.
