TOWN OF DRUMHELLER BY-LAW NO. 19.00 BEING A BY-LAW TO REGULATE THE DISCHARGE OF GUNS OR OTHER FIREARMS WITHIN THE CORPORATE BOUNDARIES OF THE TOWN OF DRUMHELLER IN THE PROVINCE OF ALBERTA PURSUANT to Section 7 of the Municipal Government Act, being Chapter M-26.1, R.S.A. 1994, as amended, the Council for the Town of Drumheller, duly assembled, enacts as follows: 1. This Bylaw shall be known as the "Discharge of Firearms Bylaw" 2. Definitions: a) "Council" means the duly elected officials of the Town of Drumheller; b) "Firearm" means any barrelled device from which any shot, bullet, or other missile can be discharged and that is capable of causing serious bodily injury or death to a person, and includes anything that can be adapted for use as a firearm; c) "Built-Up Area" means the residential, commercial and other areas of Nacmine, Drumheller, Rosedale, Wayne, Cambria, Lehigh and East Coulee as indicated on the attached plans referred as Schedule A. 3. No person shall discharge a firearm within the boundaries of any built-up area in the Town of Drumheller unless: a) The Council, through its Chief Administrative Officer, specifically authorizes a person(s) to lawfully discharge a gun or firearm in the Town where Council has obtained approval from the appropriate Federal or Provincial authorities as required by law; b) The use of a gun or firearm is in a shooting range which has been approved by the Solicitor General of Alberta or the Solicitor General of Canada; c) The use of a gun or firearm is at a site or place where problem wildlife is present and being hunted by a person or persons under the authority of a license issued for such purposes by the Natural Resources Division of Alberta Environment. 4. Section 3 does not apply to a Federal or Provincial law enforcement authority or duly appointed employees of the Department of Alberta Environment acting in their appointed capacity. 5. Any person who contravenes the provision of this Order shall be liable on summary conviction to a fine of not less than $300.00 and not more than $2,000.00 and in default of payment, to be imprisoned for a term not exceeding six months. By-law No. 19.00 Page 2 6. Bylaw No. 93.15 of the M.D. of Badlands No. 7 and Bylaw No. 5-85 of the City of Drumheller are hereby repealed. 7. That this by-law shall take effect on the date of the third and final reading. READ A FIRST TIME this 11th day of September , 2000. READ A SECOND TIME this 11th day of September , 2000.
