## BYLAW NO. 2023-03
(Garbage Collection Bylaw)
A BYLAW OF THE VILLAGE OF ELNORA, IN THE PROVINCE OF ALBERTA TO ESTABLISH A GUIDELINE FOR THE COLLECTION AND MANAGEMENT OF GARBAGE WITHIN THE VILLAGE AND RESCINDS BYLAW NO. 2021-03.
WHEREAS the Council of the Village of Elnora is responsible for the direction and control of its garbage collection and disposal.
NOW, THEREFORE THE COUNCIL OF THE VILLAGE OF ELNORA, DULY ASSEMBLED, ENACTS AS FOLLOWS:
## 1.0 BYLAW TITLE
- 1.0 This Bylaw shall be known as the Garbage Collection Bylaw.
## 2.0 DEFINITIONS
- that: 2.0 In this Bylaw, words have the meanings as set out in the Municipal Government Act, except
- a) Chief Administrative Officer means the person appointed by Council as the Chief Administrative Officer for the Village of Elnora or a person delegated to act in said role;
- b) Council means the Council of the Village of Elnora
- c) Village means the municipality of the Village of Elnora in the province of Alberta;
- d) Containers mean any receptacle to secure garbage or automated cart-based unit for mechanical pickup;
- e) Garbage bags mean standard sized garbage bags (73 X 116 cm / 29 X 46 inches) or smaller, intended for that purpose
## 3.0 CONTAINERS
- 3.0 Containers required for the storage or to facilitate the mechanical pickup of refuse may be required as directed by the Chief Administrative Officer of the Village.
## 4.0 GARBAGE GUIDELINES
- 4.0 Limited to household garbage only for residential properties
- 4.1 Garbage container lids must be closed.
- 4.2 All garbage must be bagged, no loose garbage permitted.
- 4.3 All garbage must be placed inside the garbage tote for pickup.
- 4.4 If required, additional tote(s) can be arranged through the Village Office
## 5.0 PICKUP SITE
- 5.0 Designated sites for garbage pickup must not interfere with vehicular or pedestrian traffic or cause a nuisance to neighboring properties.
- 5.1 Garbage containers must be sited 3 meters from any obstructions (along the front curb).
## 6.0 PICKUP SCHEDULE
- 6.0.1 Should a disruption occur, notice will be posted on the Village website advising of the change in scheduling.
- 6.0 A regularly scheduled pickup will be set. To facilitate pickup garbage is to be set at the designated site by 7:00 am that morning.
## 7.0 APPLIANCE PICKUP
- 7.0 The Village shall schedule appliance pickup dates in the spring and fall of each and every year to pick up discarded appliances at the resident's property upon request for a fee as determined by Council.
## 8.0 RECYCLING
- 8.1 The Village has contracted recycling of specified materials on a scheduled basis.
- 8.1.1 Should a disruption occur, notice will be posted on the Village website advising of the change in scheduling.
- 8.2 To facilitate pickup, recycle boxes may be purchased at the Village Office at a recovery cost.
## 9.0 GRASS CLIPPINGS & TREE BRANCHES
- 9.1 The Village will arrange for bins to be available annually, spring through fall (start up and shut down dependent upon weather) for residents to dispose of tree limbs and grass clippings in the bins marked accordingly at no cost.
## 10.0 GARBAGE FEES
10.1 Fees are established by Council by bylaw and determined by zoning and use of property.
11.0 THAT this Bylaw shall take effect Naumar 14, 2023
