Village of Empress
BYLAW NO. 2022-10
BEING A BYLAW OF THE VILLAGE OF EMPRESS, IN THE PROVINCE OF
ALBERTA TO PROVIDE FOR THE REVIEW and SETTING OF FEES, as required, BY
RESOLUTION OF COUNCIL
WHEREAS it is deemed appropriate to review costs associated with delivering
municipal services and those set out by schedules and appendices in utility and traffic
bylaws;
AND WHEREAS Section 7 of the Municipal Government Act, R.S.A. 2022, as amended,
provides that a Council may pass bylaws respecting services provided by or on behalf of
the municipality;
AND WHEREAS, Section 8 of the Municipal Government Act, R.S.A. 2022, as amended
notes that Council can provide for a system of licenses, permits or fees that may be in
the nature of the activity authorized by bylaw or by resolution for the purpose of raising
revenue;
NOW THEREFORE, the Council of Village of Empress, duly assembled, enacts as follows:
1.
Section 1 - Short Title:
1.1
This Bylaw may be cited as the Village of Empress Fee Review Bylaw.
2.
Section 2 - Definitions:
In this Bylaw,
2.1
"Village" - means Village of Empress
2.2
"Council" - means the duly elected Council of the Village of Empress
3.
Process for the Review and Amending of Fees:
3.1
Council shall review annually, all administrative fees,
and all fee schedules of all bylaws related to provision of Utilities,
Development, Licensing or Traffic Control for the Village.
3.2
Council may by resolution amend all said fees as required, from time to
time, at any regular meeting of Council.
4.
Coming into Force:
4.1
This Bylaw shall come into force and effect on the date of passage of this
bylaw.
5.
General
5.1
If any provision of this Bylaw is declared or held to be invalid, that
provision shall be deemed to be severed, and the remainder of the Bylaw
shall remain in force and effect.
