BYLAW NO. 25-13 TOWN OF FALHER A BYLAW OF THE TOWN OF FALHER IN THE PROVINCE OF ALBERTA FOR THE PURPOSE OF ESTABLISHING FEES FOR THE PROVISION OF MUNICIPAL SERVICES AND UTILITIES WHEREAS pursuant to Sections 7, 8(1)(c), and 61 of the Municipal Government Act, being Chapter M-26 of the Revised Statutes of Alberta, 2000, and amendments thereto (hereinafter referred to as "the Act"), Council may pass a bylaw establishing fees for the provision of municipal services and utilities; AND WHEREAS the Council of the Town of Falher deems it desirable to charge fees for the provision of various municipal services, utilities, and licenses, permits, or approvals; NOW THEREFORE, under the authority of the Act, the Council for the Town of Falher in the Province of Alberta duly assembled, enacts as follows: 1. TITLE a. This Bylaw may be cited as the "Fees and Charges Bylaw" 2. SEVERABILITY a. If any provision of this Bylaw is declared invalid, in whole or in part, by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions of this Bylaw, which shall continue in full force and effect. 3. FEES a. The fees for municipal services, utilities, and the issuance of licenses, permits, or approvals shall be set out in Schedules A, B, C, D, E, F,G, and H, attached to and forming part of this Bylaw, as applicable b. All fees established under this Bylaw are subject to GST unless otherwise indicated. 4. EFFECTIVE DATE a. This bylaw shall come into force and effect when it receives third reading and is duly signed. 5. REPEAL a. Everyone is welcome to use the baseball diamonds for general use. In scenarios beyond basic public use, including but not limited to large scale events, festivals, or tournaments, the Town of Falher reserves the right to require additional considerations from users including but not limited to a signed agreement, proof of insurance, financial deposit, fees appropriate to the scope of the event, and cleaning/remediation fees. Goods and services listed within this Bylaw are for cost recovery for local regional service delivery, in addition to exigent, uncommon, exceptional, or individual matters.
