## THE CORPORATION OF THE TOWN OF FOX CREEK, ALBERTA BY-LAW 806-2018-A01
## "TRAFFIC CONTROL BYLAW AMENDMENT 01"
## Being A Bylaw of the Town of Fox Creek, in the Province of Alberta, to amend the Town of Fox Creek Bylaw 802-2018;
WHEREAS, the Traffic Safety Act, RSA 2000, c. T-6, authorizes a municipal council to, with respect to a highway under the Municipality's direction, control and management, make bylaws that are not inconsistent with the Traffic Safety Act;
WHEREAS, the Council of the Town of Fox Creek deems it desirable to amend the Traffic Control Bylaw 806-2018;
THEREFORE, the Council of the Town of Fox Creek enacts as follows:
## SECTION 1 - AMENDMENT
- 1.1 The Town of Fox Creek Bylaw 806-2018 Traffic Control Bylaw, is hereby amended as follows:
- 1.1.1 The following definitions will be added to Part 1 - Definitions:
- 1.1.1.1 "Approved Driveway" means a hard-surfaced driveway that has an approved development permit from the Town of Fox Creek.
- 1.1.1.2 "Commercial Vehicle" means any vehicle that is registered as a commercial vehicle and/or is over 7500 kg GVW.
- 1.1.1.3 "Highway" means any thoroughfare, street, road, trail, avenue, parkway, driveway, viaduct, land, alley, square, bridge, causeway, trestleway, or other place or any part of any of them, whether publicly or privately owned, that the public is ordinarily entitled or permitted to use for the passage or parking of vehicles and includes:
- a. A sidewalk, including a boulevard adjacent to the sidewalk
- If a ditch lied adjacent to and parallel with the roadway, the ditch, and
- c. If a highway right of way is contained between fences or between a fence and the edge of the roadway, as the case may be, but does not include a place declared by regulation not to be a highway.
- 1.1.2 The following will be added to Part 2 - Rules for Operation of Vehicles
- 1.1.2.1 2.1.0 Shall be added and will read: Fail to Comply with Peace Officer Direction. For the purpose of administering this bylaw, a Peace Officer may direct a driver, registered owner, property owner or anyone in care and control or causing an offence listed in this bylaw. Failure to follow the Peace Officer direction will result in a fine of $350.00 for the first offence, $450.00 for the second offence and $550.00 for each continuing offence thereafter.
- Part 6 - Parking, Section 6.2.1 no person shall park a vehicle at any of the following locations, is amended by adding the following:
- 1.1.3.1 In any place or area where they are parked in a manner that impedes snow removal operations.
- 1.1.3.2 On unauthorized private property.
- 1.1.4 Part 6 - Parking, Section 6.4 No Parking, is amended by adding the following:
- 6.4.2 No person shall improperly parallel park (left wheels to the curb) any vehicle, including commercial vehicles.

- 1.1.5 Part 6 - Parking, Section 6.13 Parking of Recreational Vehicles, is amended to read as follows:
- 1.1.5.1 Section 6.13.2 will read: A Recreational Vehicle may be parked in a residential district providing the vehicle is contained entirely within the residents' property line. The recreational vehicle must be parked no closer than 2 metres from the interior edge of he sidewalk, or within 2 metres from the curb in the event there is no sidewalk
- 1.1.5.2 Section 6.13.5 will be added to read: A recreational vehicle or utility trailer shall only be parked on a designated driveway and must meet all requirements of Part 6.13 listed above.
- 1.1.6 The following fees will be added to Schedule X Specified Penalties:

## SECTION 2 - EFFECTIVE DATE
- 11.1 This Bylaw shall come into effect upon the day of third and final reading.
