BYLAW # 554-24
OF THE VILLAGE OF HEISLER
IN THE PROVINCE OF ALBERTA
BEING A BYLAW OF THE VILLAGE OF HEISLER IN THE PROVINCE OF ALBERTA
TO REGULATE THE OPERATION OF AN OFF-LEASH DOG AREA.
WHEREAS by-laws may be passed, pursuant to Section 7h) of the Municipal
Government Act, for wild or domestic animals and the activities in relationship to them.
NOW THEREFORE THE COUNCIL OF THE VILLAGE OF HEISLER HEREBY
ENACTS AS FOLLOWS:
1. Definitions
a. "Off Leash Dog Area" shall mean a fenced area of land for which signs are
posted indicating that dogs are permitted to run at large all year round.
b. "Owner/handler" includes any person who owns, keeps, possesses,
harbors or acts as a guardian of a dog for any length of time, whether or
not that person has a license for the dog, and where the owner is a
minor, the person responsible for the custody of the minor.
2. A dog owner may permit their dog, or any successor bylaw thereto, to run at large in
an Off-Leash Dog Park Area all year round.
3. Owners of dogs whose dogs are required to be muzzled and secured by a leash,
including any dog deemed as a "Dangerous/Vicious Dog", may not permit the dog that is
required to be muzzled to run at large in the Off-Leash Dog Park Area and must be
secured by a leash.
4. Aggressive Dogs are not permitted in the Off-Leash Dog Park Area. Persistent
aggressive action by dogs or people will not be permitted.
5. No person shall permit a dog to run at large, unless that person is in the Off-Leash
Dog Park Area, within sight of the dog and under verbal control at all times.
6. No person shall play or practice any "organized" sporting activity except walking within
an Off-Leash Dog Area, without prior permission of the Village of Heisler.
7. No person shall convey to or on, or enter or be on any area in an Off-Leash Dog Park
Area while in the possession of any bottles, containers or any other articles, equipment,
or utensils, made of glass, china, ceramic or other breakable substance capable of
causing injury to a dog.
8. No person shall permit any animal other than a dog of which he/she is the
owner/handler to be at large in an Off-Leash Dog Park Area.
9. No person shall enter the Off-Leash Dog Park Area with more than 2 dogs per
handler. An owner/handler aged 14 or older must be present and in control of their dogs
at all times.
10. Owners/handlers must abide by the Off-Leash Dog Park Rules as outlined in
Schedule A attached to this Bylaw.
11. Owners/ handlers must stoop, scoop and dispose of excrement left by their dog.
12. The Enforcement Officer may deny access to any dog that he deems as a nuisance
at any time. That dog will NOT be permitted to re-enter the park without written notice
from the Enforcement Officer.

13. Any person who contravenes the provisions of this Bylaw is guilty of an offence and
upon conviction thereof is subject to the penalty as follows:
i. the sum of Sixty ($60.00) Dollars in respect of a first offence;
ii. the sum of One Hundred ($100.00) Dollars in respect of a second offence;
iii. the sum of One Hundred and Fifty ($150.00) Dollars in respect of a third and
subsequent offence;
14. The terms and provisions of this Bylaw shall be severable and should any term or
provision be found by a court of competent jurisdiction to be legally unenforceable,
inoperative or invalid, the remainder of the Bylaw shall continue to be in full force and
effect.
15. That Schedule A forms part of this Bylaw.
This Bylaw shall come into full force and effect upon the final passing thereof.

SCHEDULE A
BYLAW 554-24 OFF LEASH DOG PARK RULES OF USE
The purpose of these rules is to make sure all users enjoy the park, and ensure
the safety of the users and their pets.
1. The park will be open 24 hours a day.
2. Dogs must have current dog tags, or proof of registration and vaccinations.
3. Dogs must be leashed when entering and exiting the park.
4. Aggressive dogs will not be permitted in the park.
5. Dogs classified as a Dangerous Dog, as per Bylaw 468-12, or any animal that
the Enforcement Officer deems as aggressive must be muzzled and are not
permitted to run at large in the Off-Leash Dog Park Area.
6. Female dogs in heat are prohibited from entering the park.
7. Dog owners must be in the park and within view of their dogs at all times.
Please do not bring more than two dogs to the park at one time to ensure you
have control over your dogs. Be ready to take control of any situation, you are
responsible for your dog's behavior.
8. As per Bylaw 468-12, owners must clean up after their dogs, and deposit waste
in designated containers. It is possible that you missed picking up after your
pet, so next time you pass an item that needs cleaning up, please pick it up to
maintain the park.
9. Failure to abide by park rules will result in loss of privileges
10. Some dogs exhibit unpredictable behavior around small children. For safety of
children please do not bring children in to the dog park unless closely
supervised.
11. The Dog Park is for dogs, their owners/handlers and those accompanying them.
THIS IS NOT A CHILDREN'S PLAYGROUND. Children under 12 must be
accompanied by an adult at all times and kept under strict supervision. Do not
allow children to run in the area and chase after dogs.
12. Owners of a dog are responsible for the acts and conduct of their animal at all
times when it is in the park. Park users and dog owners assume all risks related
to the use of the dog park.
13. Fill in any holes created by your dog, or make appropriate repairs to disturbed
areas.
14. If a large event is planned in adjoining parks, the off-leash area may be closed.
