## Town of High Prairie ## Bylaw No. 08-2019 ## A BYLAW OF THE TOWN OF HIGH PRAIRIE IN THE PROVINCE OF ALBERTA TO ESTABLISH THE DEVELOPMENT AUTHORITY FOR THE TOWN OF HIGH PRAIRIE ## WHEREAS WHEREAS WHEREAS NOW THEREFORE Section 624(1) of the Municipal Government Act, Revised Statutes of Alberta 2000, Chapter M-26, and amendments thereto, requires the Council of a Municipality to by bylaw provide for a development authority to exercise development powers and perform duties on behalf of the municipality; and Pursuant to section 624 of the Municipal Government Act, RSA 2000 Chapter M 26, a development authority may include a Designated Officer, a Municipa Planning Commission or any other person or organization; and The Town of High Prairie has a Development Officer and a Municipal Planning Commission to exercise development powers and duties on behalf of the Town; Pursuant to section 624(1) of the Municipal Government Act, RSA 2000 Chapter M-26, Council of Town of High Prairie, in the Province of Alberta, duly assembled, hereby enacts as follows: ## TITLE - This bylaw may be cited as the "Development Authority Bylaw". ## PURPOSE - The purpose of this bylaw is to establish the Development Authority for the Town of High Prairie. ## DEFINITIONS 3. In this Bylaw, - a) "Act" means the Municipal Government Act, being Chapter M-26, RSA 2000, as amended from time to time. - b) "Council" means the duly elected Council of the Town of High Prairie. - c) "Development Authority" means the persons established under Section 4 of this bylaw to exercise development powers and duties on behalf of the Town of High Prairie. <!-- image --> · ## ESTABLISHMENT - The Development Authority for the Town of High Prairie is hereby established. 5. The Development Authority for the Town of High Prairie is: - 5.1 The Development Officer for the Town of High Prairie; and - 5.2 The Municipal Planning Commission for the Town of High Prairie. ## POWERS, DUTIES AND FUNCTIONS - The powers, duties and functions of the Development Authority shall include: - 6.1 the powers, duties and functions of the Development Officer, as prescribed in the Land Use Bylaw of the Town of High Prairie; and - 6.2 the powers, duties and functions of the Municipal Planning Commission, as prescribed in the Land Use Bylaw of the Town of High Prairie. ## SEVERABILITY 7. If any portion of this bylaw is declared invalid by a court of competent jurisdiction, then the invalid portion shall be severed and the remainder of the bylaw is deemed valid. ## EFFECTIVE DATE ## Town of High Prairie ## Bylaw No. 08-2019 ## A BYLAW OF THE TOWN OF HIGH PRAIRIE IN THE PROVINCE OF ALBERTA TO ESTABLISH THE DEVELOPMENT AUTHORITY FOR THE TOWN OF HIGH PRAIRIE - d) "Development Officer" means the Chief Administrative Officer or a person delegated by the Chief Administrative Officer to exercise development powers and duties on behalf of the Town of High Prairie. - e) "Land Use Bylaw" means the Town of High Prairie Land Use Bylaw, as established in accordance with the Act. 3. "Municipal Planning Commission" means the Town of High Prairie Municipal Planning Commission, as established by Bylaw No. 17/2001 to exercise development powers and duties on behalf of the Town of High Prairie, in accordance with the Act. - g) "Town" means the corporation of the Town of High Prairie. <!-- image --> <!-- image --> ## Town of High Prairie ## Bylaw No. 08-2019 ## A BYLAW OF THE TOWN OF HIGH PRAIRIE IN THE PROVINCE OF ALBERTA TO ESTABLISH THE DEVELOPMENT AUTHORITY FOR THE TOWN OF HIGH PRAIRIE 8. This Bylaw shall come into full force and effect upon the date of its final passing thereof. READ a First time this 14th day of May, 2019. READ a Second time this 14th day of May, 2019.
