TOWNOF HIGHRIVER INTHEPROVINCEOFALBERTA BYLAW4567/2019 -- ANIMALBYLAW A BYLAWOF THETOWNOF HIGHRIVERTO PROMOTERESPONSIBLEANIMALOWNERSHIPANDTO CONTROL,REGULATE,ANDLICENSEANIMALSWITHINTHETOWNOF HIGHRIVER. WHEREASpursuant to Section 7(a) of the Municipal Government Act, a Council may pass bylaws for municipal purposes respecting the safety, health and welfare of people and the protection of people and property; ANDWHEREASpursuant to Section 7(h) of the Municipal Government Act, a Council may pass bylaws for municipal purposes respecting wild and domestic Animals, and activities in relation to them; ANDWHEREASpursuant to Section 7(i) of the Municipal Government Act, a Council may pass bylaws for municipal purposes respecting the enforcement of bylaws made under the Municipal Government Act or any other enactment including any or all of the matters listed therein; ANDWHEREASpursuant to Section 8 of the Municipal Government Act, a Council may regulate or prohibit, and provide for a system of licences, permits or approval including any or all of the matters listed therein; ANDWHEREASthe Animal Health Act, the Animal Protection Act, the Bee Act, the Dangerous Dogs Act, the Service Dogs Act, the Wildlife Act, and the WildAnimal and Plant Protection Regulation of International and lnterprovincial Trade Act, govern care, consideration, and treatment of Animals; ANDWHEREASthe Pest and Nuisance Control Regulation, the WildAnimal and Plant Trade Regulations, and the Wildlife Regulation further regulate care, consideration, and treatment of Animals; ANDWHEREASthe Provincial Offences Procedure Act sets forth procedures for dealing with offences related to the previously named Acts and Regulations; ANDWHEREASthe Council of the Town of High River considers it expedient to promote responsible Animal Ownership and to control, regulate, and License Animals within the Town of High River; NOWTHEREFORE,the Town of High River Council, duly assembled, enacts as follows: -- Purpose 1. The purpose of this Bylaw is to promote responsible Animal Ownership and to control, regulate, and License Animals within High River. Short Title 2. This Bylaw may be cited as the "Animal Bylaw". Definitions 3. Words used in this Bylaw have the same meaning as defined in the Municipal Government Act, with the following changes or additions. Where no definition is provided in the Municipal Government Act, the Alberta Interpretation Act, or this Bylaw, Webster's New Collegiate Dictionary shall be used. (a) "Animal" means any bird, reptile, amphibian, or mammal excluding humans. (b) "Animal Services Centre" means the facility established for the holding, safekeeping, and care of Animals in accordance with the provisions of this Bylaw. (c) "Apicu|ture" means the keeping and management of Bees. (d) "Attack" means an assault by an Animal upon a person or other Animal consisting of more than one Bite, peck, or scratch which results in injury to that person or Animal. (e) "Bee" or "Bees" means the insect Apis mellifera L. (f) "Beekeeper" means a person who owns and possesses Bees or Beekeeping equipment or both. 1|Page Town of High River Bylaw 4567/2019 -. -. (h) "Bylaw" means Bylaw 4567/2019 also known as the "Animal Bylaw", which is this Bylaw. (i) "CAO"means the Chief Administrative Officer for the Town or their delegate. (1') "Cat" means any domesticated Animal of the feline species. (k) "Cemetery" means land within the Town which is managed and controlled by the Town that is set apart or used as a place for the burial of human remains. () "Controlled Confinement" means the confinement of an Animal in a pen, cage, or other structure having: (i) secure sides and a secure top, (ii) the bottom secured to the sides or the sides embedded in the ground to a minimum depth of thirty (30) centimetres, (iii) minimum dimensions of 1.5 metres by 3.0 metres, and (iv) a minimum height of 1.5 metres. (m) "Coop" means a fully enclosed weather proof structure and attached Outdoor Enclosure used for the keeping of Urban Chickens. (n) "Council" means the governing body of the Town of High River. (0) "Court" means a Court of competentjurisdiction in the Province of Alberta. 2|Page Town of High River Bylaw 4567/2019 "Dangerous Do g" any Dog of any age, species, or breed, whether on public or private property, has been declared tobe aDangerous Dog pursuant tothe provisions of thi s pursuant tothe provisions of aBylaw of another municipality, or any Dog that hasb e e n subject toan order issued by aJustice pursuant tothe Dangerous DogsDecla ration of aDog being aDangerous Dog isvalidated upon the Owner receiving no tic e subject toSections 55 and 56 ().Hearings and Orders "Dog" means any domesticated Animal of the canine species. "Exotic Pet" means an Animal that is of foreign origin or character; not native; intr odu ced from abroad but not fully naturalized. Exotic Pets are restricted by federal legislatio n, including the Wild Animal and Plant Trade Regulations and the Wild Animal and Pl a nt Protection and Regulation of nternational and lnterprovincial Trade Act. "Former Owner" means the person who, at the time of seizure, was the Owner of a Animal which has subsequently been sold or destroyed. "Foster Animal" means an An mal placed in a person's custody on a temporary ba sis by an Animal rescue group or humane society. "Green Space" means any park space, whether manicured or natural, which is municipally owned and is not a Play Surface or Sport Field, including the paved an d unpaved pathway network, formal and informal parks, and community gardens. "Guardian" means the person responsible for behavioural guidance and Physical of an Animal at any time, including: (i) has possession, custody, or care and control of the Animal, either temporarilyor permanently, (ii) has actual or apparent possession or control of the property where an Anim al resides or is allowed to stay, (iii) who harbours the Animal or allows the Animal to remain on his premises, or (iv) who is the registered Owner of a motor Vehicle in which the Animal is found is being transported. "Heat" means a recurring period of sexual receptivity in many female mammals, including Dogs. "Hen" means a domesticated female chicken. "Hive" means an enclosed, man--made structure in which Bees live and raise their "Land Use Bylaw" means the Land Use Bylaw of the Town of High River. "Leash" means a line, strap, or cord that is adequate to control the Animal to which it is attached and that is securely attached to the Animal by a co lar or harness. "License" means official permission for Animal Ownership wthin High River municipal boundaries as outlined in this Bylaw, including Bees, Chickens, Dogs, and Dangerous Dogs. "Livestock" includes, but is not limited to: (i) a horse, mule, ass, swine, emu, ostrich, camel, llama, alpaca, sheep, or goat, (ii) domestically reared or kept deer, reindeer, moose, elk, or bison, iii) farm bred fur bearing Animals including foxes or mink, ( (iv) Animals of the bovine species, (v) rabbits raised for meat, (vi) Animals of the avian species intended for human consumption, including chickens (unless they adhere to the requirements set in this Bylaw for Urban Chickens), turkeys, ducks, geese, or pheasants, and (vii) all other Animals or insects that are kept for agricultural purposes (except for Urban Bees as regulated in this Bylaw). "Microchip" means a traceable implant injected into an Animal by a licensed veterinarian or Animal health technician. "Muzzle" means a humane device of sufficient strength placed over an Animal's mouth to prevent it from Biting. "Nuisance Dog" means a Dog declared to be a Nuisance Dog in accordance with Sections 50 through 52 ( ) of this Bylaw. "Off-Leash Park" means an area designated by the Town where a Dog or Nuisance Dog "Outdoor Enclosure" means a securely enclosed, roofed outdoor area attached to and forming part of a Coop, having a bare earth or vegetated floor for Urban Chickens to roam. "Owner" includes the responsibilities of a Guardian, and means any person who: (i) has legal title to the Animal, is named on a License for the Animal or can provide proof of Ownership of the Animal, (ii) who claims and receives an Animal from the custody of the Animal Services Centre, (iii) to whom a License tag was issued for an Animal in accordance with this Bylaw, or (iv) a person who operates an Animal adoption program and who has care, charge, custody, possession, or control of an Animal(s). "Owner's Property" means any property in which the Animal Owner has a legal or equitable interest, or which is otherwise under the control or is in the possession of the Animal Owner, and which property shall include land, buildings, and Vehicles. "Peace Officer" means a person engaged by the Town as a Community Peace Officer, a Bylaw Enforcement Officer, a Designated Officer, or a member of the Royal Canadian Mounted Police to carry out the provisions of this Bylaw. "Physical Control" means: (i) restrained by a Leash not exceeding three (3) metres in length which is securely held by a competent and physically capable person, or (ii) kept in a container, an enclosure, or a motor Vehicle. Nuisance Dogs (2) "Justice" means a Justice of the peace or a judge of the Court, as defined in the Provincial Offences Procedure Act. (00) "Public Space" means any municipally owned property or asset, including Green Spaces, Play Surfaces, Sport Fields, roads, and sidewalks. (pp) "Rooster" means a domesticated male chicken. (qq) "Running at Large" means any Animal not under Physical Control and not contained within the Owner's Property or other permitted property. (rr) "School Ground" means the Green Space adjacent to a school. (ss) "Service Dog" has the same meaning as stated in the Service Dogs Act and includes guide Dogs trained as a guide, as defined in the Blind Persons' Act. Service Dogs help people with specific tasks relating to visible and non--visib|e disabilities, including epilepsy, PTSD, diabetes, mobility, or other limitations. Handlers of Service Dogs and guide Dogs should carry appropriate identification with them when out in the community or in Public Spaces. (tt) "Severe Injury" means any physical injury that requires greater medical attention than wound cleaning and basic first aid. This includes wounds requiring sutures or surgery, disfiguring scars or lacerations, broken bones, severe sprains, or similar serious injury. (uu) "Special Event" means any event subject to the Town's Public Realm Policy or Special Event permit process. (W) "Sport Field" means an outdoor area which is set apart and used for general fitness or the playing of sporting activities, including: (i) running tracks, (iii) fitness parks, where outdoor fitness equipment has been installed for public use, and (aaa) (bbb) "Wildlife"means big game, birds of prey, fur-bearing Animals, migratory game birds, non- game Animals, non--licenceAnimals and upland game birds, and includes any hybrid offspring resulting from the crossing of two Wildlife Animals or that belong to the Crown, as defined in the Wildlife Act. Interpretation 4. Headings and sub--headings in this Bylaw are included for convenience only and shall not be considered in interpreting the substantive content of this Bylaw. 4 | P a g 9 Town of High River Bylaw4567/2019 (iv) formal and informal sporting field sur fac es intend ed for competitive and recreational sporting activities and u se ( fo r examp le, soccer flats, football fields, and baseball diamonds). "Town" means the municipal corporation ofTow n of High River. "Urban Bees" means one or two Hives of B ee s kept for non-- commercial, personal purposes, as outlined in this Bylaw. "Urban Chicken" means one, two, or three that are ateast 16 weeks ofage and are kept for non--commercial, personal purp oses as outlined inthis Bylaw. "Vehicle" means a device in, on, or by whic h aper son or thing may be transported or drawn on a Highway and includes a combin ation of Vehicles but does not include a mobility aid, as defined in the Traffic Safety "Violation Ticket" has the same meaning asithe Provinc ial Offences Procedure Act and is issued in accordance with that Act. Allschedules as attached to this Byl aw for m part of this Bylaw. Every provision of this Bylaw is indep ende nt of all provisions and itisthe intention of the Council that if any provision of this isdeclare d invalid by aCourt of competent jurisdiction, all other provisions of th is B yl a w shall remain valid and enforceable. Nothing in this Bylaw relieves a pers on fro m complyi ng with any Federal or Provincial law or regulation, other Town Bylaw, or any of any lawful permit, order, or licence. References in this Bylaw to an Act, s t a t u t e , regulati on, or other Bylaw refer tothe current laws and legislation, as amended or repla ced from time totime, including successor legislation. This Bylaw is gender--neutral and, ac co rdi ng ly, any reference toone gender includes the other. The word "shall" is mandatory and n o t m er el y directory. PART2 -- PERMITTEDANIMALSANDGENERALREQUIREMENTS Permitted and Prohibited Animals and Exceptions 12. Subject to the provisions of this Bylaw, Animals which are permitted may be kept within Town boundaries, including: 13. (8) (b) (C) (d) 14. Exceptions to Section domestic pets, such as Dogs and Cats, caged pets that fall within provincial and federal guidelines; rats are not permitted as pets in Alberta (see the Pest and Nuisance Control Regulation), and specific Livestock, under regulations laid out within this Bylaw: (i) Urban Bees, and (ii) Urban Chickens. any type of pigeon, Wildlife, Exotic Pets, and Livestock, except as permitted within this Bylaw. include: facilities where Livestock are temporarily housed for educational, veterinary, scientific, or CIVIC purposes, for permitted Special Events, such as parades or filming, and specific areas as shown in , in which case regulations for keeping Animals and Livestock are congruent with the rules, guidelines, and requirements set out by Foothills County, as updated or amended from time to time. 15. Animal Owners are responsible for the behaviour of their Animal on private and public property. (8) (b) Town of High River provide the necessary care for their Animal, as stated in the Animal Protection Act, including: (i) ensure that the Animal receives food, water, and maintain the Animal in good health, (ii) provide appropriate shelter for the temperature and weather conditions, and (iii) provide the Animal with adequate care when the Animal is wounded or ill; and also not crate or kennel an Animal without ensuring the health and welfare of the Animal by at least; 5|Page Bylaw 4567/2019 ithin Town boundaries Schedule F obtain a License for theirAnima|(s) No person shalljive false information when aunlvine for a License pursuam to this Bvlaw (i) providing adequate sustenance for the temperature and time period in which the Animal will be in the crate or kennel, (ii) providing adequate ventilation for the temperature and time period in which the animal will be in the crate or kennel, and (iii) providing adequate space that the Animal may stand up and turn around while in the crate or kennel. Town of High River The Owner of an Animal or Animals shall this Bylaw, unless provided an exception under Section as specified in or Sect on Licenses are required for: (a) Dangerous Dogs, in all areas of High River, and (b) Dogs, (c) Urban Bees, and (d) Urban Chickens except for specific properties, as outlined in When applying for a License under this Bylaw, the Owner of the Animal must provide: (a) a description of the Animal(s) including breed, name, gender, age, and physical description, (b) the correct name, address, and contact telephone number of the Owner, (c) where the Owner is a corporate body, the name, address, and telephone number of the natural person responsib|e'forthe Animal, (d) if applicable, information establishing that the Dog is Neutered, Spayed, or Intact, (e) if applicable, information of a previous decision establishing the Dog as a Nuisance, (f) if applicable, information of a Justice declaring the Dog to be Dangerous, (h) the applicable annual License fee for each Animal or group of Animals, as set out in the current Town of High River Rate Bylaw. The holder of an Animal License must: (a) be at least eighteen (18) years of age, (b) renew the License annually, and (c) pay the fee for a License prior to receiving the License. Animal License holders understand that: (a) a License issued pursuant to this Bylaw is not transferrable to another Owner(s) or Animal(s), (b) a License issued underthis Bylaw is non--refundable, (c) a License purchased by an uncertified cheque is subject to a non--sufficientfunds (NSF) cheque fee, as stated in the current Town of High River Rate Bylaw and a License purchased with an NSF cheque will be void or revoked, (d) a License can be suspended or revoked, without refund or compensation, at any time if the Peace Officer determines that there is non--comp|iance with this Bylaw or the applicable License or License application, (e) an Owner with a revoked License can reapply for a new License but must show compliance with all requirements and pay all applicable fees, and (f) an Owner is required to notify the municipal office immediately of any change of any information provided in an application for a License under this Bylaw. 6|Page Bylaw 4567/2019 Schedule F 14 18 (ggneral Licensing Reguirements Appeals 23. Any Owner who has been informed that: (a) any Licence issued underthis Bylaw has been revoked or cancelled, or (b) the Dog has been determined to be a Nuisance Dog PART3 -- RESPONSIBLEANIMALOWNERSHIP 7|Page Town of High River Bylaw 4567/2019 24. may appeal the tothe Peace Officer, inwriting, with nfourteen (14) days of being notified th at th e Licenc e has been revoked or cancelled, or that the Dog has been determined to b e aNu isa nc e Dog. Within thirty (30) of receiving anotice of appeal by an Owner pursuant toSection ,the Peace Officer sh all re vi ew the revocation or declaration and receive such information as inthe opinion of the P ea ce Offi cer, isrelevant and determine whether there are just and reasonable grounds to revok e or canc el aLicence or confirm or revoke the Nuisance Dog declaration and the decision of t h e Pe ac e Officer shall be final. Dog Licensing 25. 26. 27. 28. 29. 30. in addition to Sections 17 through 22 ), Dog Owners are also required to follow specific regulations. An Owner of a Dog must obtain a License for the Dog on the first day the municipal office is open: (a) after becoming Owner of the Dog, or (b) once the Dog is three months old. A Dog that is temporarily visiting or is a Foster Dog through an Animal rescue foundation or shelter does not require a License. Upon losing a Dog License tag, an Owner must purchase a replacement License tag for the Dog. Service Dog Licensing Requirements (a) Service Dogs must be Licensed in accordance with this Bylaw, however Licensing fees for Service Dogs shall be waived. Dangerous Dog Licensing Requirements (a) Ifa Dog has been declared a Dangerous Dog, it shall be identified as such for the remainder of its life, and the following additional requirements will apply to that Dog in perpetuity. (i) No person shall own or keep any Dangerous Dog within the Town as provided in this Bylaw. The Owner of a Dangerous Dog is subject to Sections 17 through 22 ( ) of this Bylaw. (ii) The Owner of a Dangerous Dog must obtain an annual License for the Dangerous Dog on the first day on which the Town office is open for business after the Dog has been declared Dangerous or has moved to the Town. The Owner of a Dangerous Dog must: (i) . (ii) ,and (iii) remain liable for the actions of the Dangerous Dog until formal notification of the sale, gift, or transfer is given to a Peace Officer. Whether on the Owner's Property or not, Dog Owners are responsible to ensure they and their Dog(s) comply with the expectations and requirements for public behaviour as stated in this Bylaw. The Owner, Guardian, or any other person having care or control of a Dog or Nuisance Dog when it is off the property of the Owner must always: (a) (b) , and The Owner of a Dog or Nuisance Dog may walk their Dog in a Green Space (unless specifically prohibited), on a pathway, or on a municipal sidewalk, provided: (a) (C) , unless they are in an Off--Leasharea, subject to Sections 43 and 44 ( ) , the Leash length is reduced to 2 metres or less when encountering any pathway or sidewalk users, including other Dogs on Leash, the Owner is conscientious of others on the pathway or sidewalk, moves their Dog out of the way of others as needed, and do not interfere with or obstruct any others using the pathway or sidewalk. The Owner of a Dog may allow the Dog to swim in the Highwood River, which runs through or adjacent to Green Spaces, unless specifically prohibited. seize and impound any Dog Running at Large. The Dog Owner is not required to have the Dog on a Leash in an Off-Leash Park or portion of a Green Space which has been designated as an Off-Leash Park. The Owner of an Animal which is must: (a) immediately report the matter to the office of the Chief Provincial Veterinarian (Alberta Animal Health and Assurance Branch) and the Peace Officer, (b) not permit the Animal to be in any Public Space, (c) not keep the Animal in contact with or in proximity to any other Animal, and (d) keep the Animal locked or tied up. Unattended Animals 46. 47. The Peace Officer may declare a tobe aNuisance Dog. In declaring aDog tobe a Nuisance Dog, the Peace Officer have regard toSections 35 through 42 ( ) and Sections 48 and ()of this Bylaw and any other matter which in the opinion of theOfficer isrelevant including whether the Dog's behaviour or actions have resulte d incont rave ntio ns of this Bylaw more than once. The Peace Officer may apply suchcon the Owner and Dog as deemed appropriate to eliminate the Nuisance. The Own er of aNuisan ce Dog must m ad e by the Peace Officer as stated inthis Section. The declaration of a Dog as a Nu isa nce Dog must be reviewed annually by the Peace Officer, taking into account Sections 35 t 42 ()and Sections 48 and 49 ( ) and the may be continued, wi hor without conditions, or revoked. The Peace Officer may order the Ow ner ofaDog alleged tobe aDangerous Dog tosurrender the Dog to a Peace Officer and the wil l be taken and held inan Animal Services Centre for the purposes of completing a behavi oural assess ment, atthe Owner's cost, pending the outcome of the hearing and any app eals . The Owner ofan alleged Dangerous Dog must made the Peace Officer. 56. The Peace Officer may allow the Ow ner tokeep possession of aDog alleged tobe aDangerous Dog pending the outcome and dispo sition of the hearing inprovincial Court and any related appeals, by issuing interim contain con trol conditions, which inthe opinion of the Peace Officer, ensures the safety of the pu bli c. Threatening Behaviou rs (i) in a locked pen or other structure, constructed pursuant to Section 3(|) ( ) in order to prevent the escape of the Dangerous Dog, and capable of preventing the entry of any person not in control of the Dangerous Dog; or (ii) securely Muzzled, and under the control of a person eighteen (18) years of age o r older by means of a Leash not exceeding one (1) meter in length. The Owner of a Dangerous Dog must ensure that (a) must provide Controlled Confinement, (b) must provide the Dangerous Dog with shelter from the elements, and (c) must not be within one (1) metre of the property line or within five (5) metres of a neighbouring dwelling unit, in accordance with the Town's Land Use Bylaw. The Owner of a Dangerous Dog may walk their Dog in a Green Space (unless specifically prohibited), on a pathway, or on a municipal sidewalk, however they must ensure that at all times, when off the property of the Owner, such Dangerous Dog is securely: (a) ; and (b) on a lead which must not exceed one (1) meter in length; and (C) The Owner of a Dangerous Dog must If a Dangerous Dog is Running at Large, the Owner of that Dangerous Dog must The Owner of a Dangerous Dog must ensure that such Dangerous Dog does not: (a) . Obstruction and Interference 69. No person, whether or not that person is the Owner of a Dog, Nuisance Dog, or Dangerous Dog, which is being pursued or has been pursued or seized by a Peace Officer shall: (a) conducting an investigation or who is attempting to seize or who has seized a Dog which is subject to seizure, (b) . (c) , or (d) from the Animal Services Centre and/or the possession of a Peace Officer. 70. No person shall: (a) . (b) (C) . (d) . (e) , or (f) 71. Section shall not apply to a Peace Officer who is attempting to seize or who has seized a Dog which is subject to seizure pursuant to this Bylaw. Notifications by leaving it with any adult person at, or by mailing it to or by leaving it at, the last known address of the Owner. Threatening Behaviours which has been seized entice a Dog to Run at Large therein icer 73. An Owner of an Animal wh om anotice ismailed pursuant toSection isdeemed tohave received that notice wi thi n seve n (7) days from the date itismailed. Anotice served personally on the Owner or any ad ul t per son atthe last known address of the Owner shall be deemed to be served on the day o f s e r v i c e . Reclaiming Seized Animals 74. Subject to the provisio ns of Secti ons 72 and 73 (),the Owner of any seized Animal, Nuisance Dog, Da ng ero us Dog may reclaim the Animal by: (a) providing proof of the Animal prior torelease, and this proof of Ownership must be to the s a ti s f a c ti o n of the Peace Officer, Notifications paying to the any costs ofbehavioural assessments, impoundment, any care, subsistence, ve ter in ar y charges incurred as set out inof this Bylaw, where a Lice nse isrequir ed under this Bylaw, obtaining the License for the Animal or Dangerous D o g , or complying wi th an y and all provisions which may be imposed inaccordance with this Bylaw. Schedule B Inspections 75. PART7 -- RESPONSIBLEURBANBEEOR URBANCHICKENOWNERSHIP Urban Bee or Urban Chicken Licensing 76. in addition to Sections 17 through 22 ( ), Owners of Urban Bee and Urban Chicken Owners are also required to follow specific regulations. Urban Bee and Urban Chicken Licensing Requirements 79. 80. Urban Bee Licensing (a) In addition to Sections 17 through 22 ( ) and Sections 77 and 78( ), each Urban Beekeeper must complete a Beekeeping course from an accepted organization or association to be approved for a License. Urban Chicken Licensing (a) In addition to Sections 17 through 22 ( ) and Sections 77 and 78 ( ), each Urban Chicken Owner must take Urban Chicken husbandry training or equivalent, which is designed to provide adequate information regarding the successful keeping of Chickens in an urban area to be approved for a Licence. Responsibilities of Urban Beekeepers 82. 83. 84. 85. 86. 87. Town of High River Beekeepers must Act, standards adopted by the Province of Alberta. Any person wanting to keep an apicultural operation must annually register with Alberta Agriculture, through the Provincial Apiculturist for Alberta. Unregistered Owners are subject to fines or imprisonment under the Bee Act. Any person wanting to keep an apicultural operation must obtain a Premises Identification (PID) under the Premises Identification Regulation in the Animal Health Act. Beekeepers or persons on whose property Bees are kept have the duty to take reasonable measures to ensure that: Bylaw 4567/2019 77. 78. Urban Beekeepers an d Chicken Owners must apply annually for aTown of High River License, as outlined i n Byla w. No person shall own or keep Urban Bees or Urban Chickens of any kind on any pre mis es within the Town boundaries unless the Urban Bees or Urban Chickens are Licensed pro vide d inthis Bylaw, unless an exception applies tothe Ownership of Urban Bees or Urba n C hi c k e n s, as identified inSection or Section An Owner of Urban Be es or Urba n Chickens can apply for the associated License atany time of the year prior to acquir ing the Bees or Chickens. Urban Bee and Urban Chicken License applications are availa ble on the Town's website or atthe Town office. Complete Urban Bee and Urban Chicken Li ce ns e applic ations should be submitted tothe Town's Development Officer at the Town of River municipal building. (a) as part of the application process, all immedi ately adjace nt neighbours must be notified by the applicant that Bee Hive(s) willbe pres ent, (b) the apicultural operation does not pose a saf ety risk topersons on adjacent public or private property, (c) the potential for damage to buildings and/orlocated on adjacent public or private property as a result of the apicultural isminimized, and (d) any person who keeps bees has the duty to the maintenanc e of the Bees insuch a condition as will reasonably prevent aggres sive beha viour or swarming by the Bees. Beekeeping and Hive requirements for the purpose s of this Bylaw are for personal use only, unless provided an exception through Section S e c ti o n The maximum number of Hives per License is two Hive Reguirements: (a) Only Apis mellifera L,also known as honeybe es, are allowed tobe kept. 13 |Page 18 Reggonsibilities of Urban ChickenQ\_r¢ner§ 88. 89. 90. 91. 92. 93. 94. (b) There can be no more than two (2) Hives per property. (c) Hives are restricted to rear ya ds with reasonable protection from by Animals and children. (cl) Hives are to be located a minimum of 2.4 metres above ground yards enclosed by a 1.8--metre--highhedge or solid fence. (e) Hive entrances are to be directed away from neighbouring propert ies. Urban Chicken Owners must comply with the Alberta Animal Health Actany other applicable standards adopted by the Province of Alberta. Any person wanting to keep Urban Chickens must obtain a Premises Id en tif ic ati on (PID) under the Premises Identification Regulation in the Alberta Animal Health Act . The keeping of Urban Chickens for the purposes of this Bylaw are for p er s o n al use only, unless provided an exception through Section No more than three (3) Hens can be kept on a single property. Only He ns w ill be allowed tobe kept. Roosters are not allowed to be kept. Each Hen must be provided with food, water, shelter, light, ventilation, and opportunit ies for essential behaviours such as scratching, dust--bathing, and roosting,suff icie nt to maintain the Hen in good health. Hens will be disposed of by delivery to a farm, abattoir, veterinarian, or operat ion that is lawfully permitted to dispose of Hens. Urban Chicken Owners on whose property Hens are kept have a duty toreaso nable measures to ensure that: 95. (a) the Coop and Hens kept in the Coop do not pose a safety topersons on adjacent public or private property, (b) the potential for damage to building and/or property loca ted on adjacen t public or private property as a result of the keeping of Urban Chick ens isminimi zed, and (c) are required to follow procedures outlined by the Canadia n Fo od Inspecti on Agency to reduce potentia disease outbreak. Coop reguirements: (a) Coops are restricted to rear yards with reasonable protect ion fro m access toother Animals or children and each Coop must provide each H en w it h atleast 0.37 m2 of interior floor area, and at least 0.92 m2 of Outdoor Enclos ure, withi n the Coop. (b) Provide and maintain, in the Coop, at least one nest box Co op and one perch per Hen that is at least 15 cm long. (c) Always keep the Hen(s) in the Coop. (d) Maintain the Coop in good repair, sanitary condition, and from vermin and noxious or offensive smells and substances. (e) Construct and maintain the Coop to prevent any rodent o r o t h e r Animal from harbouring underneath, within it, or within its walls. Section of the Bylaw only applies to Coops located within th e and those Coops are in compliance with the Town Land Use Bylaw. Section does no t a p p l y toresidents who have been provided an exception under Section PART 8 --ENFORCEME NT Authority of a Peace Officer 97. A Peace Officer may: (a) receive Animals int o care atan Animal Services Centre arising from an emergency due to fi r e , flo od, or other reasons; (b) retain Animals temp oraril y atan Animal Services Centre; 14 |Page Town of High River Bylaw 4567/2019 charge t O wn er fees, costs of behavioural assessments, impoundment, any care, subsisten ce, or veterina ry charges incurred as set out inof this Bylaw; at the e n d of the protective care period, ifno other arrangements are made between the Owner a n d the Peace Officer or the Owner cannot be ascertained, treat such Animals as seized or Schedule B 98. The Peace Officer shall not sell, euthanize, or otherwise dispose of a seized Animal until the Animal is retained in the Animal Services Centre for: (a) seven (7) days after the Owner has received notice or is deemed by Sections 72 and 73 ( )to have received notice that the Animal has been seized; or (b) seventy-two (72) hours, ifthe name and address of the Owner is not known. 99. The Peace Officer may retain a seized Animal for a longer period if in their opinion, the circumstances warrant the expense or there are reasonable grounds to believe that the seized Animal is a continued danger to a person, Animal, Livestock, or other domesticated household pets or property. 100. The Peace Officer may, before selling an unclaimed seized Animal, require that the Animal be spayed or neutered. 101. Any veterinarian, being properly and fully qualified as required by the Province of Alberta, may destroy any Animal de ivered to the veterinarian after injury to the Animal, providing the injury is determined by the veterinarian to be of such serious nature, based upon their professional opinion, that the Animal must be destroyed immediately and such costs of destruction may be billed to the municipality and the municipality is at liberty to take all steps considered necessary to recover such costs from the Owner of the Animal. 102. When the Peace Officer decides to euthanize a seized Animal pursuant to this Bylaw, the Owner shall pay the fees, as set out in of this Bylaw. Full Right and Title 103. Pursuant to this Bylaw, the purchaser of a seized Animal shall obtain full right and title to the Animal and the right and title of the Former Owner of the Animal shall cease thereupon. General Penalty Provisions 104. The Owner of an Animal is involved in a contravention of this Bylaw by: (a) doing any act or thing which the person is prohibited from doing; or (b) failing to do any act or thing the person is required to do, has contravened this Bylaw and committed an offence. 105. Any person who is convicted of an offence pursuant to this Bylaw is liable on summary Violation Tickets and Penalties 106. Where a Peace Officer believes that a person has contravened any provision of this Bylaw, that Peace Officer may commence proceedings by issuing a Violation Ticket. 107. In respect of any contravention of a provision of this Bylaw, penalties shall be in accordance with Continuing Offences 108. In the case of an offence that is of a continuing nature, a contravention constitutes a separate offence in respect of each day, or part of a day, on which the offence continues. Mandatory Court or Information 109. No provision of this Bylaw shall prevent any Peace Officer from issuing a Violation Ticket requiring the Court appearance of the defendant, pursuant to the provisions of the Provincial Offences Procedure Act, or from lay ng an information instead of issuing a Violation Ticket. The levying and payment of any fine or tim pris on me nt for any period provided inthis Bylaw shall not relieve a person from the neces sity of paying any fees, charges or costs from which he is liable under the provisions of this Responsibilities of the Municipality 111. A copy of a record of the municipality, c e rt if ie d by the person duly appointed as the Designated Officer for the same as a true copy of th e o ri gi n al , shall be admitted inevidence as prima facie proof of the facts stated in the reco d w it h o ut proof of the appointment or signature of the person signing it. 112. No action for damages shall be taken a g ai n st the municipalit y or any person acting under the authority of this Bylaw in respect of the sale, or other disposal of any Animal seized pursuant to this Bylaw. 113. It is the intention of the Council of the that all offences created pursuant tothis Bylaw be construed and considered as Strict Liability Offences. PART9 - GENERA L Effective Date 114.
