TOWN OF HIGH RIVER
IN THE PROVINCE OF ALBERTA
BYLAW 4641/2025- RATE BYLAW (UTILITIES)
A BYLAW OF THE TOWN OF HIGH RIVER TO AUTHORIZE THE MUNICIPAL COUNCIL OF THE TOWN OF
HIGH RIVER TO SET VARIOUS FEES, FINES, AND OTHER CHARGES.
WHEREAS pursuant to the Municipal Government Act R.S.A., c. M-26 and any amendments thereto is in
force;
AND WHEREAS pursuant to Part 2 (Bylaws) of the Municipal Government Act, the Town is authorized to
pass a bylaw to levy fees, fines, and other charges where applicable;
AND WHEREAS authority to levy fees, fines and other charges, where applicable, are found in bylaws as
noted within each section of the attached schedules of this Bylaw;
AND WHEREAS all applicable fees, fines, and other charges are attached to this Bylaw;
AND WHEREAS an individual fee, fine, or other charge outlined in the attached schedules may, from
time to time, be waived or modified by a resolution of Council.
NOW THEREFORE, the Town of High River Council, duly assembled, enacts as follows:
PART I - PURPOSE, DEFINITIONS AND INTERPRETATION
Purpose
1.
The purpose of this Bylaw is to set various fees, fines, and other charges for the Town of High
River for Public Works Rates, Utility Fees and Utility Bylaw Offence Fines.
Short Title
2.
This Bylaw may be cited as the "2025 Rate Bylaw (Utilities)".
Definitions
3.
Words used in this Bylaw have the same meaning as defined in the Municipal Government Act,
with the following changes or additions:
(a) "Act" means the Municipal Government Act, RSA 2000, c. M-26, together with any
amendments and Regulations made thereunder;
(b) "Bylaw" means Bylaw 4641/2025 also known as the 2025 Rate Bylaw (Utilities);
(c) "Chief Administrative Officer'' means the individual appointed to the position of the Chief
Administrative Officer or his or her designate for the Town;
(d) "Council" means the governing body of the Town;
(e) ''Town" means the municipal corporation of the Town of High River.
Interpretation
4.
Headings and sub-headings in this Bylaw are included for convenience only and shall not be
considered in interpreting the substantive content of this Bylaw.
5.
The preamble paragraphs that precede the numbered paragraphs of this Bylaw are an integral
and necessary part of this Bylaw and not a mere recital.
6.
Every provision of this Bylaw is independent of all provisions and it is the intention of the
Council that if any provision of this Bylaw is declared invalid by a Court of competent
jurisdiction, all other provisions of this Bylaw shall remain valid and enforceable.

7.
Nothing in this Bylaw relieves a Person from complying with any Federal or Provincial law or
regulation, any other Town Bylaw, or any requirement of any lawful permit, order, or license.
8.
References in this Bylaw to an act, statute, regulation, or other Bylaw refer to the current laws
and legislation, as amended or replaced from time to time, including successor legislation.
9.
This Bylaw is gender-neutral and, accordingly, any reference to one gender includes the other.
10. The word "shall" is mandatory and not merely directory.
PART II - GENERAL
Effective Date
1.
This Bylaw comes into effect on July 1, 2025.
Repeals
2.
Council authorizes the removal of associated fees, fines, and other charges contained within
this Bylaw from Bylaw 4612/2023, being the 2023 Rate Bylaw.

OPERATION CHARGES and BYLAW OFFENCE FINES
FEE FOR SERVICE
From time to time it is deemed appropriate for the Town of High River to provide services to the
private sector or outside agencies. The rental rate for Town-owned equipment shall be the
Operational Services current external rates which are based on the most current rate in the latest
version of the Alberta Roadbuilders and Heavy Construction Association Equipment Rental Rates
Guide. If a rental rate cannot be determined using the Guide, a similar rate being charged by local
or nearby equipment suppliers shall be the rental rate charged.

Section 9(f) - Disposing of waste inappropriately and/or failure to dispose of waste
Section 1 0(f) - Failure to remove or dispose of waste at a premise that the Town does not

Flat Residential Fee - Where the owner does not have at least one year continuous Winter
consumption history or customer does not have a water meter, a flat fee for wastewater produced
will be charged plus the service fee.
Commercial sanitary dumping fee
WASTEWATER FEE EXEMPTIONS
Summer months (May through Oct) consumption for residential will be calculated using the 3
previous winter water billings (Nov/Dec, Jan/Feb, Mar/Apr - a minimum of one winter history). If
the water consumption in a summer billing period is less than the previous winter average or the
Flat Residential Fee (used for when there is not 1 year's continuous water consumption), then the
current consumption will be used.
Exemptions for the wastewater rate and fee apply for irrigation meters (no wastewater charge for
meters designated as irrigation) and customers who are not connected to the town wastewater
system.
Exemptions apply for commercial/industrial customers where 15% or more of their water usage is
used in a sellable product. Customers must apply in writing for this exemption. Proof will be
provided by the customer to the Town's satisfaction of the average percentage on an annual basis
or as requested by the Town. This average will be subtracted from the wastewater rate.
