BYLAW 4640/2025
Being a Bylaw of the Town of High River, in the Province of Alberta, to establish a Bylaw to outline the
provision of Solid Waste management.

Pursuant to the Municipal Government Act, RS.A., 2000, being Chapter M-26, as
amended from time to time, a municipal council may pass bylaws for municipal
purposes respecting the safety, health and welfare of people and the protection of
the people and Property, nuisances, services provided by or on behalf of the
municipality; and
The Municipal Government Act also provides that a municipal council may pass
Bylaws to establish a system for the collection, removal, and disposal of Garbage
and Solid Waste;
The Municipal Council of the Town of High River, duly enacts as follows:
SHORT TITLE
This Bylaw will be cited as the "The Solid Waste Management Bylaw."
DEFINITIONS
a) "Ashes" means cold residue from the burning of wood, coal, and other like
materials for the purpose of cooking, heating buildings and disposition of
Waste combustible materials.
b) "Automated Collection" means the collection of Waste by a system of
mechanical lifting and tipping of Waste Receptacles into specifically
designed vehicles.
c) "Biomedical Waste" means medical Waste that requires proper handling
and disposal because of environmental, aesthetic, and health and safety
concerns as well as risks to human health and includes:
i.
Human anatomical Waste;
ii.
Infectious human Waste;
iii.
Infectious animal Waste;
iv.
Blood and body fluid Waste; and
v.
Medical sharps, such as needles, syringes, blades, or other
clinical laboratory material capable of causing punctures of cuts.
d) "Boulevard" may include flowers, lawn, plants, shrubs, or trees and
means:
i.
The portion of land between the curb and the Sidewalk and
between the Sidewalk and the Premises' Property line, or
ii.
Where there is no curb, the portion of land between the near
edge of the Roadway and the Premises' Property, but does not
include the Median, which is located between two lanes of the
Roadway.
e) "Building Waste" means all Waste produced in the process of
constructing, demolishing, altering, or repairing a building and shall
include, but not be limited to soil, vegetation and rock displaced during the
process of building.
f)
"Bylaw" means Bylaw 4640/2025 also known as the 'The Solid Waste
Management Bylaw".
g) "Chief Administrative Officer" means the Chief Administrative Officer of
the Town or his or her delegate.
h) "Collection Day" means the day which the Director schedules for
municipal collection of Solid Waste.
i)
"Collector" means a person or corporation who collects Waste within in
the Town for and on behalf of the Town.
j)
"Council" means the governing body of the Town.
k)
"Curb" means the actual Curb, if there is one, and if there is no Curb in
existence, shall mean the division of the Roadway between that part
intended for the use of vehicles and that part intended for the use of
pedestrians.
I)
"Customer" means any person, corporation or organization that has
entered a contract with the Town for Utility provision at a particular
premise, or who is the owner or Occupant of any Premises connected to
or provided with a Utility.
m) "Director" means the Director of Municipal Services as appointed by the
Chief Administrative Officer to oversee the Municipal Services and/or their
authorized delegate, authorized agent, or representative.
n) "Garbage" means Waste biproducts produced from household processes
and can be composed of organic and inorganic material.

o) "Hazardous Waste" means waste that is generated from any premises
and has one or more hazardous properties as described in the
Environmental Protection and Enhancement Act, RS.A. 2000, c. E-12

1 Alberta King's Printer:.
p) "Leaf and Yard Waste" means grass clippings, leaves, brush, twigs,
house and garden plants, sawdust and wood shavings or other
comparable items as designated by the Director. The recycling center
receives this type of waste 365 days a year at 640 7th Street NW High
River - Recycling.
q) "Median" means a narrow portion of land that separates the lanes of
traffic from those travelling in the opposite direction.
r)
"Occupant" means a person or corporation in actual possession of any
Premises either as an owner or tenant. For billing purposes further
defined as a person contracting with the Town for the domestic supply of
water to any Premises.
s) "Organics" means food Waste such as vegetables, fruits, Solid dairy
products, pasta rice, bread, coffee grounds, filters, tea bags, eggshells,
meat, fish, Solid fats, bones, and cat litter/feces but does not include
cardboard, boxboard, paper, plastic, or any non-organic materials.
t)
"Peace Officer" means a person engaged by the Town as a Community
Peace Officer, a Bylaw Enforcement Officer, a designated Officer, or a
member of the Royal Canadian Mounted Police to conduct the provisions
of this bylaw.
u) "Plastic Garbage Bag" means a sturdy plastic bag specifically marketed to
store Waste and excludes bags that are intended for other purposes.
v) "Premises" means any land, or building, supplied with Utilities by the
Town.
w) Property" means items that are owned which are not fixed to the land.
x) "Roadway" means the same as the word highway, as defined in the
Traffic Safety Act, and includes any thoroughfare, street, road, trail,
avenue, parkway, viaduct, lane, alley, square, bridge, causeway, trestle
way, or other place, whether publicly or privately owned, that the public is
ordinarily entitled or permitted to use for the passage or parking of
vehicles.
y) "Shared Receptacle Service" means Garbage collection services provided
to a specific multi-premise site in the Town in which several Premises
share one or more Waste Receptacles for Garbage collection.
z) "Sidewalk" means that part of a Roadway is primarily intended for the use
of pedestrians and includes the part lying between the Curb line or edge
of the Roadway and the adjacent Property line, whether paved or
improved.
aa) "Solid Waste" means anything that is set out for collection and includes
garbage, recyclable material, and food waste material.
bb) "Street" means a public thoroughfare within the Town and includes, where
the context so allows, the Sidewalk and borders of the Street and all parts
appearing in the Land Titles Office as set aside for a public thoroughfare;
when used in distinction to it means the public thoroughfare on which the
Premises in question front.
cc) "Solid Waste Collection Cart" means a cart that is supplied by the Town of
High River designed to place Waste into then rolled to a collection point
and emptied by an Automated Collection truck.
dd) "Town" means the corporation of the Town of High River, or the area
contained within the boundaries thereof, as the context requires.
ee) "Transient Waste" means items such as couches, chairs, and freezers,
which are placed on side streets or alleys.
ff) "Waste" means any discarded household debris, debris, recyclables,
biomedical, or household Hazardous Wastes as herein defined.
gg) "Waste Bin" means any bulk Waste Receptacle with a capacity greater
than 1.5 m3 requiring mechanized collection. Specifically marketed to
store Waste and excludes bins that are meant for other purposes.
hh) "Wet Garbage" means kitchen Waste containing liquids originating from
hotels, boarding houses and restaurants but excludes drained household
kitchen Waste which has been properly packaged.
ii)
"Waste Receptacle" means a Waste Bin, Solid Waste Collection Cart or
Shared Waste Receptacle.
INTERPRETATION
a) Headings and sub-headings in this Bylaw are included for convenience
only and shall not be considered in interpreting the substantive content of
this Bylaw.

b) The preamble paragraphs that precede the numbered paragraphs of this
Bylaw are an integral and necessary part of this Bylaw and not a mere
recital.
c) All schedules as attached to this Bylaw form part of this Bylaw.
d) Every provision of this Bylaw is independent of all provisions, and it is the
intention of the Council that if any provision of this Bylaw is declared
invalid by a Court of competent jurisdiction, all other provisions of this
Bylaw shall remain valid and enforceable.
e) Nothing in this Bylaw relieves a Person from complying with any Federal
or Provincial law or regulation, any other Town Bylaw, or any requirement
of any lawful permit, order, or license.
f)
References in this Bylaw 4640/2025 to an act, statute, regulation, or other
Bylaw refer to the current laws and legislation, as amended or replaced
from time to time, including successor legislation.
g) This Bylaw is gender-neutral and, accordingly, any reference to one
gender includes the other.
h) The word "shall" is mandatory and not merely a directory.
GENERAL
1. Except as otherwise provided in this Bylaw, the Town shall provide for the
public collection and removal of Solid Waste within the limits of the Town and
shall supervise the facilities and equipment necessary or desirable for the
management of Solid Waste collected or disposed of by the Town.

Supervise the collection, removal, and disposal of Solid Waste, and;
Set the days and times that collection shall be undertaken in different
portions of the Town;
Outline the quantities and classes of Solid Waste to be removed from any
Premises or accepted by the Town for disposal;
Decide which method will be used to collect Waste;
i.
Automated Collection;
ii.
Manual collection in an extenuating circumstance
State the location from which Solid Waste will be collected;
i.
Front Street collection, or
ii.
Rear Lane collection;
Set instructions and operating policy for Automated Collection;
May specify that private Waste haulers report the total volume of Solid
Waste to be hauled out of the Town's boundaries;
Conduct any inspections required to determine compliance with this
Bylaw;
Take any steps or conduct any actions required to enforce this Bylaw;
Take any steps to conduct any actions required to remedy a
contravention of this Bylaw.
Any Solid Waste that is to be collected must be:
i.
bagged to prevent loose Waste from escaping the cart;
Solid Waste, after bagging, must be placed in the Solid Waste Cart only
to comply with this Bylaw, unless otherwise provided in this Bylaw.
The Town will provide at its own expense the first Solid Waste Collection
Cart to the Premises:
i.
The cart is to always remain at the Premises;
ii.
The Town may, at the time of collection or any other time,
remove, repair, or replace any obsolete, damaged, or non-
serviceable carts;
iii.
If the Solid Waste Collection Cart is lost, stolen, or damaged the
Occupant shall be responsible for purchasing a replacement cart
from the Town or pay for the cost of repairs;
iv.
The Town owns all Solid Waste Collection Carts;
d) A Solid Waste Collection Cart shall not be filled to a height greater than 5
cm from the top of the Solid Waste Collection Cart;
e) The Solid Waste Collection Cart shall be cleaned out regularly by the
Customer to avoid build-up of odors;
f)
No person shall place Solid Waste in any Solid Waste Collection Cart
without the permission of the owner or Occupant of the Premise;
g) The Director reserves the right to withhold collection of Solid Waste when
the Solid Waste Collection Cart does not meet the necessary

requirements or is in a depilated, unsafe, or is in an unsanitary condition
or in contrary to the instructions and operating policy of the Director.

a) For Automated Collection, the Director will set the maximum weight.
a) Except as otherwise provided herein, no person shall place or keep Solid
Waste Collection Carts upon any portion of the Street or Lane. Any Solid
Waste Collection carts improperly left in the Street may be removed by the
Town;
b) No person who receives Solid Waste Collection shall set out Solid Waste
Collection Carts at locations that are: unsafe, obstructed, blocked by
snow, ice, poorly maintained, and uneven or that prevent Waste
Collectors from collecting Waste in a safe and efficient manner in the
opinion of the Director or their designate;
c) The Occupant of residential Premises shall place Solid Waste Collection
Carts for collection in such a way that Collectors shall have access without
entering private Property;
d) Automated Solid Waste Collection Carts shall be:
i.
Set out in accordance with the instructions and operating policy of
the Director;
ii.
Set out on the Street by the Curb or in the Lane on Collection Day
no later 0700 hrs;
iii.
Set out so that they will not likely be overturned;
iv.
Stored on the premises;
v.
Placed no less than 1 meter from any obstructions such as
vehicles, fences, or trees;
vi.
Carts shall be placed individually at the curb, where possible;
e) The Town shall collect Solid Waste from only one pick-up point from each
premise, except where the Director has designated any other pick-up point,
he considers necessary.
a) An Occupant of the Premises from which Garbage is to be collected
shall:
i.
Thoroughly drain all household Garbage and place it in a Plastic
Garbage Bag before disposing of it in the Solid Waste Collection
Cart;
b) The Town shall not remove the following from the Premises:
i.
Highly combustible or explosive materials including but not limited
to liquid or solid fuels, gunpowder, ammunition, or explosives;
ii.
Hot Ashes which are not properly quenched and appear to be hot
or likely to cause a fire;
iii.
Compressed propane or butane cylinders;
iv.
Toxic or household Hazardous Waste including solvents, oven
cleaners, paints, automotive fluids, wet cell batteries, pesticides,
herbicides, or any material commonly referred to as household,
commercial, or industrial Hazardous Waste;
v.
Biomedical Waste including hypodermic needles or syringes,
lancets or any sharp item used in home medical care;
vi.
Large bulky items such as mattresses, box springs, dressers,
tables, chairs, major appliances, auto and truck parts, tires, tree
limbs, whole shrubs, or discarded heavy machinery;
vii.
Sheet iron, large pieces of scrap metal or machine parts;
viii.
Electronic equipment including televisions, computers, computer
monitors, keyboards, and associated cables;
ix.
Renovation, construction, or demolition material;
x.
Stumps, concrete blocks or slabs, soil, rocks, or aggregate;
xi.
Dead animals and animal parts from hunting or trapping;
xii.
Transient Waste;
xiii.
Septic tank pumping, raw sewage, or industrial sludge;
xiv.
Radioactive Waste;
xv.
Waste material which has not been placed for collection in
accordance with the provision of this Bylaw;
xvi.
Liquid Waste or material that has attained a fluid consistency and
has not been drained.

a) No building materials or construction materials shall be placed into Solid
Waste Collection Carts;
b) A person conducting the construction, demolition or alteration of buildings
or other building operations on any Property shall do so in such manner as
to not permit building material or Building Waste material to remain loose,
free, or uncontrolled on the Property;
c) The main contractor on the building site shall be responsible for the actions
of any subcontractor or tradesman who fail to comply with subsection 7 a)
and 7 b);
d) The main contractor on a building site shall be responsible for the term of
the construction in providing a suitable Waste Receptacle capable of
receiving all Building Waste material and maintaining the same in a safe
contained manner;
e) Where the contractor is working on more than one building site and they
are adjoining, he may provide one Building Waste Receptacle for each
three building sites;
f)
The main contractor on a building site shall be responsible for having all
unused building material and Building Waste material disposed of in the
Landfill or appropriate area;
g) The Director may direct the person conducting the construction or alteration
of a building to provide a fence of a type that will trap any building material
or Building Waste material in such a manner as to prevent it from escaping
from the building site.
8. The Town shall collect Solid Waste:
a) From each residential Premises once each week, except as detailed in
Section 5 b) d) and Section 7 a);
b) The Town will not collect commercial Solid Waste:
c) Any designated Solid Waste that is stored in a Solid Waste Collection Cart
may be collected by the Town at the Director's discretion;
d) Where the Town does not collect Waste at a premise listed in 11 e), the
Property owner or Occupant, either by contractors, agents or by
employees, shall remove and dispose of the Solid Waste in compliance with
all applicable Federal, Provincial and Municipal laws and shall provide the
Town with a copy of the contract between the Occupant and the service
provider;
e) Solid Waste Collection Carts shall not be set out prior to 7 p.m. the day prior
to Collection Day and must be placed at collection points no later than 7
a.m. on the scheduled Collection Day;
f)
All Solid Waste Collection Carts must be removed from the Street or Lane
by 8 p.m. on the Collection Day and stored on the Property when not in
use.
9.
No person shall convey through any Street in the Town any Solid Waste
except in a properly enclosed Receptacle or in a vehicle which is covered with
canvas or tarpaulin, or secured such that the contents are protected from
being wind-borne or falling on the Streets in relation to the National Safety
Code Standard 10 and Alberta's Commercial Safety Vehicle Regulation.
10. The Town will not be responsible for any damage to roads or infrastructure on
a private site resulting from the legitimate operation of Waste Collection
vehicles during Waste collection activity at that private site.
11 .
a) It shall be unlawful for any person to dump Building Waste, Garbage, or
other Waste material anywhere within the limits of the Town of High River,
except in the location designated by the Director and approved in writing
by the Director;
b) No person, other than the Occupant of the Premise, shall pick over,
remove, disturb, or otherwise interfere with any Waste material that has
been set out for municipal collection;
c) No person shall place residential or commercial Waste in a public litter
container;
d) No person shall burn household refuse, burnable debris, or prohibited
debris in any fireplace or fire pit within the Town;
e) The Town reserves the right to withhold collection of improperly prepared
Waste, prohibited Waste, excessive quantities of Waste, or Waste located
at unsafe or non-compliant set-out locations;

f)
The Occupant shall keep the Lane at the rear of the Premises occupied or
under his control - to the center of the Lane - in a clean and tidy condition
and free from refuse of any nature;
g) The Occupant shall keep the Curb and gutter at the front of the Premises
in a clean and tidy condition.
a) Charges for waste removal provided by the Town are stipulated in the
current Town of High River Rate Bylaw;
b) The Director shall cause such measurements to be made and records to
be maintained as he deems necessary to estimate or determine the
volume of Waste removed from any Premises and based on such
measurements and records shall establish the monthly charge to be
levied on any occupier or commercial hauler. The Director on being
satisfied that any estimate required to be amended may establish new
charges;
c)
Where conditions exist which could require the application of a different
rate, such rate will be stipulated by the Director;
d) The administration fee for changing the size of the Solid Waste Collection
Cart shall be as set out in the Town of High River Rate Bylaw;
e) The Fee for additional Waste Collection shall be set out in the current
Town of High River Rate Bylaw.
13. Obstructions and Interference:
a) No person shall provide false information to, obstruct, or attempt to
obstruct a Peace Officer.
14. The Owner or Occupant of a Premises or Property who participates in a
contravention of this Bylaw by:
a) Doing any act or thing which the Person is prohibited from doing; or
b) Failing to do any act or thing the Person is required to do;
has contravened this Bylaw and committed an offence.
15. Any Person who is convicted of an offence pursuant to this Bylaw is liable on
summary conviction to a fine not exceeding one thousand dollars ($1000.00)
and in default of payment of any fine imposed if not paid within 90 days.

a) Where a Peace Officer believes that a Person has contravened any
provision of this Bylaw, that Peace Officer may commence proceedings
by issuing a Violation Ticket in accordance with the Provincial Offences
Procedure Act;
b)
In respect of any contravention of a provision of this Bylaw, penalties
shall be in accordance with Schedule A.
17. In the case of an offence that is of a continuing nature, a contravention
constitutes a separate offence in respect of each day, or part of a day, on
which the offence continues.
18. No provision of this Bylaw shall prevent any Peace Officer from issuing a
Violation Ticket requiring the Court appearance of the defendant, pursuant to
the provisions of the Provincial Offences Procedure Act or from relying on
information instead of issuing a Violation Ticket.
19. The levying and payment of any fine or the imprisonment for any offense
provided in this Bylaw shall not relieve a Person from paying any fees,
charges, or costs for which they are liable under the provisions of this Bylaw.
20.
a) No action for damages shall be taken against the municipality or any
Person acting under the authority of this Bylaw in respect of the
destruction, sale, or other disposal of any Property seized pursuant to this
Bylaw.
b) It is the intention of the Council of the municipality that all offences
created pursuant to this Bylaw be construed and considered as being
Strict Liability Offences.

21. No section of this Bylaw relieves a person from complying with any federal or
provincial law or regulation other than Bylaw or any requirements of any
lawful permit, order, consent, or other direction.
22. Every provision of this Bylaw is independent of all other provisions, if any
provision of this Bylaw is declared invalid for any reason by a Court of
competent authority, all other provisions of this Bylaw shall remain valid and
enforceable.
ENACTMENT
1)
This Bylaw comes into effect when it is passed by Council.
2)
Upon enactment of this Bylaw, Bylaw 4620/2024 is hereby rescinded.

SCHEDULE "A" - CHARGES
Charges shall be as specified in Schedule "A" for the first offence. For a second offence in one
twelve-month period, the charge shall be double the charge listed below, and the specified
charge shall be double the specified charge listed below. For third and subsequent offences in
one twelve-month period, the charge shall be triple the charge listed below, and the specified
charge shall be triple the specified charge listed below.

From time to time, it is deemed appropriate for the Town of High River to provide services to the private
sector or outside agencies. The rental rate for Town owned equipment shall be the Operational Services
current external rates which are based on the most current rate in the latest version of the Alberta
Roadbuilders and Heavy Construction Association Equipment Rental Rates Guide. ff a rental rate cannot be
