## VILLAGE OF HILL SPRING BYLAW NO. 2018-297 LONG GRASS BYLAW BY-LAW ESTABLISHING REGULATIONS REGARDING FIRE PREVENTION BY THE MOWING AND UPKEEP OF GRASS AND MAINTAINING OF BOULEVARDS BY PROPERTY OWNERS This by-law may be called The Long Grass and Boulevard By-law. The Council of the Village of Hill Spring enacts as follows: WHEREAS mature grass exceeding fifteen (15) centimeters (six (6) inches) creates a fire hazard inside the Village of Hill Spring, and long grass exceeding twenty-five (25) centimeters (ten (10) inches) creates a negative impression of the village, WHEREAS un-maintained grass on boulevards and untidy boulevards create a negative impression of the village, THEREFORE the Village of Hill Spring enacts as follows: ## 1. DEFINITIONS: "Boulevard" - means the land between the property line and the travelled portion of the adjoining roadway. "Long grass" means grass which may or may not still be growing but has exceeded a length of twentyfive (25) centimeters (ten (10) inches. "Mature grass" - means grass which has stopped actively growing and is losing or has lost much of its moisture content. "Mowed condition" means grass that is seven and a half (7.5) centimeters (three (3) inches) or less in length. "Notice" shall be in a form prescribed in this by-law, and may be served on a property owner personally, or by affixing it to the front door of the dwelling on the property, or by sending it by ordinary mail to the mailing address of the property owner. The address for ordinary mail shall be deemed to be the most recent address provided to the Village of Hill Spring by the property owner. "Tidy condition" means that no vehicles, objects, or structures are allowed to remain on the boulevard. Occasional parking of currently licensed vehicles is allowed for a period of not more than 72 consecutive hours. ## 2. REGULATIONS - a. Property owners are to maintain mature grass on their lots at a length of fifteen (15) centimeters (six (6) inches) or less. - b. Property owners are to maintain all grass on their lots at a length of twenty-five (25) centimeters (ten (10) inches or less. - c. Boulevards are to be kept mowed and in a tidy condition by the owners of the adjoining property. - d. Notwithstanding section 3, the village may authorize the placement of items on a boulevard such as moveable flower pots or moveable picnic tables for the use of a business's customers. - e. If mature grass on a lot is not maintained at a length of fifteen (15) centimeters (six (6) inches) or less, the village may issue a notice to the land owner indicating a date by which the grass must be cut to six (6) inches or less. - f. If all grass on a lot is not maintained at a length of twenty-five (25) centimeters (ten (10) inches or less, the village may issue a notice to the land owner indicating a date by which the grass must be cut to twenty-five (25) centimeters (ten (10) inches or less. Bylaw # 2018-297 - g. If a person wants to 'hay' their property, they must submit that request to administration by April 30 of the current year and receive a permit to leave the grass for hay. The grass must be cut no later than July 15 of that year. - h. If by the date indicated on the notice the grass on a lot has not been reduced in length as required by section 1 or section 2, a charge of ten dollars ($10.00) per day shall be levied against the property concerned. If the grass remains uncut for a further period of seven days, the village may perform the work to reduce the height of the grass and charge the cost of the work to the property owner as per Schedule "A". - i. If a boulevard is not kept tidy and in a mowed condition, the village may issue a notice to the land owner of the adjoining property indicating a date by which the boulevard must be mowed or - j. If by the date indicated on the notice the boulevard has not been mowed or tidied, a charge of ten dollars ($10.00) per day shall be levied against the property adjoining the boulevard. If the grass remains uncut, or the boulevard remains un-tidied for a further period of seven (7) days, the village may perform the work to mow the boulevard or tidy it and charge the cost of the work to the owner of the adjoining property as per Schedule "A". - k. Unpaid costs of the work performed pursuant to this by-law may be applied to taxes on the property concerned. ## 3. RESCINDING BYLAW a. Bylaw 2010 - 294 is hereby repealed ## 4. DATE OF COMMENCEMENT - a. This bylaw shall come into effect upon third and final reading. Village mowing charge per hour is one hundred and fifty dollars ($150.00) or a portion thereof. In extenuating circumstances, the Village may waive boulevard fees. ## NOTICE PURSUANT TO BYLAW # 2018-297 OF THE VILLAGE OF HILL SPRING TO Lot \_block\_ \_ the owner of plan \_Village of Hill Spring. ## TAKE NOTICE that the village of Hill Spring has determined - THAT the mature grass on your lot exceeds the allowed maximum length and must be cut to a maximum of fifteen (15) centimeters (six (6) inches. - THAT the grass on the boulevard adjoining your lot and adjacent to (NAME OF STREET OR Is not being maintained in a mowed condition. (seven and a half (7.5) centimetres) three (3) inches) - THAT the boulevard adjoining your lot and adjacent to (NAME OF STREET OR AVENUE) is not being kept in a tidy condition. ## YOU ARE HEREBY REQUIRED TO: - Reduce the length of mature grass on your lot to the legal maximum or less. - Reduce the length of grass on your boulevard to the legal maximum or less. - Remove any vehicles, objects or structures from your boulevard. COMPLIANCE WITH THIS ORDER IS REQUIRED BY Non-compliance with this order may result in the Village of Hill Spring taking action to remedy the items indicated.
