TOWN OF HINTON
BYLAW NO. 1179
TO REGULATE TRAFFIC WITHIN THE CORPORATE LIMITS OF
THE TOWN OF HINTON
WHEREAS,
The Traffic Safety Act, R.S.A. 2000, c. T-6, section 13 provides that a Municipal
Council may pass a Bylaw with respect to regulation of parking and the use of
highways under its direction, control and management.
AND WHEREAS,
In accordance with the Town of Hinton regulatory bylaw review policy it is deemed
expedient to review and update the Town of Hinton Traffic Bylaw.
NOW THEREFORE,
THE MUNICIPAL COUNCIL OF THE TOWN OF HINTON, IN THE PROVINCE
OF ALBERTA, DULY ASSEMBLED AND IN ACCORDANCE WITH THE
PROVISIONS OF THE MUNICIPAL GOVERNMENT ACT, RSA 2000, Chapter
M-26 AND AMMENDMENTS THERETO, ENACTS AS FOLLOWS:
SECTION 1
1.01
That this Bylaw be cited as the "TOWN OF HINTON TRAFFIC BYLAW."
SECTION 2
DEFINITIONS
Words used in this Bylaw which have been defined in the Act or the
Regulations have the same defined meaning when used in this Bylaw.
2.01
"Act" means The Traffic Safety Act, RSA 2000, c.T-6, as amended or replaced
from time to time.
2.02
"Alberta Motor Transport Board" means the Board as defined in the Alberta Motor
Transport Act RSA 2000, c M-21
2.03
"Alley" is defined in the Act.
2.04
"Boulevard" is defined in the Act.
2.05
"CAO" means a Municipal official in the responsible role of Chief Administrative
Officer and includes anyone designated and authorized to act on their behalf.
2.06
"Commercial Vehicle" means,
(a)
a truck, trailer or semi-trailer except
(i)
a truck, trailer or semi-trailer that is a public service vehicle, or
(ii)
a truck, trailer or semi-trailer or any class of vehicle that by the regulations
or by an order of the Alberta Motor Transport Board is exempted from

being classified as a commercial vehicle, and
(b)
includes
(i)
a motor vehicle from which sales are made of goods, wares, merchandise
or commodity, and,
(ii)
a motor vehicle by means of which delivery is made of goods, wares,
merchandise or commodity to a purchaser or consignee thereof.
2.07
"Cross Walk" is defined in the Regulations.
2.08
"Curb" means the actual concrete or asphalt curb, or in the absence of one, the
dividing line of a highway between the edge of the roadway and the sidewalk.
2.09
"Disabled" means a person or persons who have a physical disability requiring
assistance from another person(s) and/or an aid, such as a wheelchair.
2.10
"E-Bike" means a powered bicycle consistent with the provincial regulations and,
is consistent with federal definition of "power-assisted-bicycle" in MVSR CRC, c
1038 s2.
2.11
"Environmental Protection and Enhancement Act" means the Environmental
Protection and Enhancement Act RSA 2000 cE-12 and regulations as amended
or replaced from time to time.
2.12
"Forest and Prairie Protection Act" mean the Forest and Prairie Protection Act
RSA 2000 cF-19 and regulations as amended or replaced from time to time.
2.13
"Heavy Vehicle" means a motor vehicle, alone or together with any trailer, semi-
trailer or other vehicle being towed by the motor vehicle, with a registration
gross vehicle weight of more than forty-five hundred (4,500) kilograms, or
exceeding eleven (11) meters in total length. A public passenger vehicle, when
engaged in the transport of passengers, shall be deemed to be excluded from
the definition of a heavy vehicle for the purposes of section 5 of this Bylaw
2.14
"Highway" is defined in the Act.
2.15
"Intersection" means the area embraced within the prolongation or connection of
(a)
the lateral curb lines or, if none,
(b)
the exterior edges of the roadways, of two or more highways, which join
one another at any angle whether or not one highway crosses the other.
2.16
"Loiter" which means to hang around idly or to congregate.
2.17
"Mobile Unit" means
(a)
any house trailer or re-locatable trailer, or

(b)
any structure whether ordinarily equipped with wheels or not, that is
constructed or manufactured to be moved from one point to another by
being towed or carried and to provide living accommodation for or other
use by one or more persons.
2.18
"Motor Vehicle" is defined in the Act.
2.19
"Obstruction" shall mean to impede safe and uninterrupted passage of vehicles or
a visual obstruction to motorists.
2.20
"Off Highway Vehicle" means any motorized vehicle designated for cross-country
travel on land, water, snow, ice marsh or swamp land or other natural terrain
without limiting the generality of the foregoing, includes, when designed for such
travel,
(i) 4-wheel drive or low-pressure tire vehicles,
(ii) motor-cycles and related 2-wheel vehicles,
(iii) amphibious machines,
(iv) all-terrain vehicles,
(v) miniature motor vehicles,
(vi) snow-vehicles,
(vii) minibikes, and
(viii) any other means of transportation that is propelled by any power other
than muscular power or wind,
but does not include
(ix) motor boats, or
(x) any other vehicle exempted from all of the provisions of the Act by the
regulations;
2.21
"Park" is defined in the Act.
2.22
"Parking Stand" means that portion of any highway set apart as a place where a
vehicle may be parked and where the context requires, includes a parcel, lot or
place set apart for the public parking of vehicles.
2.23
"Peace Officer" is defined in the Act and includes a duly appointed Bylaw
Enforcement Officer employed by the Town.
2.24
"Pedestrian" is defined in the Act.
2.25
"Playground Zone" means a zone on a highway identified by a traffic control

device as an area where children
(a)
may be expected to be on a highway, or
(b)
are permitted to cross the highway at a designated point along the
highway, and
(c)
have fixed hours to reflect the times pedestrians are using the playground
zones and give motorists consistent and specific times that are easy to remember
2.26
"Possessory Liens Act" means the Possessory Liens Act, RSA 2000, c P-19
2.27
"Pulp Truck" means any vehicle that alone or together with any trailer, semi-trailer
or other vehicle being towed by the motor vehicle is carrying pulpwood or is used
for the purpose of carrying pulpwood and is oversize and/or overweight.
2.28
"Regulation" means the Use of the Highway and Rules of the Road Regulation,
(A.R. 304/2002) made pursuant to the Act.
2.29
"Roadway is defined in the Act.
2.30
"School Zone" means a zone on a highway identified by a traffic control device as
an area where children
(a)
may be expected to be on a highway, or
(b)
are permitted to cross the highway at a designated point along the
highway.
2.31
"Sidewalk" is defined in the Act.
2.32
"Skateboard" means a device consisting of a board with wheels, propelled by
human power upon which a person may ride.
2.33
"Town" means the Town of Hinton.
2.34
"Town Council" means the elected Council of the Town of Hinton.
2.35
"Tractor" which means a motor truck with short chassis for hauling a trailer.
2.36
"Traffic Control Device" means any sign, signal, marking, or
device
placed,
marked or erected under the authority of this Bylaw for the purpose of regulating,
warning or guiding traffic.
2.37
"Traffic Control Signal" means a traffic control device, whether manually,
electrically or mechanically operated, by which traffic is directed to stop and
proceed.
2.38
"Traffic Control Device is defined in the Act.
2.39
"Traffic Control Signal" is defined in the Act.
"Traffic Control Zone" is that part of a highway in the Town designated by Council

as being controlled by a Traffic control signal.
2.40
"Trailer" means a vehicle so designed that it may be attached to or drawn by a
motor vehicle or tractor and intended to transport property or persons and includes
any trailer that is designed, constructed and equipped as a dwelling place, living
abode, or sleeping place, either permanently or temporarily but does not include
machinery or equipment used in the construction or maintenance of highways.
2.41
"Trailer Court" means any area of land within the Town where "trailers" may be
lawfully parked and without restricting the generality of the foregoing, shall include
camp grounds, but shall exclude mobile units situated on lots owned by the owner
of the mobile unit.
2.42
"Truck Route" means a highway within the Town upon which the operation of
Heavy Vehicles is permitted, and which has been designated as such in this
Bylaw
2.43
"Vehicle" Is defined in the Act.
2.44
"All Terrain Vehicle" means a wheeled or tracked motor vehicle designed for travel
primarily on unprepared surfaces such as open country and marshland, but does
not include a snow vehicle, implement of husbandry or construction machinery.
2.45
"Snow Vehicle" means a motor vehicle designed or intended to be driven
exclusively or chiefly on snow or ice, or both.
2.46
"Operator" means a person who drives or is in actual physical control of a vehicle.
2.47
"Owner" includes a person renting an off-highway vehicle or having the exclusive
use of that vehicle under a lease or otherwise for a period of more than thirty (30)
days.
SECTION 3
ADMINISTRATION
3.01
Pursuant to sections 13 and 110 of the Act, the CAO is hereby delegated the
authority to place, erect, display or alter traffic control devices at such locations
within the Town as they may determine, or as Council may by resolution direct,
for the purpose of controlling and regulating traffic, including, but not limited to,
the following specific purposes to:
(a) divide the surface of a Highway into traffic lanes marked by solid or broken
lines.
(b) prohibit "U" turns at any intersection.

(c) designate any intersection or other place on a Highway as an Intersection or
place at which no left-hand turn or right-hand turn shall be made.
(d) designate as a one-way street any Highway or portion thereof.
(e) designate "School Zones" and "Playground Zones";
(f) designate Highways or portions thereof as Truck Routes, parking lots, and
vehicle storage areas for Heavy Vehicles and/or recreational vehicles, and may
cause signs or other Traffic Control Devises to be erected to identify the
beginning and end of a Truck Route.
(g) set apart as a "through-street" any Highway or part of a Highway and to
control entry to any Highway by means of a "stop" sign or "yield' sign.
(h) designate a marked Crosswalk upon any municipal Highway.
(i) designate parking stands, passenger, and truck loading zones, "no parking"
and "no stopping" zones, and the times when the restrictions of such zones are
in effect.
(j) designate "Disabled parking zones".
(k) close or restrict the use of any Highway, bridge or overpass or any part of
any Highway, bridge or overpass either as to the full width thereof or as to part
of the width thereof with respect to any class or classes of vehicles or with
respect to any class or classes of pedestrians.
(l) prohibit, restrict or regulate the parking of vehicles or any particular class of
vehicles on any Highway or other public place or any portion thereof during
such hours as he or she may determine.
(m) designate and mark guidelines for parking on any Highway or other public
place or any portion thereof.
(n) indicate the maximum speed limits for any municipal Highway.
(o)impose limitations or restrictions on loads traveling on municipal Highways.
SECTION 4
SPEED LIMITS
4.01
Speed limits shall be as prescribed by the Traffic Safety Act, except
in section 4.03 hereof.
4.02
Unless otherwise directed by posted Traffic Control Devices no person
shall drive a vehicle at a speed in excess of forty (40) kilometers per hour

on any roadway within the Town.
4.03
Notwithstanding section 4.02 the various maximum speeds from the Highway so
posted shall be as recorded in the following schedules:
(a)
Schedule 4-A - 60 km/hr
(b)
Schedule 4-B - 50 km/hr
(b)
Schedule 4-C - 40 km/hr
(c)
Schedule 4-D - 30 km/hr
(d)
Schedule 4-E - 15 km/hr
SECTION 5
TRUCK ROUTES
5.01
Subject to the provisions of sub-section 5.02, no person shall drive, park or
operate a Heavy Vehicle on any of the Highways of the Town, except those
Highways designated as "Truck Routes". (Schedule 5-A)
5.02
The following shall not be deemed to be operating a vehicle in contravention of
Section 5.01 if the vehicle was being operated on the most direct and practicable
route between the premises or location concerned and the nearest truck route:
(a)
Persons delivering or collecting goods or merchandise to or from the
premises of bona fide customers.
(b)
Persons going directly to or from business premises of the owner of the
heavy vehicle concerned.
(c)
Persons going directly to or from premises for the servicing or repairing of
the Heavy Vehicle.
(d)
Persons pulling a disabled motor vehicle from a Highway prohibited to
heavy vehicles.
(e)
Persons driving a public passenger vehicle in respect of which the owner
holds a subsisting certificate from the Highway Traffic Board of the
Province of Alberta and the owner also holds the written consent of the
CAO to drive and operate the public passenger vehicle upon the highway
upon which it was being operated.
(f)
Persons driving vehicles, owned by or hired for the services for the Town
and, being actually used in the service of the Town, or
(g)
Persons who have obtained written authorization from the CAO to operate
or drive the specific heavy vehicle on the particular highway in the Town

on which he/she was driving or operating the said heavy vehicle.
(h)
Any person driving a truck on a route written authorized by the CAO
shall produce the same when required to do so by a Peace Officer.
SECTION 6
MAXIMUM WEIGHTS AND OVERSIZE VEHICLES
6.01(i)
For the purpose of this Section "maximum weight" means:
(a)
The maximum weight permitted for a vehicle and load pursuant to the
certificate or permit issued for such vehicle under the Motor Transport Act
or the regulations thereunder.
(b)
If there is no certificate or permit issued for such vehicle under the Traffic
Safety Act and Regulations thereunder then the combined weight of the
vehicle and the heaviest load that may be carried in accordance with
provisions of the Motor Transport Act and Regulations thereunder, shall
apply.
(c)
The maximum weight permitted for any vehicle and load as set out in the
Regulations.
6.01(ii)
For the purposes of this section "maximum vehicle size" means any vehicles
which does not exceed the following maximum limits:
(a)
Width 2.5m.
(b)
Height - 3.8m measured from the ground surface to the top of load.
(c)
Wheel base - 10.7m of any single unit;
(d)
Overall length - 18.5m including the overall length of any tractor with semi-
trailer or any other combination of vehicles coupled together.
6.02
Unless he/she has first obtained a permit as provided in sub-section 6.05 of this
Section or subject to Section 7, a person shall not drive or operate on any
Highway within the Town, a vehicle or combination of attached vehicles with a
weight or size, including any load thereon, in excess of maximum weight, or
maximum vehicle size.
6.03
Wherever in their opinion, there is a contravention of sub-section 6.02 of this
Section, a Peace Officer may order the driver or other person in charge or control
of a vehicle or combination of attached vehicles to the nearest adequate weigh
scale to determine the weight of such vehicle or combination of attached vehicles
and load carried thereon. The weigh scale or slips shall be given to the Peace

Officer and may be retained by him and if the weight of any loaded vehicle or
combination of attached loaded vehicles is in excess of maximum weight, the
peace officer, in addition to any prosecution for contravention of sub-section 6.02
hereof, may require that any load or portion thereof in excess of maximum weight
shall be removed before the vehicle or combination of attached vehicles is again
taken upon a highway.
6.04
A person driving or in charge of a vehicle or combination of attached vehicles
suspected by a Peace Officer of being on a roadway in contravention of
sub-section 6.02 of this Section shall, when requested by the Peace Officer
produce for such officer's inspection any certificate or permit for such vehicle or
vehicles that may have been issued under the Act and Regulations thereunder
showing the maximum weight of such vehicles or combination of attached
vehicles.
6.05
Notwithstanding the other provisions of this Section, a person may apply to the
CAO, or such persons as may be designated by the CAO, for a permit to allow on
a roadway a vehicle or combination of attached vehicles with a weight in excess of
maximum weight, or maximum vehicle size. The CAO, in their authority may grant
or deny written permission for such periods as they may set out therein.
SECTION 7
PULP TRUCKS
7.01
A person shall not drive or operate a Pulp Truck on any of the highways of the
Town except those highways designated as Pulp Truck routes in Schedule 7-A.
attached hereto and forming part of this Bylaw.
SECTION 8
DANGEROUS MATERIALS
8.01
No person shall park any vehicle used primarily for the conveying of inflammable,
explosive, corrosive or other dangerous material upon any highway or upon any
property having a building or buildings thereon unless the vehicle is parked upon
the property at least 15.24 m from the nearest building likely to contain persons or
valuable goods; provided that this prohibition shall not apply to the time during
which any such vehicle is necessarily motionless while delivering gasoline or oil to
garages, or retail dealers in gas and oil or other consumers.

SECTION 9
PEDESTRIANS
9.01
A pedestrian shall not cross any roadway within the Town, other than an alley,
except within a marked or unmarked crosswalk., excepting Athabasca Avenue,
Park Street and Pembina Avenue between Switzer Drive and Jasper Street.
9.02
Where a crosswalk at any intersection is marked with lines, no pedestrian shall
cross either of the intersecting highways within the intersection except within
the limits of such marked crosswalk.
9.03
No person shall stand on any highway, crosswalk or sidewalk in such a
manner as to:
(a) Obstruct vehicular or pedestrian traffic;
(b) Annoy or inconvenience any other person lawfully upon such
highway, crosswalk or sidewalk; or
(c) Obstruct the entrance to any building.
9.04
No person shall conduct, organize or participate in a foot, bicycle or E-Bike race
upon any roadway, unless permission for the race has been first obtained.
9.05
No person shall stand upon or walk along any part of a highway within the
Town for the purpose of soliciting a ride from the driver of any private vehicle.
9.06
No person shall Loiter on a sidewalk, Highway or public place within the Town of
Hinton.
SECTION 10
PARKING
10.01
Vehicle parking is permitted with the conditions and/or restrictions indicated in this
Bylaw.
10.02
Motor vehicles shall be parallel parked as may be required, or except as may be
noted otherwise in this Bylaw.
(a)
When parking on a roadway, a driver shall park his vehicle with the sides
of it parallel to the curb or edge of the roadway except as may be noted
otherwise in this Section.
(i)
with the right-hand wheels of it not more than 500mm from the
right-hand curb or edge of the roadway, or
(ii)
in the case of a one-way Highway where parking on either side is
permitted, with the wheels closest to a curb or edge of the roadway
not more than 500mm from the curb or edge and with the vehicle

facing the direction of travel authorized for that Highway;
(b)
Subsection (a) does not apply where angle parking or right-angle parking
is permitted or required.
(c)
When a sign indicates that angle parking is permitted or required
and parking guidelines are visible on the roadway, a driver shall park his
vehicle:
(i)
with its sides between and parallel to any two of the guidelines,
and
(ii)
with one front wheel not more than 500mm from the curb or edge
of the roadway.
(d)
Angle parking shall mean that vehicles are parked at sixty to forty-five
degrees from the curb.
(e)
Right angle parking shall mean that vehicles are parked at ninety degrees
from the curb.
10.03
A driver shall not stop or park his vehicle:
(a)
In a "No Parking Zone" where posted.
(b)(i)
Upon any public land which the Town uses or permits to be used
as a playground, recreation area or public park except on such
part thereof as may be designated by a sign or signs, for vehicle
parking.
(b)(ii) Parking in designated areas on public land shall be permitted only
while using the public land, and for a maximum of 24 hours.
(c)(i)
in a Disabled parking only zone.
(c)(ii)
notwithstanding Section 10.03 (c) a person may park in a restricted
residential zone if such vehicle displays in the windshield the
appropriate permit as issued by the Town of Hinton.
Notwithstanding Section 10.03(c)(i) a person may park in Disabled
parking zone if such vehicle displays in the windshield a Disabled
parking permit as issued by the Alberta Motor Vehicle Branch.
(c)(iii) In a restricted parking zone during the times of restriction so
designated and marked on a Traffic Control Device.
(d)
For longer than a period specified on any Traffic Control Devise.
(e)
On a sidewalk or boulevard.

(f)
On a crosswalk or on any part of a crosswalk.
(g)
Within an intersection other than immediately next to the curb in a "T"
intersection.
(h)
At an intersection nearer than 5m to the projection of the corner property
line immediately ahead or immediately to the rear, except when his vehicle
is parked in a space where a parking metre or other traffic control device
indicates parking is permitted.
(i)
Within 5m on the approach to a stop sign or yield sign.
(j)
Within 5m of any fire hydrant, or when the hydrant is not located at the
curb, within 5m of the point on the curb nearest the hydrant, or as
designated by yellow painted curb.
(k)
Within 1.5m of an access to a garage, private road or driveway, or a
vehicle crossway over a sidewalk.
(l)
Within 5m of the near side of a marked crosswalk.
(m)
Alongside or opposite any street excavation or obstruction when the
stopping or parking would obstruct traffic.
(n)
On any bridge or in any subway or on the approaches to either.
(o)
On the roadway side of a vehicle parked or stopped at the curb or edge of
the roadway, or
(p)
At or near the site of any fire, explosion, accident, or other incident, if
stopping or parking would obstruct traffic or hinder Peace Officers,
firefighters, ambulance attendants or rescue officers or volunteers.
(q)
On Highways designated as rear lanes.
(r)
In front of or across a driveway in a manner which prohibits safe access or
egress.
(s)
No person shall park on a Highway
(i)
a vehicle displayed for sale, or a vehicle displaying advertising
directing persons to any commercial premises.
(ii)
No person shall display any goods for sale, offer any goods for
sale, or sell any goods on a Highway.
(iii)
Notwithstanding subsection (ii), the Town of Hinton may, by bylaw,
permit the display or sale of goods on a sidewalk.
10.04
Notwithstanding subsection 10.03, a person may park a vehicle in a "No Parking

Zone" when attending church, or a funeral or any meeting being held at a school
after 6:00 p.m.
10.05
No person shall park any trailer, whether designed for occupancy by persons or
for the carrying of goods or equipment upon any highway, unless said trailer is
attached to a vehicle by which it may be propelled or drawn and when so attached
the trailer shall be deemed to be part of a vehicle and subject to the regulations
pertaining to vehicles.
10.06
Except as otherwise provided in this Bylaw, no person shall stop or park at any
time in:
(a)
any bus stop properly marked by a sign, or
(b)
any passenger loading zone properly marked by a sign, except for the
purpose of loading or unloading passengers, and no person shall keep
their motor vehicle in a passenger loading zone longer than is necessary
to load or unload his passengers.
(c)
any parking stand specified for a particular use by a certain vehicle
classification or classifications, which parking stand zones and uses are
set forth in Schedule 10-B.
(d)
Any bus or school bus lane marked by a sign indicating the restrictions,
which apply hereto.
10.07
Unloading zones are for the purpose of delivering goods to buildings.
10.08
Where parking lines are visible on a roadway, no driver shall park a vehicle except
within the limits of the lines designating a parking space.
10.09
No person shall park a vehicle so that the bumper or side of the vehicle is closer
than 60cm to the bumper or side of another vehicle.
10.10
No person shall park any vehicle upon any highway within the Town so as to
obstruct the free and safe passage of any other vehicle along such highway.
(i)
No person shall park a vehicle on a highway in such a manner as to cause
a visual obstruction.
(ii)
No person shall deposit on a highway any object or material in
such a manner as to cause a visual obstruction.
10.11
No person shall park any commercial vehicle, bus, truck, engine or trailer of the
design capacity of more than 2,000 kg or a length of more than 8 m except upon
any highway where such parking is expressly permitted, or, except for the purpose

of loading and unloading such vehicle.
10.12
(a)
No person shall park or leave any vehicle on private land or property
unless such person has obtained the permission of the owner, tenant,
occupant or person in charge or control of said land or property.
(b)
Any Peace Officer may tag and cause a vehicle improperly parked on
private property, to be removed and taken to and stored in a suitable place
and all costs for the removal and storage are a lien upon the vehicle which
may be enforced in the manner provided by the Possessory Liens Act.
10.13
(a)
No person shall leave a vehicle standing on a street in one location for
more than 72 consecutive hours. Any such vehicle shall be considered to
be abandoned and shall be towed away and impounded, where it will
remain until claimed by the owner or his agent.
(b)
All costs for the removal and storage are a lien upon the vehicle which
may be enforced in the manner provided by the Possessory Liens Act.
10.14
(a)
When a vehicle is parked in violation of any provision of this Bylaw, any
peace officer may tag and cause the vehicle to be removed to a place
designated by the CAO as a vehicle pound where it will remain impounded
until claimed by the owner thereof or his agent.
(b)
No impounded vehicle shall be released to its owner or his agent until an
impounding charge sufficient to meet the reasonable towing and storage
charges on the vehicle has been paid to the owner of the vehicle pound
and such charge shall be in addition to any fine or penalty imposed in
respect of any such violation, or to any payment made in lieu of
prosecution as hereinafter provided in this Bylaw.
(c)
All costs for the removal and storage are in lien upon the vehicle that may
be enforced in the manner provided by the Possessory Liens Act.
10.15
(a)
No person who is the owner of a motor vehicle or trailer shall park or
operate or suffer or permit any other person to park or operate the motor
vehicle or trailer on a highway at any time during which the owner is not
the holder of a subsisting certificate of registration or permit issued under
the Act for the motor vehicle or trailer.
(b)
No person shall park or cause to be parked on a highway a vehicle or
trailer not displaying a current license plate or transit sticker.

10.16
(1)
A driver shall not turn his vehicle so as to proceed in the opposite direction
(u-turn) unless he can do so in safety and without interfering with other
traffic.
(2)
A driver shall not turn his vehicle so as to proceed in the opposite direction
(u-turn)
(a)
on a curve, or
(b)
on the approach to or near the crest of a grade
where his vehicle cannot be seen by the driver of another vehicle
approaching from their direction within 150 metres.
(3)
In an urban area, a driver shall not turn his vehicle so as to proceed in the
opposite direction (u-turn)
(a)
on a roadway between intersections,
(b)
at a place where a sign prohibits making a U-turn,
(c)
at an intersection controlled by a traffic control signal,
(d)
at an alley intersection, or
(e)
at any other intersection unless the movement can be made in
safety.
SECTION 11
SCHOOL AND PLAYGROUND ZONES
11.01
Pursuant to the provisions of section 107(3) of the Act, the prescribed hours
during which all school and playground zones are in effect in the Town are
hereby increased.
School and Playground zones within the Town shall be in effect from seven
a.m. to nine p.m. (0700 -2100 hrs) every day, and the CAO shall cause Traffic
Control Devices indicating said hours of effect to be displayed accordingly.
11.02
A School Zone begins where there is a Traffic Control Device indicating the school
zone and ends where there is a Traffic Control Device indicating the end of the
School Zone as indicated in Schedule 11-A.
11.04
A Playground Zone begins where there is a traffic control device indicating the
Playground Zone and ends where there is traffic control device indicating the end
of the Playground Zone, or marks the speed permitted. Playground Zones are
identified in Schedule 11-B.

SECTION 12
BICYCLES AND E-BIKES
12.01
A bicycle or E-Bike are authorized to use on sidewalks unless otherwise posted.
12.02
A bicycle or E-Bike are authorized to use on all trails or pathways unless
otherwise posted.
12.03
No bicycle or E-Bike shall be ridden by more than one person at a time.
12.04
Unless the context otherwise requires a person operating a bicycle or an E-Bike
on a Highway within the Town has all the rights and subject to all duties that the
driver of a vehicle has under this Bylaw.
12.05
No person shall leave or operate a bicycle or E-Bike in any public place so as to
obstruct the use or enjoyment of such public place within the Town.
12.06
Any bicycle or E-Bike being operated, used or left in contravention of this Bylaw
may be seized by a Peace Officer and stored in a designated location for a period
not exceeding 14 days, and all costs for the removal and storage are a lien on the
bicycle that may be enforced in a manner provided by the Possessory Liens Act.
12.07
Pedestrians shall maintain the right-of-way over bicycles and E-Bikes that are on
bicycle pathways designated as bicycle path, as designated in Schedule 13-A.
12.08
A person who is operating a bicycle or E-Bike on a highway shall ride as near as
practicable to the right-hand curb or edge or the roadway.
12.09
An E-Bike will meet the Alberta E-Bike regulations,
-
Output cannot exceed 500 W,
-
Cannot assist beyond 32 km/h,
-
Required equipment includes head/tail lamps, reflectors, brakes and horn,
-
Fully operable pedals are required,
-
No driver's license, vehicle insurance, or vehicle registration is required,
-
Approved bicycle or motorcycle helmet is required,
-
Operators must be 12 years of age or older,
-
Is capable of being propelled by muscular power,
-
Has one of the following safety features
(i) an enabling mechanism to turn the electric motor on and off that is
separate from the accelerator controller and fitted in such a manner that it is
operable by the driver, or
(ii) a mechanism that prevents the motor from being engaged before the
bicycle attains a speed of 3 km/h

Bears a label that is permanently affixed by the manufacturer and appears in
a conspicuous location stating, in both official languages, that the vehicle is a
power assisted bicycle.
SECTION 13
TEMPORARY CLOSING OF HIGHWAYS, AND
RESTRICTED USE OF ROAD RIGHTS-OF-WAY
13.01 (i)
For the purpose of maintenance, emergency, or for special circumstances
desirable and in the public interest as determined by the CAO, the CAO or their
delegate may:
(a)
temporarily close in any area of Town, any highway in whole or in part to
traffic, or
(b)
temporarily suspend in any area of the Town, parking privileges and/or
regulations granted by the provisions of this Bylaw, and
(c)
may also place barricades and/or post appropriate notices on or near the
highway or highways concerned, and
(d)
during emergency or maintenance operations, the crews
working
for
the Town are exempt from the regulations of this Bylaw providing
adequate provision has been made for public safety.
13.01 (ii)
If vehicles are found parked upon areas for which parking privileges are
suspended for the purpose of snow removal or street sweeping, these vehicles
may be towed to a storage compound. The owner of the vehicle shall pay to the
towing company, all towing and storage costs prior to the vehicle being released
to the owner.
13.02
RESTRICTED USE OF ROAD RIGHTS-OF-WAY
1.
In this section "Road Rights-of-Way" shall mean land:
(a)
shown as a road on a plan of survey that has been filed or
registered in a Land Titles Office, or
(b)
used or intended to for use as a public road, lane or walkway; and
includes a bridge forming part of a public road and any structure
incidental to a public road.
2.
Within the corporate limits of the Town of Hinton, no person shall operate
any motor vehicle, bicycle, or be a pedestrian on a "Restricted Use Road"
other than that specified as per

Schedule 13-A of this Bylaw.
3.
For the purpose of this Bylaw, permitted use shall pertain to developed
and/or undeveloped Road Rights-of-Way.
SECTION 14
PARADES AND FUNERAL PROCESSIONS
14.01
In this Section "Parade" or "Procession" means any group of pedestrians (except
military parades and processions and funeral processions) numbering more than
fifty persons marching or walking on the road- way or on the sidewalk, or any
group of vehicles (except military parades and processions and funeral
processions) numbering ten or more.
14.02
Any person desiring to hold a parade or procession within the Town shall at least
48 hours prior to the time he/she desires to hold the same, make application in
writing to the CAO or designate and in such application shall furnish to the CAO or
designate information with respect to the following:
(a)
the name and address of the applicant, and if such applicant is an
organization, the names and addresses of the executive thereof.
(b)
the nature and object of such parade or procession,
(c)
the day, date, and hours during which same will be held,
(d)
the intended route thereof,
(e)
the approximate number of persons who will take part therein,
(f)
the approximate size, number and nature of flags, banners, placards, or
such similar things to be carried therein and particulars of signs,
inscriptions and wording to be exhibited thereon; and such written
application shall bear the signatures and addresses of the persons who
will be in control of such parade or procession and who undertake to be
responsible for the good order and conduct thereof.
14.03
The CAO or designate may for any reason that appears to them proper, issue, or
refuse to issue a permit. In the event of a refusal, the applicants concerned may
apply to the Town Council therefore and the Town Council may by resolution or
otherwise direct the issue of such permit, subject to the provisions of this Bylaw.
14.04
Where a permit has been issued pursuant to this section, the CAO shall fix the
hour and route of the parade or procession and give such directions to the
applicants in regard to such parade or procession as in his opinion will prevent

any unnecessary or unreasonable obstruction to the street or sidewalk and tend to
prevent a breach of the peace. The CAO shall make the necessary arrangements
for the proper policing of the streets in connection with such parade or procession
and for such purpose may erect such temporary barriers or traffic control devices
as they deem necessary.
14.05
No person shall hold or take part in any parade unless a permit has been issued
therefore in accordance with the provisions of this Bylaw.
14.06
If any funeral procession is in process of formation or proceeding along any
highway, any Peace Officer may regulate all traffic in the vicinity and all persons
whether on foot or on horse or in vehicles, shall obey the order and direction of the
Peace Officer so regulating traffic.
14.07
Before a funeral procession enters upon, crosses or turns into a highway
designated and marked as a through traffic street by a stop sign, or traffic control
signal the first vehicle in the funeral procession shall come to a complete stop in
the manner required by this Bylaw and shall not drive the vehicle into the
intersection until it is safe to do so. A vehicle that follows in the funeral procession
may then enter into the intersection without stopping provided the headlamps are
alight and the highway can be entered safely. The provisions of this sub-section
shall not apply at intersections where traffic is controlled by a peace officer.
14.08
No person driving any vehicle or riding or driving a horse shall drive or ride
through, nor shall any pedestrian walk through, the ranks of any funeral
procession (the vehicles of which have their lights on), nor through the ranks of
any other authorized parade or procession, or in any way obstruct impede or
interfere with the same.
14.09
No persons shall take part in the organization or conduct of a parade or
procession that forms up, attempts to form up or is carried on without a permit
having been obtained pursuant to this Section.
SECTION 15
FIRES
15.01
In case of a fire within the Town, any Peace Officer or member of the Fire Rescue
Service of the Town may designate in any manner a line or lines near the location
of a fire beyond which no member of the public shall pass, and no unauthorized

person, whether on foot, or in any vehicle or any manner of conveyance shall
cross such line.
15.02
The Chief Officer of the Fire Rescue Services of the Town or any person acting
under their instructions shall have the right to move or cause to be moved any
vehicle which they may deem necessary to move or have moved for the purpose
of carrying out any duty, work or undertaking of the Fire Rescue Services of the
Town.
SECTION 16
BUS STOPS AND PARKING STANDS
16.01
No person shall stop in any area designated as a bus stop except for the sole
purpose of temporarily parking to board or discharge bus passengers and no
person shall stop any bus for the purpose of boarding or discharging passengers.
16.02
Parking Stands shall be parking areas designated for an exclusive use by
specified persons or corporate entities. Schedule 16-A
16.03
Persons assigned to parking stands so designated and the corresponding uses so
specified, shall not regularly use any adjacent parking area.
SECTION 17
VEHICLES WITH LUGS
17.01
No person shall drive, propel, or move on any highway any vehicle having metal
spikes, lugs, cleats, chains or bands projecting from the surface of the wheel or
tire of such vehicle, or any vehicle having a caterpillar tread, unless and until a
special permit from the CAO has been issued pursuant to sub-section 19.02 of
this Section.
17.02
Any person desiring to obtain a permit required by the preceding sub-section shall
make application in writing therefore to the CAO setting out the nature of the
vehicle to be moved, the name of the make thereof, the style of wheels and of any
projections thereto, origin and destination of proposed route and such further
information as the CAO may require. Any person making application shall agree
to pay all damages caused to the highway, or any works made or done over, upon
or under the same because of the operation and conveyance or movement of the
vehicle mentioned in the permit. The CAO may issue such permit specify the
route to be taken, the precautions required to protect the highway along the route
(including the laying down of planks to protect bridges or culverts), the hours

during which the movement shall take place and such other conditions as he/she
deems advisable for the protection of the highways and any works done or made
over or under the same.
SECTION 18
OFF LIMITS AREAS TO VEHICLES
18.01
No person who is an owner or operator of a motor vehicle shall operate or permit
any other person to operate or park a motor vehicle on any municipally owned
land outside of a road allowance unless otherwise posted, or with the prior
written authority of the CAO, or unless designated for vehicular traffic.
18.02
Notwithstanding Section 18.01 no employee or agent of the Town of Hinton will be
in contravention of Section 18.01 while engaged in maintenance of the said lands,
or enforcement of Bylaws.
18.03
(a) No person who is an owner or operator of an Off-Highway Vehicle shall
operate or permit any other person to operate the Off-Highway Vehicle on any
lands within the Town of Hinton, excepting those areas designated specifically for
that purpose or for which the CAO has issued a permit.
(b) Notwithstanding 19.03(a) the Pine Valley Lodge is permitted to utilize
roadways as defined in Schedule 18-A with their electric vehicle carts.
SECTION 19
MISCELLANEOUS SECTIONS
19.01
Every person shall be guilty of an offence who;
(a)
coasts on any highway within the Town, on a sled, toboggan, skis, or
skateboard;
(b)
washes a vehicle upon any highway or drains the radiator of any vehicle
upon a highway or washes a vehicle near a highway so as to result in
slush or ice forming upon a highway or public sidewalk.
(c)
coasts on sidewalks described in Schedule 49 within the Town on a
skateboard. A skateboard being used in contravention of this bylaw may
be seized by a Peace Officer and stored in a designated location for a
period not exceeding fourteen (14) days.
19.02
Any person in control of private property, whose property includes a Highway,
may erect traffic control devices upon the said Highway after having obtained the
written approval of the CAO and any such traffic control devices and their erection

shall be to the specifications of the CAO and in accordance with the provisions of
this Bylaw.
19.03
One-way streets in the Town are as set out in Schedule 19-A attached hereto and
forming part of this Bylaw.
19.04
Pursuant to the Environment Protection and Enhancement Act:
(a)
No person shall dispose of litter on public land unless he disposes of it:
(i)
in a container placed for the purpose of collecting it, or
(ii)
in accordance with the Forest and Prairie Protection Act
hereunder.
(b)
(i)
No person shall dispose of litter on a highway, unless he disposes
of the litter in a container placed for the purpose of collecting it.
(ii)
No person shall transport litter in or on a motor vehicle or trailer on
a highway, if the litter is likely to fall off or blow off the motor vehicle
or trailer, unless the litter while being transported is adequately
secured to prevent it from falling off, or adequately covered to
prevent it from blowing off, the motor vehicle or trailer.
(iii)
If litter is disposed of from:
(a)
a motor vehicle other than a bus or taxi, or
(b) a trailer, and it cannot be determined which of 2 or more
occupants of the motor vehicle or trailer is responsible, the driver of
the motor vehicle shall be deemed to be the person who disposed of
the litter from the motor vehicle or trailer.
(iv)
If litter is disposed of from:
(a)
a motor vehicle other than a bus or taxi, or
(b)
a trailer,
and it cannot be determined who is the driver of the motor
vehicle, the owner of the motor vehicle shall be deemed to
be the person who disposed of the litter from the motor
vehicle or trailer, unless he proves to the satisfaction of a
Court that at the time of the offence the motor vehicle was
not being driven, the trailer was not being tower or the motor
vehicle or trailer was not parked or left by him or by any
other person with his consent, express or implied.

(c)
In this section "litter", means:
(i)
any solid or liquid material or product or combination of solid or
liquid materials or products, including, but not limited to:
(a)
any rubbish, refuse, garbage, paper, package, container,
bottle, can, manure, human or animal excrement or sewage
or the whole or a part of an animal carcass, or
(b)
the whole or part of any article, raw or processed material,
motor vehicle or other machinery, that is disposed of.
19.05
No person on a highway shall cross the single solid line from one lane to another
except when overtaking and passing another vehicle.
SECTION 20
PENALTIES AND OFFENCE TICKETS
20.01
Any person who contravenes any provision of this Bylaw is deemed to be guilty of
an offence and liable to a fine as per Schedule 20-A of this bylaw.
20.02
Any Peace Officer may enforce the provisions of this Bylaw and may issue an
offence ticket to any person found to have committed a breach of the Bylaw. The
offence ticket shall state the alleged offence and the Bylaw number and required
payment of the appropriate fine as provided in Schedule 20-A of this Bylaw to the
Town of Hinton within thirty (30) days of issuance of the ticket.
20.03
An Offence Ticket may be issued by personally serving it upon the offender, by
leaving it at the residence of the offender or by sending it to the address on the
offender's driver's licence or by leaving it upon the vehicle in appropriate cases.
20.04
The provisions of this section are an initial alternative to a summons under Section
13 of this Bylaw. If an Offence Ticket is issued and payment is made within the
time limited, then such payment shall be accepted in lieu of prosecution. If
payment is not made within the time limited, then the alleged offender is not
entitled as of right to settle the alleged offence without a court appearance.
Should the alleged offender fail to make voluntary payment during the time limited
then an additional sum of $25.00 shall be added to the appropriate fine indicated
on the offence ticket. After the time limited for payment of the offence ticket, the
Peace Officer may allow a further period of grace within which the appropriate fine
and the additional $25.00 may be accepted.

(a)
If any court of competent jurisdiction declares any provision of this bylaw
invalid, the invalid portion must be severed and the remainder of the bylaw is
deemed valid.
20.05
If a cheque is given in payment for an offence ticket and the cheque is not
honoured by the financial institution on which it is drawn, the offence ticket shall be
treated in the same manner that it would have been if the cheque had not been
given in payment for the appropriate fine provided.
SECTION 21
REPEAL
21.01 Bylaw No.1023 and amendments thereto are hereby repealed.
SECTION 22
RES0LUTION OF COUNCIL
22.01
Council may amend all schedules pertaining to this Bylaw by resolution of council.
SECTION 23
DATE OF ENACTMENT
23.01
This Bylaw shall come into effect on the date of the final passing thereof.
