SUMMER VILLAGE OF ISLAND LAKE
BYLAW # 01-2025
BEING A BYLAW TO CONTROL AND REGULATE NOISE WITHIN THE
SUMMER VILLAGE OF ISLAND LAKE
WHEREAS, the Council of the Summer Village of Island Lake may pass bylaws for municipal purposes
respecting the safety, health, welfare and the protection of people and property; and
WHEREAS, under the provision of Section 7 of the Municipal Government Act, being Chapter M-26 of the
Revised Statutes of Alberta 2000, and amendments thereto, the Council may pass a bylaw for municipal purposes
respecting nuisances, and the safety, health and welfare of people and the protection of people and property.
WHEREAS, under the provisions of Section 13 (1) (g) of the Traffic Safety Act, being Chapter T-6 of the Revised
Statutes of Alberta 2000, and amendments thereto, the Council of a municipality may make by-laws defining
what constitutes objectionable noises, devising a system of method of determining or measuring such noise, and
prohibiting the operation of motor vehicles which in any manner make objectionable noise;
WHEREAS, the intent of this bylaw is that all objectionable noise shall be reduced or eliminated as much as
possible, compatible with the normal activities of urban life.
NOW THEREFORE, THE Municipal Council of the Summer Village of Island Lake, in Council, duly
assembled, enacts as follows:
1. TITLE
This bylaw may be cited as the "Noise Control Bylaw."
2. DEFINITIONS
1) "Village" means the Summer Village of Island Lake
2) "Council" means the Council of the Summer Village of Island Lake
3) "Designated Officer" means a municipal official appointed by bylaw of the Council to exercise certain
powers or perform duties under a municipal bylaw
4) "Objectionable Noise" means any sound that is clearly audible beyond the property from which it
originates and that, having regard to the time of day, duration and character of the sound, unreasonably
interferes with the health, peace or safety of others
5) "Holiday" means a public holiday as defined in the Interpretation Act (Alberta) and a day or portion of a
day proclaimed by the Mayor or by Council as a civic holiday
6) "Residential Area" means any area or district classified as residential by the Land Use Bylaw 08-2021
7) "Vehicle or Motor Vehicle" refers to such vehicles as defined in Section 1 (1) (x) of the Traffic Safety
Act Chapter T-6 of the Revised Statutes of Alberta 2000, as amended
8) "Person" means and/or includes a corporation and heirs, executors, administrators, or other legal
representatives of a person, and owner/occupier or person apparently in charge
9) "Fireworks, Fire Crackers or Poppers" means a device consisting of a combination of explosives and
combustibles, set off to generate colored lights, smoke and noise for amusement

10) "Appliance" means any device or equipment used for domestic, household, property maintenance,
advertising, or recreational purposes (e.g. lawn mower, snow removal device, motorized model aircraft,
public address system), regardless of power source
11) "Industrial Vehicle" means a vehicle used in commercial or industrial operations, including but not
limited to vacuum trucks, excavators, dump trucks and other similar heavy-duty vehicles.
12) "Village Property" means any land, building, park, roadway, structure, or other real property owned or
controlled by the Village (e.g. ball diamond, park areas).
3. REGULATIONS
(1) Applicability
(a) These regulations do not apply to objectionable noise arising from emergency work or activities that
are:
1. Reasonably necessary to protect the health, safety, or property of any person, or to prevent or
mitigate serious harm to the environment; and
2. Carried out by:
(i) the Village Council, Village Administration, or any contractor acting under their direction; or
(ii) any other person acting reasonably to respond to an actual or imminent emergency.
(b) The exemptions in subsection (a) apply only for the duration of the emergency and only to the extent
that the objectionable noise is reasonably necessary to deal with that emergency.
(c) Where practicable, the person or organization responsible for the objectionable noise shall notify the
Village Administration as soon as possible of the nature of the emergency and the expected duration
of the objectionable noise.
(2) General Prohibition
(a) No person shall make, continue, cause or allow to be made any objectionable noise which, by its
nature, intensity, duration, or time of occurrence, unreasonably disturbs, injures or endangers the
health, peace or safety of other persons within the civic limits of the Village. There should be a marked
departure from the norm, which would offend a reasonable person given all of the circumstances.
(b) No person shall allow property belonging to him/her or under their control to be used so that there
originates from the property any objectionable noise that unreasonably disturbs, injures or endangers
the health, peace or safety of other persons in the vicinity of such property or within the limits of the
Village.
(3) Vehicle Noise Abatement
(a) No person shall operate a motor vehicle on a street within a residential area at any time of the day or
night, so as to create an objectionable noise that unreasonably disturbs residents.
(b) A person may operate an engine-powered device to remove snow or ice from parking lots, roadways,
or sidewalks after a snowfall or rain, for the time reasonably needed to complete the work. A
Designated Officer may revoke this permission for a specific location if necessary.
(4) Loading/Unloading of Industrial Vehicles
(a) No person shall load or unload an industrial vehicle in a residential area between the hours of eleven
o'clock in the evening and seven o'clock in the morning.
(5) Operation of Appliances
(a) No person shall operate an appliance in a residential area between the hours of eleven o'clock in the
evening and seven o'clock in the morning.

(6) Animal Noise
(a) No person in control of an animal shall cause or permit the animal to make or continue to make
objectionable noise that, by reason of its volume, duration, frequency, or time of day, unreasonably
disturbs residents.
(7) Construction Noises
(a) No person shall carry on construction of any kind using equipment, machinery, or mechanical devices
that can be heard beyond the boundary of the construction site between the hours of eleven o'clock in
the evening and seven o'clock in the morning.
(8) Fireworks
(a) No person shall set off fireworks, poppers, or firecrackers after eleven o'clock in the evening.
(b) No person shall set off fireworks, poppers, or firecrackers after midnight on Statutory Holidays and
the adjacent weekend (if applicable).
(9) Noise While Using Village Property
(a) A person shall not use Village property (e.g. ball diamond) in a manner that could result in
objectionable noise unless that person has first obtained written permission from the Village.
(b) No person shall set off fireworks, poppers, or firecrackers on Village property unless that person has
first obtained written permission from the Village.
4. PENALTIES:
Any person who contravenes this Bylaw is guilty of an offence and liable:
(a) for the first offence, to a maximum fine of $250.00;
(b) for the second offence, to a maximum fine of $500.00 and
(c) for the third and each subsequent offence, to a maximum fine of $1,000.00.
