BYLAW NO. 750 OF THE TOWN OF KILLAM IN THE PROVINCE OF ALBERTA A bylaw of the Town of Killam, in the Province of Alberta to regulate the licensing of business, under authority of the Municipal Government Act, Statutes of Alberta, 2005, Chapter M-26.1. WHEREAS for information purposes, the Town of Killam plans to license all businesses operating within the Town, whether in commercial or residential land use district, and WHEREAS the Town of Killam wishes to undertake economic development activities, and believes that increased economic development will be a benefit to local businesses; and thus, will earmark all business license fee revenue as a portion of the funding for economic development activities, and WHEREAS the Municipal Government Act provides for councils to pass bylaws to regulate businesses, business activities and persons engaged in business, and WHEREAS the Municipal Government Act provides that a system of licenses may be enacted NOW THEREFORE the Council of the Town of Killam, duty assembled, hereby enacts as follows: SHORT TITLE 1. This Bylaw may be cited as the "Town of Killam Business License Bylaw". DEFINITIONS 2. "Business" shall mean any business, occupation, profession, trade, calling, manufacturing or craft carried on from a commercial or industrial building, residence or accessory residential building, with the intent to sell any goods and/or services at a reasonable expectation of profit. LICENSING OFFICER 3. The Licensing Officer for the Town of Killam shall be the Administrator or another person designated by the Administrator. The duties of the Licensing Officer are: a.) to invoice and collect business license fees pursuant to this bylaw. REQUIREMENT FOR LICENSE 4.1 No person within the Town of Killam shall carry on or operate a business unless he/she holds a valid license issued pursuant to the provisions of this Bylaw. 4.2 If an individual disputes an activity or operation being classified as business, the licensing officer may ask the individual to demonstrate that no business income and/or expenses are being claimed on his/her personal income tax return. In the case of a new activity or operation, the settlement of the dispute shall be deferred until after the date of next filing of a personal income tax return. No license fee need be paid until after settlement of a dispute. 5. Notwithstanding Section 4 above, no license shall be required for: - a charitable or non-profit organization; or - a person or business if any provincial or federal statute exempts such person or business from the requirement of a municipal license. BUSINESS LICENSE 6. An individual operating more than one business shall pay a license fee for each business. 7. The annual business license fee for any type of business within the Town of Killam shall be set from time to time by resolution of Council. 8. The deadline for renewal each year is February 28th. 9. Those individuals or companies purchasing licenses to sell goods on the street or door to door on a daily or annual basis under Bylaw #719 are not required to purchase an annual business license under this Bylaw. PENALTIES 10. If the amount of the business license invoice isn't paid by the deadline the invoice amount shall be added to the tax roll of this business as per the Municipal Government Act, Statutes of Alberta, 2005, Chapter M-26.1.
