A BYLAW OF LAC LA BICHE COUNTY IN THE PROVINCE OF ALBERTA FOR THE PURPOSE OF
ESTABLISHING A SCHEDULE OF FEES
_____________________________________________________________________________________
WHEREAS under the authority and pursuant to the Municipal Government Act, RSA 2000, Chapter M -26
Sections 7 Lac La Biche County may pass bylaws for municipal purposes respecting people, activities and
things in, on or near a public place or place that is open to the public;
AND WHEREAS Section 7 of the Act provides that a municipality may pass bylaws for services provided by
or on behalf of the municipality;
AND WHEREAS Section 8 of the Act provides that a municipality may pass a bylaw to establish fees for
licenses, permits and approvals;
AND WHEREAS Lac La Biche County wishes to establish, in a bylaw, a schedule of fees for various
municipal services;
AND WHEREAS it is deemed appropriate to consolidate all applicable bylaws and policies to better provide
for the administration of fees.
NOW THEREFORE under the authority and subject to the provisions of the Municipal Government Act, and
by virtue of all other powers enabling it, the Council of Lac La Biche County, duly assembled, enacts as
follows:
Title
1
This bylaw is called the "Schedule of Fees Bylaw"
Definitions

The definition of any word or term used in this bylaw which is defined in the Municipal Government
Act shall have the same definition of the word or term as specified in the Municipal Government Act.
(a) "Administration" means the administrative and operational arm of the Municipality, comprised of
various departments and business units and including all employees who operate under the
leadership and supervision of the Chief Administrative Officer;
(b) "CAO" means the Chief Administrative Officer of the Municipality or their delegate;
(c) "Council" means the municipal Council of Lac La Biche County.

Application
3(1)
Lac La Biche County imposes fees for the provision of services and information as provided in the
attached Schedules, and that the fees enclosed in the Schedules attached hereto and forming part
of this Bylaw be approved and due to Lac La Biche County.

(2)
That should any fees mentioned here may still appear in older bylaws or policies not yet revised, and
the information listed in this Bylaw shall be in full force and effect and supersede previous fees.
(3)
Lac La Biche County has the discretion to enforce this Bylaw.
(4)
New and/or updated Schedules may be added to the Schedule of Fees Bylaw.
(5)
That the attached Schedules, extracted from various County bylaws be repealed from their assigned
bylaw or policy to form an integral part of the Schedule of Fees Bylaw, without harm to the main body
of their respective bylaw or policy, unless otherwise specifically stated.
(6)
That the following amendments are made to the referenced bylaws to coincide with the Schedule of
Fees Bylaw:
(a) Bylaw 18-015 Assessment Review Board Bylaw, section 16 be revised to remove the reference
to "Policy CS-10-012: Schedule of Fees and Charges," and to replace this reference with, "The
Clerk shall administer fees for assessment complaints as outlined in the Schedule of Fees
Bylaw."
(b) Bylaw 13-030 Lac La Biche County's Cemetery Bylaw, section 2.2-Administration, be revised
to remove the reference to the "Lac La Biche County Policy-Schedule of Fees and Charges."
and replace this reference with, "The fees and charges contained in the Schedule of Fees
Bylaw, must be paid in full prior to the use of any lot, to Lac La Biche County."
(c) Bylaw 13-030 Lac La Biche County's Cemetery Bylaw, section 4.1.2-Sale of Lots, be revised
to remove the reference to the "Lac La Biche County Policy-Schedule of Fees and Charges,"
and replace this reference with, "Fees and charges shall be those appearing on the Schedule
of Fees Bylaw, as amended from time to time by Council."
(d) Bylaw 13-030 Lac La Biche County's Cemetery Bylaw, section 4.2.2-Interment and
Disinterment, be revised to remove the reference to the "Lac La Biche County Policy-
Schedule of Fees and Charges", and replace this references with, "No person, other than Lac
La Biche County's Administration shall dig in any lot for the purpose of interfering, or
disinterring human remains. Exceptions may be made for outside contractors, at the discretion
of Lac La Biche County, otherwise, they will be subject to a penalty in accordance with the
Cemeteries Act.
(e) Bylaw 12-003 Waterworks Bylaw, section 14 (a)-Water Rates be revised to remove the
reference to the "Schedule of Fees and Charges Policy", and replace this reference with, "All
consumers shall pay the fees, rates and charges levied on all lands served by or connected to
the Water System of the County (hereinafter referred as the "Water Service Charges"), as per
the Lac La Biche County Schedule of Fees Bylaw."
(f)
Bylaw 12-003 Waterworks Bylaw, section 4 (c)-Water Meters be revised to remove the
reference to the $125 water meter deposit and the deposits associated with larger meters, and
replace this reference with, "The person who wishes to receive water service shall pay a water

meter deposit to Lac La Biche County in accordance with Schedule J of Bylaw 20-002
Schedule of Fees Bylaw.
(g) Bylaw 12-002 Sewer Bylaw, section 7.1.3-Sewer Rates, Opening & Closing of Accounts be
revised to remove the reference to the "Schedule of Fees Policy", and replace with, "All
consumer shall pay the fees, rates and charges levied on all lands served by or connected to
the Sewage System of the County (hereinafter referred as the "Sewer Service Charges"), as
per the Lac La Biche County's Schedule of Fees Bylaw."
(7) Any policy reference made to the "Lac La Biche County Policy-Schedule of Fees and Charges" be
replaced with "the Schedule of Fees Bylaw".
(8) For any fees or charges not listed explicitly in the attached schedules, the CAO or designate has the
authority to set the appropriate fee or charge.
Severability

Each provision of this Bylaw is independent of all other provisions. If any such provision is declared
invalid by a court of competent jurisdiction, all other provisions of this Bylaw will remain valid and
enforceable.
Repeal
5 (1) Policy No. CS-10-012, Schedule of Fees and Charges is hereby repealed upon passing of this bylaw.
(2) Bylaw 17-018 Recreation Facility Fees, Rates & Charges is hereby repealed upon passing of this
bylaw.
(3) Bylaw 17-023 Utility Fees is hereby repealed upon passing of this bylaw.
(4) The following portions of Bylaw 09-042- Natural Gas Bylaw Schedule B is hereby repealed upon
passing of this bylaw:
a) Dishonored Payment Charge
b) Meter and Regulator Moving at Consumer Request
c) Temporary Disconnect (for intermittent service)
d) The Reconnect Fees referenced
e) The Verification and Testing of Meter Fee referenced
f) The Labour Rate referenced
(5) That Schedule C of Bylaw 09-042 Natural Gas Bylaw is hereby repealed upon passing of this bylaw
(6) The following portions of Bylaw 15-034 Waste & Recovery Management Bylaw is hereby repealed
upon passing of this bylaw:
a) Schedule A - The January-December 2016 Rates Tipping Fee Schedule for the following Material
Streams; Industrial; Commercial and Institutional Waste (ICI), Construction and Demolition
(C&D), and Residential.
b) Schedule A - Reference to Residential Loads

This Bylaw shall come into force and effect after third and final reading of this bylaw.
