Wastewater Lagoon Tax Bylaw
BEING A BYLAW OF LAC STE. ANNE COUNTY TO RAISE REVENUE TO PAY FOR THE COST OF
EXPANSION, MAJOR REPAIRS AND THE OPERATION OF LAC STE. ANNE COUNTY LAGOONS
AND WASTEWATER FUNCTIONS
WHEREAS, pursuant to Section 382 of the Municipal Government Act (Alberta), the Council of Lac Ste.
Anne County may pass a special tax by law to raise revenue for a specific purpose or service;
AND WHEREAS the Council of Lac Ste. Anne County is of the view that revenue needs to be raised by way
of a special tax to pay a portion of the costs to be incurred in the expansion, upgrades, and sewer debenture
payments as well as the operation of wastewater functions within the County;
NOW THEREFORE, the Council of Lac Ste. Anne County, in the Province of Alberta, duly assembled,
enacts as follows:
1. Citation
1.1 "Wastewater Lagoon Tax" shall mean a special tax imposed pursuant to
this Bylaw pursuant to Section 382 of the Municipal Government Act (Alberta);
2. Definitions
2.1 "Holding Tank" shall mean a tank designed to retain sewage or effluent until transferred into mobile
equipment for disposal elsewhere and has no other method of disposal (sewage field / mound or
pump out system).
2.2 "Forcemain" shall mean:
a) a sewage collection system operated by the municipality and is located within a hamlet;
b) a sewage collection system operated by the North 43 Lagoon Commission;
c) sewage collection system operated by the Darwell Lagoon Commission.
2.3 "Residential Properties" shall mean:
a) Other Residential Property as defined in Bylaw 11-2024, Assessment Sub Classes Bylaw
b) Vacant Residential Property as defined in Bylaw 11-2024, Assessment Sub Classes Bylaw
c) Recreational Condominium Property as defined in Bylaw 11-2024, Assessment Sub Classes

3. The purpose for which this Bylaw is passed is to raise revenue to pay for the following wastewater
functions:
3.1 For expansion, upgrades and major repairs to the wastewater functions within the County;
3.2 Operating costs of the wastewater functions within the County.
4. The area of the municipality that will benefit from the wastewater functions, and in which the special
tax is to be imposed, is comprised of all Residential Properties located in the County.
5. The estimated cost of:
5.1 The debenture payments, upgrades, expansion, and major repairs to the wastewater functions within the
County is $187,867
5.2 The operating costs of the wastewater functions within the County is $132,258.
6. The tax rate for all residential properties in which their only method of sewage or effluent disposal is a
holding tank is set at $125.00.
7. The tax rate for all residential properties which are connected to the force main is set at
$25.00.
8. The tax rate for residential properties not described in section 6 or 7 is set at $25.00.
9. This Bylaw shall come into force upon third and final reading and replaces Bylaw 06-2025.
