LAC STE. ANNE COUNTY PROVINCE OF ALBERTA BYLAW NO. 08- 2024 BY- LAW NO. 08- 2024 OF LAC STE. ANNE COUNTY TO RAISE REVENUE TO PAY FOR THE COST OF EXPANSION, MAJOR REPAIRS AND THE OPERATION OF LAC STE. ANNE COUNTY WASTE WATER FUNCTIONS. WHEREAS, pursuant to Section 382 of the Municipal Government Act ( Alberta), the Council of Lac Ste. Anne County may pass a special tax by- law to raise revenue for a specific purpose or service; WHEREAS the Council of Lac Ste. Anne County is of the view that revenue needs to be raised by way of a special tax to pay a portion of the costs to be incurred in the expansion, upgrades, major repairs, and sewer debenture payments as well as the operation of waste water functions within the County; NOW THEREFORE, under the authority of the Municipal Government Act ( Alberta), the Council of Lac Ste. Anne County hereby enacts as follows: 1. In this Bylaw: a) " Special Wastewater Lagoon Tax" shall mean a special tax imposed pursuant to this Bylaw pursuant to Section 382 of the Municipal Government Act (Alberta); b) "Holding Tank" shall mean a tank designed to retain sewage or effluent until transferred into mobile equipment for disposal elsewhere and has no other method of disposal ( sewage field / mound or pump out system). c) "Force main" shall mean: i. a sewage collection system operated by the municipality and is located within a hamlet: ii. a sewage collection system operated by the North 43 Lagoon Commission: iii. a sewage collection system operated by the Darwell Lagoon Commission. d) "Residential Properties" shall mean: i. Other Residential Property as defined in Bylaw 11- 2024, Assessment Sub Classes Bylaw ii. Vacant Residential Property as defined in Bylaw 11- 2024, Assessment Sub Classes Bylaw iii. Recreational Condominium Property as defined in Bylaw 11- 2024, Assessment Sub Classes Bylaw 2. The purpose for which this Bylaw is passed is to raise revenue to pay for the following waste water functions: a) For the expansion, upgrades and major repairs to the waste water functions within the County; b) Operating costs of the waste water functions within the County. 3. The area of the municipality that will benefit from the waste water functions, and in which the special tax is to be imposed, is comprised of all Residential Properties located in the County. 4. The estimated cost of: a) The debenture payments, upgrades, expansion, and major repairs to the waste water functions within the County is $ 209, 225. b) Operating costs of the waste water functions within the County is $ 100, 000. BYLAW 08- 2024 WASTE WATER SPECIAL TAX 5. The tax rate for all residential properties in which their only method of sewage or effluent disposal is a holding tank is set at $ 125. 00. 6. The tax rate for all residential properties which are connected to the force main is set at 25. 00. 7. The tax rate for residential properties not described in sections # 5 or # 6 is set at $ 25. 00. 8. This Bylaw shall come into effect on the date of final passage for the 2024 tax year.
