Page 1 of 4 SUMMER VILLAGE OF LARKSPUR A BYLAW TO BE KNOWN AS THE FIRE BYLAW Bylaw Name: Fire Bylaw Bylaw number 25-15 Date Approved: July 22, 2025 Reviewed By: Date Reviewed: WHEREAS the Municipal Government Act, R.S.A. 2000, c. M-26, as amended, provides that a council may pass bylaws for the safety, health, and welfare of people and the protection of people and property; AND WHEREAS the Council of the Summer Village of Larkspur wishes to regulate and control the use and setting of fires within the Summer Village; AND WHEREAS the Council of the Summer Village of Larkspur wishes to provide for the recovery of fire protection costs incurred by the Summer Village; NOW THEREFORE, the Council of the Summer Village of Larkspur, duly assembled, enacts as follows: 1. NAME OF BYLAW 1.1 This Bylaw may be cited as the "Fire Bylaw." 2. DEFINITIONS 2.1 In this Bylaw: a) "Council" means the Council of the Summer Village of Larkspur. b) "CAO" means the Chief Administrative Officer of the Summer Village. c) "Designated Officer" means a person appointed under the MGA whose duties include bylaw enforcement. d) "Fire" means any combustible material in a state of combustion. e) "Fire Department" means any fire or emergency service organization providing service to the Summer Village. f) "Fire Department Property" means all property designated for Fire Department use. g) "Fire Hazard" means a condition increasing the risk of fire. h) "Fire Protection Services" includes prevention, suppression, investigation, and public education. i) "Fire Protection Charge" means any costs incurred by the Summer Village in providing Fire Protection Services. j) "Illegal Fire" means any fire not permitted by this Bylaw. k) "Incident" means any situation where there is danger to life or property to which the Fire Department responds. l) "Member" means a member of the Fire Department. Page 2 of 4 m) "Officer" means the Fire Chief or Deputy Fire Chief. n) "Peace Officer" means as defined in the Provincial Offences Procedure Act. o) "Property" means any real or personal property. p) "Recreational Fire" means a small, controlled fire for light, warmth, or cooking. q) "Running Fire" means a fire not under control. r) "Violation Ticket" means a ticket issued under the Provincial Offences Procedure Act. s) "Alberta Fire Code" means the current Alberta Fire Code. t) "Authority having jurisdiction" means the Fire Chief or delegate. u) "Fireworks" includes high and low hazard as defined in the Alberta Fire Code. 3. POWERS OF MEMBERS 3.1 Members may: a) Enter property to extinguish or control fires. b) Regulate conduct of the public near fires. 4. POWERS OF OFFICERS 4.1 Officers may: a) Authorize use or commandeering of equipment. b) Perform fire suppression activities. c) Regulate conduct of the public near fires. 5. FIRE PROTECTION CHARGES 5.1 Costs may be recovered from: a) Persons responsible for the fire. b) Owners or occupants of property benefiting from fire services. 5.2 Charges are payable within 60 days. 5.3 Unpaid charges may be recovered through court or added to the tax roll. 6. FIRE HAZARDS 6.1 Council may order removal of fire hazards. 6.2 If the order is not followed, the CAO or Designated Officer may perform the work. 6.3 Costs may be added to the tax roll. 7. PERMITTED & PROHIBITED FIRES 7.1 Fires may only be set as permitted by this Bylaw. 7.2 The burning of brush piles, garbage, structures, or other large/noxious materials is prohibited. Page 3 of 4 7.3 Illegal fires must be extinguished immediately or reported to the Fire Department. 8. FIRE BANS 8.1 The CAO may impose a fire ban at the direction of the Regional Fire Chief or in alignment with the Forest Protection Area (FPA) restrictions. 8.2 A fire ban remains in effect until lifted or until a date specified in the notice. 8.3 Notice will be posted at the Summer Village entrance and on AlbertaFireBans.ca. Residents are encouraged to download the Alberta Fire Bans app. 8.4 During a ban, no person shall ignite or allow recreational fires on their property. 8.5 Council may impose additional restrictions by unanimous written agreement. 9. GENERAL OFFENSES 9.1 No person shall: a) Contravene this Bylaw. b) Leave burning material where it may cause a fire. c) Provide false or misleading information. d) Obstruct Fire Department members or damage their property. e) Falsely represent themselves as a member. f) Interfere with firefighting infrastructure. g) Allow a recreational fire to become uncontrolled or hazardous. h) Cause visibility hazards due to smoke. i) Light fires on Summer Village land without written permission. 10. PENALTIES 10.1 Fines shall be as set out in the Summer Village's Fees and Charges Bylaw. 11. VIOLATION TICKETS 11.1 The CAO, Designated Officer, or Peace Officer may issue Violation Tickets for any contravention of this Bylaw. 12. LIABILITY 12.1 Village officials and members of fire services are not liable for actions taken in good faith under this Bylaw. Page 4 of 4 13. GENERAL 13.1 This Bylaw comes into force on the date of final passing. 13.2 Any invalid portion shall not affect the remainder of the Bylaw. 13.3 This bylaw repeals bylaw 12-1.
