Bylaw 750-2009 Water Metering Bylaw VILLAGE OF MANNVILLE BYLAW NO. 750-2009 A BYLAW OF THE VILLAGE OF MANNVILLE ENACTED FOR THE PURPOSE OF AUTHORIZING THE REPLACEMENT OR INSTALLATION OR WATER METERS FOR EACH WATER UTILITY ACCOUNT HOLDER HEREINAFTER REFERRED TO AS THE "WATER METERING BYLAW." WHEREAS Section 7 of the Municipal Government Act, being RSA 2000, C.M-26, as amended, authorizes Council of the Village of Mannville to pass bylaws for municipal purposes respecting public utilities and services provided by or on behalf of the municipality; and WHEREAS the Village of Mannville provides a potable water supply distribution system, and a sewage collection and treatment system and deems it necessary to install new water meters for all current water utility account holders in order to promote water conservation and collect accurate revenues. WHEREAS the Village of Mannville has engaged Neptune Technology Group as its contractor for the purchase and installation of the new water meters, to be known as the 2009 Water Metering Project. NOW THEREFORE the Municipal Council of the Village of Mannville duly assembled ENACTS AS FOLLOWS: 1. The provisions of the Bylaw shall apply to any property obtaining water from the water supply distribution system operated by the Village of Mannville. 2. Each property obtaining water from the water supply distribution system operated a) by the Village of Mannville must be equipped with: a. An operational, interior shut-off valve; b. A water meter; and c. A radio frequency meter and must have an authorized radio frequency transmitter for remote read. 3. All water meters must be installed in an approved location and be readily accessible to authorized representatives of the Village of Mannville for the purpose of verifying, inspecting, repairing or replacing the meter. 4. a) Each property owner must make an appointment on or before April 24, 2009 with Neptune Technology Group (Canada) Ltd. to install a water metering unit compatible with the Neptune Water Metering System. Every person who contravenes this section of the Bylaw is guilty of an offence and upon the issuance of a violation ticket shall pay a specified penalty of $250.00. b) Each property owner shall allow the Neptune Technology Group (Canada) Ltd. installations team access to their property in order to complete the installation. Installations are to commence April 16, 2009. All installations/replacements are scheduled be complete prior to May 8, 2009 (project completion date). c) The cost of the installation of a water meter in compliance with the Neptune Water Metering System shall be at the expense of the Village of Mannville if installed prior to the project completion date. All water metering systems installed on or after May 9, 2009 shall be supplied by the Village of Mannville but installed by and at the expense of the property owner. Qualified personnel shall carry out all water meter system installation and each installation shall be subject to inspection by an authorized inspector. Should an installation prove Bylaw 750-2009 Water Metering Bylaw to be inadequate upon inspection, the property owner shall alter the installation of the satisfaction of the Village of Mannville at the expense of the property owner. d) The Village of Mannville accepts no financial responsibility or liability for damages incurred to private property while accessing or attempting to access the water meter for inspection or replacement. e) Owners of property obtaining water from the water distribution system operated by the Village of Mannville must allow the Village of Mannville or its authorized representative to install a compliant water meter on the owner's property and the Village of Mannville or its authorized representative shall have the right to enter upon the owner's property at periodic intervals for the purpose of verification, inspection, removal, repair or replacement of said meter. f) The property owner shall be responsible for the cost of any additional plumbing requirements beyond the initial meter installation or replacement, such as cut-ins, modifications, or relocations. Should the Village be able to accommodate these requirements as part of the overall project, the cost may be added to the property owner's utility bill over a six month period, upon execution of an agreement to that effect. 5. The Village of Mannville assumes no responsibility for the maintenance, replacement and repairs of any water infrastructure located inside the property owner's property line, with the exception of water meter change outs as initiated from time to time by the Village of Mannville in its sole discretion. The use of a certified plumber is recommended. 6. Mobile Home owners must exercise additional precautions to protect the water meter from damage, including but not limited to the installation and activation of heat tape on the water lines and on the meter; and the enclosure of the water lines and the meter with insulated skirting. Supplies and labour costs for replacement of water meters due to broken frost plates and other preventable damage, are the responsibility of the property owner. 7. Properties not yet equipped with radio frequency meters on or after July 1, 2009, will be billed, bi-monthly, at a flat rate of $125.00 per month for water and sewer services, plus all other standard utility charges until a compliant meter is installed and operational. 8. Water meters installed by the Village of Mannville shall at all times remain the property of the Village of Mannville and shall not be tampered with or interfered with at any time by the property owner, the user or those under his control. Any damage to the said meter shall be paid for by the property owner, on the basis of cost of parts required plus a labor charge of $50.00 per hour, per person with a minimum charge of one hour. 9. No person other than the Public Works Operators or their duly authorized agent shall turn off or turn on, or attempt to turn off or turn on, the water supply from the Village of Mannville water distribution system to the property or attempt to do so. Every person who contravenes this section of this bylaw is guilty of an offence and upon issuance of an offence ticket shall pay a penalty of $250.00. 10. No person, shall intentionally alter a meter placed on any service pipe or connected with it inside or outside any house, building or other place so as to lessen or alter the amount of water registered by it, unless specifically authorized by the Village of Mannville. Every person who contravenes this section of this Bylaw is guilty of an offence and upon the issuance of an offence ticket shall pay a penalty of $250.00. 11. The charges for a municipal utility service provided to a parcel of land are an amount owing to the municipality by the owner of the parcel. If non payment occurs the amount owing will be applied to the Tax Roll for the parcel and collected as taxes. Bylaw 750-2009 Water Metering Bylaw This by-law shall take effect on the day of the final passing thereof.
