Town of McLennan Snow Removal Bylaw No. 2015-06 A BYLAW OF THE TOWN OF McLENNAN TO CONTROL THE REMOVAL OF SNOW FROM PRIVATE PROPERTY. WHEREAS, under the authority of Section 7 of the Municipal Government Act, being Chapter M-26 of the Revised Statues of Alberta 2000, and amendments thereto, Part 2 Bylaws, Division 1, General Jurisdiction, 7 (a) provides that a Municipal Council may pass a bylaw for purposes respecting the safety, health and welfare of people and the protection of people and property. WHEREAS, it is the intention of the Town of McLennan Council to regulate the removal and/or placement of snow on private property and to prohibit the placement of such snow on roadways, public drainage ditches and public property. NOW THEREFORE, The Council of the Town of McLennan, in the Province of Alberta, enacts as follows: Title 1.1 This Bylaw may be cited as the Snow Removal Bylaw Definitions 2.1 In this Bylaw: (a) "Public Place" includes all or any part of a street, a park, a municipal reserve, environmental reserve, buffer strip, drainage ditch or other property of the Town of McLennan; (b) "Street" means public thoroughfares of the Town, including sidewalks which afford a means of access to land abutting it, and includes a lane. Regulations 3.1 No person shall push, blade, shovel, blow or place snow that has accumulated on private property onto any sidewalk, street or public place. 3.2 The Council of the Town of McLennan may designate areas for disposal of accumulated snow and upon such designation being made the owner or occupier of property may dispose of snow upon such places, notwithstanding that such places are public places. 3.3 The owner or occupier of property shall ensure that when clearing or removing snow or ice or other loose debris, that he or she shall refrain from causing injury or unduly interfering with any person lawfully using the sidewalk, street or public place and shall refrain from causing damage to the sidewalks, streets or public places. 3.4 The owner or occupier of property shall ensure that snow disposal be undertaken in such a manner that it does not create a hazard or interfere with the use of streets, sidewalks or public places. 3.5 Snow stored on private property or boulevards immediately abutting private properties shall not contravene the Traffic Bylaw by obstructing traffic or by draining onto adjoining properties. 3.6 Snow can only be stored on public property for a maximum of three business days, then it must be hauled away. 3.7 Snow cleared from private property shall not be deposited on other private property. 3.8 If this bylaw is contravened the Town may, by written order, require the owner or occupant to remove the snow or ice or other accumulation from the street, sidewalk or public place, failing which the Town may take whatever actions or measures are necessary to remedy a contravention of the Bylaw, including removal of the accumulation and add to the tax roll any unpaid expenses and costs incurred by the Town for removing the accumulation. PENALTIES 4.1 Any person who contravenes or fails to comply with any provisions of this bylaw is guilty of an offence and is liable for and subject to a fine of ONE HUNDRED DOLLARS ($100). This bylaw shall take effect on the date of the third and final reading. READ a first time on this 13th day of October, 2015. READ a second time on this 13th day of October, 2015.
