VILLAGE OF MORRIN UTILITIES BYLAW BYLAW #383 A BYLAW OF THE VILLAGE OF MORRIN IN THE PROVINCE OF ALBERTA TO ESTABLISH REGULATIONS GOVERNING THE WATER, SEWER AND SOLID WASTE UTILITIES. WHEREAS pursuant to Section 7 of the Municipal Government Act, RSA 2000, Chapter M-26 and amendments thereto, Cquncil may pass a bylaw regarding public utilities; AND WHEREAS the Council of the Village of Morrin proposes to establish regulations regarding the water, sewer and solid waste utilities provided for the Village of Morrin; NOW THEREFORE the Council of the Village of Morrin, in the Province of Alberta, duly assembled, enacts as follows: L. TITLE This Bylaw may be cited as the "Utilities Bylaw". 2. DEFINITIONS 2.1 "Act" or "MGA" means the Municipal Government Act (MGA), RSA 2000 Chapter M-26 and regulations made under the MGA as amended. 3. UTILITY RATES 3.1 Water, sewer and solid waste utility rates shall be set at Council's discretion by bylaw. 4. UTILITY DEPOSIT 4.I A utility deposit shall be charged at the time an account is registered with the Village of Morrin. 4.2 The amount of the utility deposit shall be three times the total monthly utility rate at that time for water, sewer and solid waste utilities. 4.3 The utility deposit will be refunded to the resident when the resident moves, the water service is disconnected and all utility accounts are paid in full. 5. ACCOUNTS 5.1 All water service, unless officially turned off by the Village Public Works, shall be considered in use and charged accordingly. (Section 42, MGA) 5.2 All accounts for water, sewer and solid waste services shall be payable when rendered. Utilities Bylaw #383 5.3 Services are liable to be discontinued including shutoff of water services in the event that an account is not paid within ninety (90) days from the date that the account is rendered. 5.4 ln the event water services are disconnected due to unpaid accounts, the water service will be re-connected after all arrears owing and the re-connection charge levied in accordance with the Rates & Fees Bylaw are paid in full. 5.5 Accounts for water, sewer and solid waste services shall be forwarded monthly to the owner or occupant of the property connected to the water/sewer works system and shall be payable at the Village Office. 5.6 Accounts shall be deemed to be sufficiently forwarded if they are mailed by ordinary mail to the owner or occupant at the known mailing address. 5.7 Pursuant to Section,553, MGA, any arrears on discontinued accounts outstanding on December 31 of any given year, may be charged as taxes against a property and may be entered on the Tax Roll to the real property to which water, sewer and solid waste services have been provided. 5.8 All new accounts will receive a copy of this Bylaw when their deposit is paid to the Village Office. EFFECTIVE DATE This Bylaw shall come into force and effect when it receives third reading and it is duly signed. Repeal of Bylaw Bylaw 373 and all amending bylaws are hereby repealed.
